Sec. 11-25

Conditional uses.

(a)

Certain uses exist which would not generally be acceptable as an outright use in various zone districts, however, if controlled as to number, area, location, or relation to adjacent and surrounding uses, these uses would not be injurious to the public health, safety or general welfare. Such uses are hereby classified as conditional uses and are subject to the provisions specified herein.

(b)

Any conditional uses listed in this chapter shall be permitted only after review by the planning commission with a specific recommendation to the council and approved by the council.

(c)

A conditional use permit may be granted only upon finding all of the following:

(1)

That the conditional use will not be injurious to the use and enjoyment of the environment or of other property in the immediate vicinity, or substantially diminish and impair property values within the surrounding neighborhood;

(2)

That the proposed conditional use will not increase local or state expenditures in relation to costs of servicing or maintaining neighboring properties;

(3)

That the establishment of the conditional use will not impede the normal and orderly development and improvement of surrounding property for uses predominant in the area; and

(4)

That the location and character of the proposed conditional use are considered to be consistent with a desirable pattern of development for the locality in general.

(d)

Application for conditional use permit shall be filed with the zoning administrator on a form provided for that purpose. The application shall be accompanied by plans, drawings, surveys or other data as necessary to fully describe the proposed use and its impact on surrounding property.

(e)

A nonrefundable filing fee of $40.00 shall accompany the application.
