ARTICLE II

ESTABLISHMENT OF ZONING DISTRICTS

Sec. 32-41. - Establishment of zoning districts.

The county is divided into the minimum number of zoning districts necessary to achieve compatibility of uses and character within each district, to implement the adopted comprehensive plan, and to achieve the purposes of this chapter.

Sec. 32-42. - Zoning districts.

Table 02.010 indicates the zoning districts and references the section where their purpose statements may be found.

Sec. 32-43. - Zoning map.

Zoning districts established by this chapter are bounded and defined as shown on the official zoning map of the county, also referred to as the zoning map or zoning map atlas. The zoning map atlas, and all its information is a part of this chapter.

Sec. 32-44. - Interpretation of district boundaries.

The following rules shall be used to determine the precise location of any zoning district boundary line shown on the zoning map:

(1)

Boundaries shown as following or approximately following streets, alleys or railroads shall be construed as following the centerline of such features.

(2)

Boundary lines shown as following or approximately following lot lines, municipal boundaries, survey or other property lines, or municipal boundaries shall be construed as following such lines.

(3)

Boundaries shown as following or approximately following the centerline of streams, rivers, other continuously flowing watercourses or levees shall be construed as following the channel centerline of such watercourses. In the event of a natural change in the location of such streams, rivers or other watercourses, the zoning district boundary shall be construed as moving with the channel centerline.

(4)

Boundaries shown as separated from and parallel or approximately parallel to any of the features listed in subsections (1)—(3) of this section shall be construed to be parallel to such features and at such distances as are shown on the zoning map.

(5)

Watershed boundaries shall follow the ridge line where the topography slopes in two directions. Where the watershed line is within 25 feet of a property line, it shall be considered to follow the property line.

Sec. 32-45. - New or unclassified land.

Any land not shown or labeled on the zoning map shall be considered zoned agricultural residential (AR-40).

Sec. 32-61. - Agricultural residential district 80 (AR-80).

The AR-80 district is established to promote a compatible mixture of agricultural, forestry, conservation and very-low-density residential uses where few public services will be available. This district aims to preserve the environment through protection of prime farm land and water quality in the WSW-II critical area in water supply watersheds.

Sec. 32-62. - Agricultural residential district 40 (AR-40).

The AR-40 district is established to promote a compatible mixture of agricultural, forestry, conservation and very-low-density residential uses where few public services will be available. Protection of the environment, preservation of prime farm land, and the continuation of rural lifestyles are goals this district seeks to attain.

Sec. 32-63. - Residential district (R-25).

The R-25 district is established primarily as a medium-density residential district where off-site water and sewer is available.

Sec. 32-64. - Manufactured home park district (MHPD).

The MHPD district is established to provide areas for manufactured or mobile home parks or subdivisions where singlewide units are permitted.

Sec. 32-65. - Highway business district (HB).

The purpose of the HB district shall be to provide for and encourage the proper grouping and development of uses primarily along major roads for businesses that want a location with access to higher volumes of traffic. It is also intended to provide locations for businesses which will best accommodate the needs of the motoring public. The standards are intended to reduce highway congestion and hazard and to ensure that the uses are not a blight on the county's character.

Sec. 32-66. - Neighborhood business district (NB).

The NB district is established for business development serving the business needs of the rural community. The size and uses in the district are intended to serve the community, rather than regional or highway markets.

Sec. 32-67. - Prime industrial district (I-1).

The purpose of the I-1 district is to establish and provide areas for high-quality industrial, manufacturing, wholesaling and warehousing operations.

Sec. 32-68. - General industrial district (I-2).

The purpose of the I-2 district is to establish and preserve areas for heavy industrial and related uses and is designed to accommodate all but the most objectionable industries; however, industries permitted by right are required to minimize their emission of smoke, dust, fumes, glare, noise and vibrations. This district should be separated from residential areas whenever possible by natural or structural features such as sharp breaks in topography, strips of vegetation or traffic arteries. This district shall be located adjacent to and/or with direct access to thoroughfare roads or streets.

Sec. 32-69. - Office/institutional district (O/I).

The purpose of the O/I district is to provide locations for medium-intensity office and institutional land use and to function as a buffer between districts which may conflict with one another. Generally, these areas should have water and sewer mains that either exist at the site or are to be made available during the development process. The maximum amount of land to be zoned as an O/I classification should not exceed eight acres if the site is surrounded by high-density residential development. In addition, vehicular access must consist of direct ingress and egress to a public road classified as either arterial or collector as designated by the thoroughfare plan for the county prepared by the state department of transportation and adopted by the board of commissioners.

Sec. 32-70. - Agricultural support enterprises conditional zoning district (ASE-CZ).

The ASE-CZ district is established as floating zoning district allowing for the development of specific land uses in accordance with established standards. This zoning district requires the approval of a zoning map amendment (rezoning) by the board of county commissioners, approval of a site plan (if applicable), and may include agreed-upon conditions of development. Land uses permitted within the district can be found in section 32-144 of this Code of Ordinances. Any applicable site plan must meet the standards of appendix 7 of the land development code. Any permitted land use in this district must comply at minimum with the bulk standards in table 04.100B for non-residential uses in the AR-40 zoning district; and, articles V, VII (signs allowed in AR-40 zoning district per table 07.105 of this chapter), VIII, IX, X, XI, XII, XV, XVI, XVII, and XIX of this chapter.
