B Two-Family Duplex Dwelling District Regulations
§ 22.25 Scope.
The regulations set forth in this article, or set forth elsewhere in this chapter when referred to in this article, are the B Two-Family Duplex Dwelling District regulations.
§ 22.26 Permitted uses.

The following uses are permitted in the B Two-Family Duplex Dwelling District:
(A)
Any use allowed as a permitted use in the A Single-Family Dwelling District.

Editor's Note: Section 2 of this ordinance stated that pursuant to § 22.45 of the Hometown Zoning Ordinance, the lawful use of any building existing at the time of the adoption of this ordinance may be continued, although such use does not conform with the provisions hereof. The remaining provisions of Article 13, Nonconforming Uses, of the Hometown Zoning Ordinance shall govern the status of any legal nonconforming use.
(B)
Two-family duplex dwellings.
(C)
Private garages.
(1)
Interior lots. A private garage may be erected upon each building side to house no more than two automobiles and may only be located two feet away from a side lot line and five feet from the rear lot line; and such garage shall not exceed in size 18 feet in width by 22 feet in depth. Under no circumstances shall a garage be erected that extends beyond the building line of the adjoining property. No shed, shack, lean-to, extension or other structure may be erected against said garage or residential unit or any other portion of the building site, except as provided for in this chapter. Any garage so erected shall be of brick or frame construction with a hip or gable composition shingle roof. Any brick or frame siding shall conform to the color, size, type and design of the similar materials used in the residential unit erected on said lot.
(2)
Corner lots: same as interior lots except five feet from rear lot line and front of garage not closer to the street than the extended line of the street side wall of the existing residence and not farther from the street than 30 feet from the party side lot line.
§ 22.26.1 Special uses.

The following uses, be they principal or as an accessory use, shall be considered special uses in the B Two-Family Duplex Dwelling District and shall not be developed or used without a special use permit:
(A)
Any use allowed as a special use in the A Single-Family Dwelling District.

§ 22.27 Parking regulations. [1]
§ 22.28 Height regulations. [1]
The height regulations in the B Two-Family Duplex Dwelling District are the same as in the A Single-Family Dwelling Districts. Additions above the original roof on duplex dwellings that have an existing addition will be integrated in design with the existing second addition to preserve the appearance of a single-family unit. The maximum height allowed for any garage shall be established in Chapter 21, Article 9, Garages, of the Municipal Code of the City of Hometown.
§ 22.29 Yard areas.
(A)
Front yard. Minimum setback regulations are the same as in the A Single-Family Dwelling Districts.
(B)
Side yard. Side yard regulations are the same as in the A Single-Family Dwelling Districts, except there must be a ten-foot side yard along the lot line opposite the party wall lot line and a three-foot side yard along the party wall lot line, with the following exceptions:
(1)
If there is an existing addition on the party wall line or if both duplex partners extend corresponding additions simultaneously. Such additions may extend to the party wall line and will have the party wall extended between the additions.
(2)
If one or both sides of a duplex are raised to permit the construction of a basement, such development may extend to the party wall whether both sides are developed simultaneously or not. Written consent of the duplex partner will be required. Such consent to grant right of access for maintenance will be recorded. Evidence of such recording shall be presented to the Building Commissioner prior to the issuance of a permit.
(C)
Rear yard: not less than 30 feet between the main building and rear lot line.
