CHAPTER 17

03 - DISTRICT SPECIFIC PROVISIONS

17.03.010 - Allowed uses.

A. The uses identified in Table 17.03.010.C. are those uses allowed in the village's zoning districts.

B. Use Regulations and Interpretation.

1. Permitted uses are identified in Table 17.03.010.C. with a "P" in the row corresponding to the use in question.

2. Special uses are identified in Table 17.03.010.C. with a "S" in the row corresponding to the use in question.

3. Conditions applicable to a specific use are referenced in the "Additional Regulations" column of Table 17.03.010.C.

4. Uses identified in Table 17.03.010.C. with a "-" or otherwise not listed are prohibited. However, the zoning administrator may determine that a proposed use is substantially similar to a use identified in Table 17.03.010.D. In such case, the use shall be treated in the same manner as the use the zoning administrator found it to be substantially similar to.

5. Uses identified in Table 17.03.010.C. that are not defined in Chapter 17.10 of this title shall be defined in accordance with the North American Industry Classification System (NAICS), as amended.

Notes:
(1) Where the front yard setback for fifty (50) percent of the frontage on the same side of a street as the subject property, between two intersecting streets exceeds the minimum, the front yard setback shall be not less than the average front yard setback for the existing buildings.
(2) If any side, corner side, or rear yard is adjacent to a residential district, the requirements for that yard shall double.
(3) If any side, corner side, or rear yard is adjacent to a residential district, the requirements for that yard shall increase to 20% of the total lot area.

17.03.030 - Permitted obstructions in required yards.

A. All Yards:

1. Chimneys, but not extending more than two feet into a required setback;

2. Bay windows, but not extending more than two feet into a required setback;

3. Eaves, but not extending more than two feet into a required setback;

4. Gutters and downspouts, but not extending more than twelve (12) inches from the edge of the eaves;

5. Basketball poles, hoops, and backboards.

B. Side Yards:

1. Stairs from a side door, but not extending more than three feet into the required setback;

2. Canopy over a side door entrance, but not extending more than three feet into the required setback;

C. Front and Corner Side Yards:

1. Open, unenclosed porches and stairs, but not extending more than eight feet into the required setback;

D. Rear Yards:

1. Swing sets and other similar recreation equipment;

2. Decks and patios;

3. Swimming pools;

4. Storage sheds, but not over eight feet in height;

5. Radio or television poles, towers, or antennae, including satellite dishes.
