CHAPTER 10B

OFFICE AND RESEARCH DISTRICT O&R

5-10B-1: PURPOSE:

An office and research district (O&R) is established to allow office and research development and accessory uses at appropriate locations within the village. The uses allowed within this district are intended to serve area residents, and enhance the economic base of the village. The O&R office and research district should be located along roadways where adequate access can be provided without disrupting residential areas. The visibility afforded to parcels along these roadways requires site and building design that enhance the economic viability of the business and aesthetic quality of the public right of way. Impacts on existing and future residences, in and adjacent to the village, should be further minimized by the provision of appropriate perimeter buffers and by promoting design in this district which is compatible with the character of Kildeer and viable office and research development. 5-10B-2: PERMITTED USES:

The following uses, and no others, shall be permitted as of right in the O&R office and research district. In interpreting the use designations in this chapter, references to the North American industry classification system, United States, 2007, where applicable, are given in parentheses following each use:
   A.   Offices:
      Offices, business and professional, not elsewhere specified.
   B.   Finance And Insurance:
      Finance and insurance (52) except see special use provisions for freestanding commercial banking and savings institutions.
   C.   Real Estate, Rental And Leasing:
      Activities related to real estate (5313).
      Lessors of real estate (5311), except miniwarehouses and self-storage units (53113).
      Offices of real estate agents and brokers (5312).
   D.   Professional, Scientific And Technical Services:
      Accounting, tax preparation, bookkeeping, and payroll services (5412).
      Advertising and related services (5418).
      Architectural, engineering, and related services (5413).
      Computer system design and related services (5415).
      Legal services (5411).
      Management of companies and enterprises (55).
      Management, scientific, and technical consulting services (5416).
      Marketing research and public opinion polling (54191).
      Photographic services (54192).
      Scientific research and development services (5417).
      Specialized design services (5414).

   E.   Administration And Support Services:
      Business support services (5614).

   F.   Educational Services:
      Business schools and computer and management training (6114).

   G.   Healthcare And Social Assistance:
      Home healthcare services (6216).
      Individual and family services (6241).
      Medical and diagnostic laboratories (6215).

      Outpatient care services (6214).
      Vocational and rehabilitation services (6243).
   H.   Accessory Retail: Accessory retail uses which are incidental to the primary O&R use and shall be for the convenience of the tenants and employees of the building or structure in which it is located. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-3: SPECIAL USES:

The following uses, and no others, may be permitted by special use permit in accordance with the provisions of chapter 17 of this title. In interpreting the use designations in this chapter, references to the North American industry classification system, United States, 2007, where applicable, are given in parentheses following each use:
   A.   Retail Trade:
      Retail trade uses as allowed in the B zoning district provided, however, that any such use shall be compatible with and consistent with existing office uses in the vicinity of the proposed use.
   B.   Finance And Insurance:
      Bank in freestanding building with drive-through and/or external ATM (522110) with safety requirements for pedestrian and vehicular circulation, including: adequate stacking, no conflicts with other vehicles entering or leaving the site, opportunity for a person in line to safely exit the line, minimum conflict with pedestrians, and adequate lighting.
      Savings institution in freestanding building with drive-through and/or external ATM (522120) with safety requirements for pedestrian and vehicular circulation, including: adequate stacking, no conflicts with other vehicles entering or leaving the site, opportunity for a person in line to safely exit the line, minimum conflict with pedestrians, and adequate lighting.
   C.   Healthcare And Social Assistance:
      Child daycare services (6244).
   D.   Arts, Entertainment And Recreation:
      Fitness and recreational sports centers (713940).
   E.   Accommodation And Food Services:
      Full service restaurants (722110).
      Hotels and motels (721110).
      Limited service restaurants (722211).
      Snack and nonalcoholic beverage bars (722213).
   F.   Other Services:
      Dry cleaning and laundry except coin operated (812320).
   G.   Planned Business Development:
      All new development or redevelopment of properties adjacent to Rand Road shall be processed as planned developments, regardless of parcel size. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-4: CONDITIONS OF USE:

All uses permitted in this district shall be subject to the following conditions:
   A.   There shall be no manufacture, processing or treatment of products other than those which are clearly incidental and essential to the business conducted on the same premises.
   B.   Such uses, operations or products shall not be objectionable due to odor, dust, smoke, noise or vibrations or other similar causes. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-5: MINIMUM LOT AREA:

No lot or parcel of land used for business purposes shall be less than ten thousand (10,000) square feet in area where municipal sewer and water utilities are provided and not less than twenty thousand (20,000) square feet where such utilities are not provided. Further, such lot or parcel of land shall have a minimum width at the building line of sixty feet (60'). (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-7: OFF STREET PARKING AND LOADING:

Parking and loading facilities shall be provided as required or permitted in chapter 13 of this title and conforming to the following:
   A.   Off street loading shall not be located in a front or corner side yard.
   B.   Concrete curbs shall be constructed around the perimeter of all off street parking and off street loading facilities.
   C.   Curbed, landscaped islands shall be provided in off street parking lots containing twenty (20) or more spaces in accordance with the following:
      1.   Landscaped islands shall be a minimum of six feet (6') wide, as measured between backs of curbs.
      2.   One island shall be installed for each fifteen (15) off street parking spaces. Landscaped islands shall be planted with not less than one shade tree and ground cover and/or shrubs.
      3.   Shrubs installed in islands shall be low growing, and trees shall be high branched so as to maintain a clear line of sight for motorists that is between three feet (3') and five feet (5') aboveground. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-8: BUILDING HEIGHT:

The height of any structure shall not exceed two and one-half (21/2) stories, nor shall it exceed thirty five feet (35'), except as provided herein. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-9: TRANSITIONAL YARDS:

Where an O&R district adjoins a residence district (R-1, R-2 and residential portion of PD-1, PD-2, and PD-3), transitional yards shall be provided as follows:
   A.   Where an O&R district fronts on a street and at least fifty percent (50%) of the property frontage directly across the street is in a residence district, there shall be provided a front yard setback in the O&R district of not less than thirty feet (30') in depth. No off street parking spaces may be located in said O&R district front yard setback.
   B.   In an O&R district where a side yard is adjacent to a side yard of property in a residence district, there shall be provided a side yard setback in the O&R district of not less than thirty five feet (35') in depth. No off street parking spaces may be located in said O&R district side yard setback.
   C.   In an O&R district where a side yard is adjacent to a rear yard of property in a residence district, there shall be provided a side yard setback in the O&R district of not less than thirty five feet (35') in depth. Off street parking spaces may be located in said O&R district side yard setback but shall not be closer than fifteen feet (15') to the lot line.
   D.   In an O&R district where a rear yard is adjacent to a side yard or rear yard of property in a residence district, there shall be provided a rear yard setback in the O&R district of not less than fifty feet (50') in depth. Off street parking spaces may be located in said O&R district rear yard setback but shall not be closer than thirty feet (30') to the lot line.
   E.   No accessory uses or structures shall be permitted in any transitional yard setbacks.
   F.   "Landscape buffer" is defined as combination of berm, densely planted compact hedge and evergreen vegetation.
   G.   A landscape buffer shall be installed in all transitional yard setbacks in accordance with a plan reviewed and approved by the plan commission/board of appeals. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-10: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building structures or enlargement:
   A.   Front Yard: A front yard of not less than thirty feet (30'). Said yard shall be entirely green space with no parking permitted.
   B.   Side Yards: There shall be two (2) side yards each of which shall be not less than ten feet (10') wide and a side yard adjoining a street shall not be less than thirty feet (30') wide.
   C.   Rear Yard: A rear yard of not less than twenty five feet (25'). (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-11: MAXIMUM LOT COVERAGE:

The lot coverage of structures, off street parking and off street loading shall not exceed sixty percent (60%) of each individual lot. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-12: LIGHTING STANDARDS:

Whenever off street parking spaces are used at night, parking lot lighting shall be provided as follows:
   A.   Lighting used along streets and rights of way and individual lots shall be uniform in design.
   B.   An average of one to three (3) foot-candles shall be maintained within the parking lot to assure safe levels of illumination.
   C.   Maximum to minimum and average to minimum uniformity ratios shall demonstrate that an even distribution of light will be provided within the parking lot.
   D.   Light standards and luminaires shall be so designed and placed to:
      1.   Confine light to the property. Light spillage in excess of five-tenths (0.5) foot-candle beyond the property line shall be prohibited, except at entrances to and from the commercial or office property.
      2.   Prevent glare visible from residential properties and street rights of way.
   E.   Security lighting installed on commercial or office buildings shall be shielded to fully cover lamps and to cast light downward. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-13: LANDSCAPING REQUIREMENTS:

   A.   Perimeter Yards: Shade trees, which average not less than forty feet (40') on center, shall be installed in ten foot (10') wide perimeter yards which abut properties planned for, or developed with, existing commercial or office uses.
   B.   Foundation Plantings: Trees and shrubs shall be installed along the front and side elevations of commercial or office buildings to provide articulation, provide shade, and to enhance the pedestrian environment.
   C.   Plant Material Sizes: Trees and shrubs shall be installed at sizes not less than the following:
      1.   Evergreen trees: Eight feet (8') to ten feet (10') in height.
      2.   Shade trees: Three inches (3") to four inches (4") in caliper, as measured six inches (6") above grade.
      3.   Ornamental trees: Eight feet (8') to ten feet (10') in height.
      4.   Shrubs: Not less than twenty four inches (24") in height, unless used for screening, in which cases shrubs three feet (3') to four feet (4') in height shall be required. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-14: ROOF MOUNTED MECHANICAL EQUIPMENT:

   A.   All roof mounted mechanical equipment including, but not limited to, heating, ventilating, and air conditioning units (HVAC), shall be fully screened from public view on all sides of the building.
   B.   Screening shall be accomplished by the roof structure or parapet walls. The height of the parapet walls or roof structure shall equal the height of the tallest rooftop element installed on the building. Such screening shall be designed to blend with and complement the architecture of the building. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-15: TRASH RECEPTACLES:

   A.   Trash receptacles shall be located only in a rear or interior side yard, enclosed by a masonry wall not less than the height of the containers, and provided with gates to contain trash.
   B.   Where visible to the public, landscaping shall be installed around the enclosure to soften its appearance. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-16: UTILITY METERS; TRANSFORMERS:

Wall mounted utility meters and ground supported transformers shall be painted to match the building. If visible to the public, meters and transformers shall be screened by landscaping equal in height to the tallest meter or transformer. (Ord. 11-O-008, 3-15-2011, eff. 3-15-2011)

5-10B-17: RAND ROAD:
