Principal uses and structures permitted in the R-E District, except principal uses and structures in the R-2 and R-3 District.

Single-family detached dwellings.

Cluster housing, subject to regulations stipulated in Article XL and subject to site plan approval by the Planning Board.

Private nonprofit elementary or secondary schools accredited by the New York State Department of Education.

Public libraries and public museums.

The following uses by special use permit authorized by the Planning Board (see Article XLVI):

Accessory uses and structures customarily incidental to permitted principal uses.

Private garages or off-street parking spaces (see Article XXXII), including the parking of not more than one commercial vehicle, provided that the vehicle is used by the occupant of the premises, does not exceed 3/4 ton rated capacity and is stored within a completely enclosed building.

Storage of unoccupied house trailers, utility trailers or boats owned by the occupant of the premises for his personal use.

Buildings for private horticultural purposes, not to exceed 500 square feet in floor area, provided that such buildings are located to the rear of the front setback line and do not occupy any part of a required side yard.

Private tennis courts and/or private swimming pools, provided that any such facility is located to the rear of the front setback line and does not occupy any part of a required side yard. In the case of any private nonmovable swimming pool, such pool shall comply with applicable provisions of Chapter 232 of the Code of the Town of Hamburg.[1]

Professional residence-offices, when approved by the Zoning Board of Appeals, provided that:

Home occupations, as defined in this chapter. Home businesses, as defined in this chapter, when reviewed and approved by the Code Enforcement Officer.

Satellite dish antennas, provided that they are of a dull finish and located as close to the main structure in the rear yard and as far from property lines as possible.

Temporary structures, as defined in § 280-342 of this chapter, are permitted for a period of time not to exceed seven consecutive days.

Fifteen thousand square feet where the lot is served by a public sanitary sewer.

Thirty thousand square feet where a lot is not served by a public sanitary sewer.

Ninety feet where a lot is served by a public sanitary sewer.

One hundred feet where a lot is not served by a public sanitary sewer.

Single-family dwellings: The minimum width of any side yard shall be 10 feet. The total minimum width of both side yards shall be 25 feet.

Other principal buildings: Except as otherwise provided, each side yard shall equal 30 feet or a distance equal to the height of the principal building, whichever is a greater; provided, however, that when a side yard adjoins a lot in any district other than an R District, such side yard shall equal 15 feet or a distance equal to 1/2 the height of the principal building, whichever is greater.
