Sec. 32-881. - Compliance with official plans and other county ordinance.

The county establishes as policy that the standards, regulations, administration, enforcement and other activities of this chapter are intended to plan, implement and achieve the purposes, objectives and plans contained in the current editions of the county's comprehensive land development plan and any official plans adopted by the planning board and/or the board of commissioners or required by this article.

Sec. 32-901. - Establishment of annual report.

(a)

A telecommunication tower location plan for the county shall be developed annually by the planning board and presented to the board of commissioners for adoption. The purpose of this plan is to facilitate the telecommunication needs of the services providers and to protect the interests of the citizens of the county.

(b)

Such report shall include but is not limited to the following:

(1)

Information concerning existing towers in the county, including ownership/operator, service providers using tower, general specifications of the tower design and height, and available collocations remaining.

(2)

Information concerning towers proposed to be sited within the succeeding 12 months, including the following:

a.

Proposed search area for each proposed tower.

b.

Information on proposed tower design, including tower type, height number of collocations available, including applicant and any general engineering information as to the decisions on the proposed tower design.

c.

Information on existing towers or alternative antenna structures that serve as collocation sites.

(c)

Process of adoption of the telecommunication tower location plan is as follows:

(1)

All proposals for new towers or additional height to existing towers shall be reviewed at an annual meeting date determined by the planning board. Information submitted shall be presented in person by a representative of the service provider to the planning board at this meeting. The planning board's review shall be conducted within 60 days of the annual meeting.

(2)

A comprehensive tower location plan shall be recommended by the planning board to the board of commissioners for approval within the period stated in subsection (c)(1) of this section. If the planning board fails to make a recommended tower location plan, the board of commissioners shall prepare and adopt the tower location plan as provided in this subsection. The board of commissioners may hold a public hearing to receive public input about the telecommunication tower location plan prior to its approval. After approval of the plan, any applications for new or additional height to existing towers shall be applied for as provided in this division.
