Fences may be erected to a maximum height of six feet and a minimum height of not less than three feet. The acceptable materials for use as a fence and the construction of the fence are established in the provisions of Chapter 21, Building Code, § 21.126, of the Municipal Code of the City of Hometown. Any rear lot line fence abutting the Wabash Railroad right-of-way may be erected to a maximum height of eight feet.[1]

All designs are subject to the approval of the Building Commissioner.

Decorative slats may be installed on chain-link fences. Where there exists a fence along the rear yard property line and along party line in a rear yard, a second fence shall not be installed parallel to the existing fence, except a patio fence.[2]

Patio fences may be erected in rear yards only, to a height of six feet (or average of six feet for stepped fencing) extending a maximum of 10 feet from the rear wall of the original building parallel to and along the party lot line of duplex houses. Such fence may be of wood materials, pierced masonry or ornamental iron providing not less than 10% daylight openings. In the case of a stepped fence, no portion shall be higher than the bottom of the facia board of original construction and the highest point will be adjacent to the building.

The fence may be located on the party lot line if agreed to and erected by the mutual owners; each to give the other a letter of consent and approval.

If one owner erects a patio fence, it shall be located 36 inches from the party lot line.
