ARTICLE XXI

ENFORCEMENT AND PENALTIES

Sec. 21.00.- Violations and penalties.

(a)

Wherever by the provisions of this Ordinance the performance of any act if prohibited, or omission to act, or wherever any regulation, dimension or limitation is imposed on the use of, or upon any land, or on the erection or alterations or the use of change of occupancy of structure or the use within such structure, a failure to comply with such provisions of this Ordinance shall constitute a violation of this Ordinance. A separate offense shall be deemed committed upon each day during or when a violation occurs or continues.

(b)

Any person, or any other acting in behalf of said person, violating any of the provisions of this Ordinance shall upon conviction thereof be subject to a fine of not more than five hundred dollars ($500.00) and the costs of the prosecution or by imprisonment for not more than ninety (90) days, or by both such fine and imprisonment at the discretion of the Court.

The imposition of any sentence shall not exempt the offense from compliance with the requirements of this Ordinance.

(c)

Civil rights or remedies not affected. The provisions of this Ordinance are not to be deemed to affect any civil rights or remedies existing at the time when this Ordinance takes effect, by virtue of the common law or of any provisions of statute.

(d)

Civil remedies preserved. The omission to specify or affirm in this Ordinance any liability to damages, penalties, forfeiture or other remedy, imposed by law, and allowed to be recovered or enforced in any civil action or proceeding, for any act or omission declared punishable herein does not affect any right to recover or enforce the same.

Sec. 21.01. - Public nuisance.

Any building or structure which is erected, altered or converted, or any use of premises or land which is begun or changes subsequent to the time of passage of this Ordinance in violation of any of the provisions thereof is hereby declared to be a public nuisance per se and shall be abated by order of a court by competent jurisdiction.
