CHAPTER 13

OFF STREET PARKING AND LOADING

5-13-1: PURPOSE:

The purpose of this chapter is to alleviate or prevent the congestion of the public streets, and so promote the safety and welfare of the public by establishing minimum requirements for the off street parking and loading and unloading of motor vehicles in accordance with the use to which property is put. 5-13-2: GENERAL PROVISIONS, PARKING AND LOADING:

   A.   Scope Of Regulations: The off street parking and loading provisions of this title shall apply as follows:
      1.   For all buildings and structures erected and all uses of land established after the effective date hereof, accessory parking and loading facilities shall be provided as required by the regulations of the district in which such buildings or uses are located. However, where a building permit has been issued prior to the effective date hereof, and provided that construction is begun within one year of such effective date, and diligently prosecuted to completion, parking and loading facilities as required hereinafter need not be provided.
      2.   When the intensity of use of any building, structure or premises shall be increased through gross floor area, seating capacity or other unit of measurement specified herein for required parking or loading facilities, parking and loading facilities as required herein shall be provided for such increase in intensity of use.
However, no building or structure lawfully erected or use lawfully established prior to the effective date hereof shall be required to provide such additional parking or loading facilities unless and until the aggregate increase in units of measurement existing upon the effective date hereof, in which event parking or loading facilities as required herein shall be provided for the total increase.
Whenever the existing use of a building or structure shall hereafter be changed to a new use, parking or loading facilities shall be provided as required for such new use. However, if the said building or structure was erected prior to the effective date hereof, additional parking or loading facilities are mandatory only in the amount by which the requirements for the new use would exceed those for the existing use if the latter were subject to the parking and loading provisions of this chapter.
   B.   Existing Parking And Loading Facilities: Accessory off street parking or loading facilities which are located on the same lot as the building or use served which were in existence on the effective date hereof or were provided voluntarily after such effective date shall not hereafter be reduced below or if already less than, shall not further be reduced below the requirements of this chapter for a similar new building or use.
   C.   Permissive Parking And Loading Facilities: Nothing in this chapter shall be deemed to prevent the voluntary establishment of off street parking or loading facilities to serve any existing use of land or buildings; provided, that all regulations herein governing the location, design, improvement and operation of such facilities are adhered to.
   D.   Damage Or Destruction: For any conforming or legally nonconforming building or use which is in existence on the effective date hereof, which subsequent thereto is damaged or destroyed by fire, collapse, explosion or other cause, and which is reconstructed, reestablished or repaired, off street parking or loading facilities equivalent to any maintained at the time of such damage or destruction shall be restored or continued in operation. However, in no case shall it be necessary to restore or maintain parking or loading facilities in excess of those required by this chapter for equivalent new uses or construction.    E.   Control Of Off Site Parking Facilities: When required parking facilities are provided on land other than the zoning lot on which the building or use served by such facilities is located, they shall be and remain in the same possession or ownership as the zoning lot occupied by the building or use to which the parking facilities are accessory. No off site parking lot shall change ownership from that of the zoning on which the building or use served by such facility is located. No such off site parking facilities shall be authorized and no occupancy permit shall be issued where the plans call for parking facilities other than on the same zoning lot until and unless the plan commission/board of appeals has reviewed the plans and heard the applicant and made findings that the common ownership or possession of the zoning lot and the site of the parking facilities are reasonably certain to continue and that the off site parking facilities will be maintained at all times during the life of the proposed use or building.    F.   Submission Of Plot Plan: Any application for a building permit, or for a certificate of occupancy where no building permit is required shall include therewith a plot plan, drawn to scale and fully dimensioned, showing any parking or loading facilities to be provided in compliance with this chapter. 5-13-3: ADDITIONAL REGULATIONS, PARKING:

   A.   Use Of Parking Facilities: Off street parking facilities accessory to residential use and developed in any residential district in accordance with the requirements of this chapter shall be used for the parking of passenger automobiles owned by occupants of the dwelling structures to which such facilities are accessory or by guests of said occupants. Under no circumstances shall required parking facilities accessory to residential structures be used for the parking of automobiles belonging to the employees, owners, tenants, visitors or customers of business or manufacturing establishments.
   B.   Joint Parking Facilities: Off street parking facilities for different buildings, structures or uses, or for mixed uses, may be provided collectively in any zoning district in which separate parking facilities for each constituent use would be permitted; provided, that the total number of spaces so located together shall not be less than the sum of the separate requirements for each use.
   C.   Size: Required off street parking spaces shall be at least nine feet (9') in width and eighteen feet (18') in length, exclusive of access drives or aisles, ramps, columns or office or work areas.
      1.   The number and dimensions of parking spaces provided for the handicapped shall be in accordance with the standards of the Illinois capital development board, as set forth in "Accessibility Standards, Illustrated", dated May 1, 1988, as may be amended from time to time.
      2.   All required off street parking spaces shall have a vertical clearance of at least seven feet (7'). See section 5-13-5, "Off Street Parking Chart", of this chapter for other requirements pertaining to parking stall and drive aisle dimensions.
   D.   Access:
      1.   Each required off street parking space shall open directly upon an aisle or driveway of such width and design as to provide safe and efficient means of vehicular access to such parking space. All off street parking facilities shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movements.
      2.   All areas providing for off street parking facilities shall open directly upon an aisle or driveway not less than nine feet (9') wide for single-family detached or attached dwellings, and twelve feet (12') wide for all other uses, or such additional width and design as shown in section 5-13-5, "Off Street Parking Chart", of this chapter. No driveway across property nor curb cut shall exceed a width of thirty feet (30').
   E.   In Yards: Except for transitional yards in a B district which are governed by section 5-10-9 of this title, off street parking spaces may be located in required interior side and rear yards, but in no case closer than ten feet (10') to any lot line.
   F.   Design And Maintenance:
      1.   Open And Enclosed Parking Spaces: Accessory parking spaces located on the same lot as occupied by the use served may be open to the sky or enclosed in a building. Accessory parking spaces located in a residence district elsewhere than on the same lot occupied by the use served shall be open to the sky except when otherwise allowed as a special use.
      2.   Surfacing: The minimum surfacing requirements shall be as follows:
         a.   Except in detached, single-family residential areas, all open off street parking spaces and secondary drive aisles shall be improved with a geotextile fabric (200 pound strength); ten inches (10") of CA-6, grade 8 or 9 (excluding crushed concrete); one and one-half inches (1.5") of bituminous binder and one and one-half inches (1.5") of bituminous surface material. All open off street driveways and primary drive aisles shall be improved with a geotextile fabric (200 pound strength); twelve inches (12") of CA-6, grade 8 or 9 (excluding crushed concrete); two inches (2") of bituminous binder and two inches (2") of bituminous surface material;
         b.   Open off street parking areas and driveways in detached, single-family residential areas shall either be improved with six inches (6") of compacted stone and two inches (2") of bituminous surface material or eight inches (8") of compacted stone;
         c.   Alternative materials which provide equivalent strength may be used subject to approval by the village engineer.
      3.   Screening And Landscaping: All open automobile parking areas containing more than five (5) parking spaces shall be effectively screened on each side adjoining or fronting on any property situated in a residence district by a densely planted compact hedge. Such required screening shall conform with the front and side yard setback requirements of the district in which the parking is located.
      4.   Lighting: Any lighting used to illuminate off street parking areas shall be directed away from residential properties in such a way as not to create a nuisance.
      5.   Signs: See chapter 20 of this title.
      6.   Repair And Service: No motor vehicle repair work of any kind, except for routine maintenance, shall be permitted in conjunction with accessory off street parking facilities provided in a residence district.
The sale or storage of gasoline and motor oil in conjunction with accessory off street parking facilities is not permitted in any residence district. (Ord. 95-O-681, 1-4-1995)

5-13-4: LOCATION OF ACCESSORY OFF STREET PARKING FACILITIES:

The location of off street parking spaces in relation to the use served shall be as prescribed hereinafter. All distances specified shall be walking distances between such parking spaces and a main entrance to the use served.
   A.   For Uses In A Residence District: Parking spaces accessory to dwellings shall be located on the same zoning lot as the use served. Spaces accessory to use other than dwellings may be located on a lot adjacent to, or indirectly across a street or alley from the lot occupied by the use served, but in no case at a distance in excess of three hundred feet (300') from such use.
   B.   For Uses In PD-1 And PD-2 Districts: All required parking spaces shall be located on the lot of the use served. Off street parking accessory to a municipal parking lot may be allowed by special use permit in accordance with chapter 17 of this title within two hundred feet (200') of and adjacent to any PD district. 5-13-6: SCHEDULE OF PARKING REQUIREMENTS:

   A.   Employee Parking: Parking requirements determined by the number of employees shall be based on the maximum number of employees on duty and/or residing on the premises at any one time.
   B.   Capacity Calculations: When parking spaces are required on the basis of capacity, capacity shall be determined based on the occupancy standards established by the village building code 1 . (Ord. 95-O-681, 1-4-1995)
   C.   Mixed Uses: When two (2) or more uses are located on the same zoning lot or within the same building, parking spaces equal in number to the sum of the separate requirements for each such use shall be provided. No parking spaces or portion thereof shall serve as a required space for more than one use unless otherwise recommended by the plan commission/board of appeals and the board of trustees.    D.   Special Uses: The parking space requirements listed below shall apply to uses processed as special uses, unless the village determines that the specific requirements of a special use warrant a different parking space standard.
   E.   Spaces Required: Accessory off street parking spaces shall be provided as required for the following uses:
1. Residential:
 
Single-family dwellings
2 spaces per dwelling unit
Townhomes
2 1/2 spaces per dwelling unit
2. Retail And Service Uses:
 
Bank/financial institution
5 spaces per 1,000 square feet of floor area, plus 7 stacking spaces for each drive-up window
Barbershop/hair styling salon
2 spaces per chair, plus 1 space per employee
Hotel/motel
1 space per room, 1 space per employee, plus additional spaces for accessory uses as required by this schedule of parking requirements
Nursery/lawn and garden supply
5 spaces per 1,000 square feet of floor area, plus 1 space per each 2,000 square feet of outdoor sales area
Photography studio
4 spaces per 1,000 square feet of floor area
Produce stand:
As determined by the Zoning Administrator
Repair shop:
4 spaces per 1,000 square feet of floor area
Restaurant:
1 space per 3 persons of design capacity, plus 8 stacking spaces for each drive-up window
Retail sale of food:
6 spaces per 1,000 square feet of floor area
Retail store:
5 spaces per 1,000 square feet of floor area
Service shop (such as tailer or shoe repair):
4 spaces per 1,000 square feet of floor area
Tavern or bar:
1 space per 3 persons of design capacity
Transportation ticket office:
5 spaces per 1,000 square feet of floor area
Undertaking establishment/funeral home/funeral parlor:
15 spaces per parlor, 1 space per employee, plus 1 space per vehicle owned, leased or rented
Veterinary clinic or animal hospital/shelter:
4 spaces per 1,000 square feet of floor area
Video rental:
6 spaces per 1,000 square feet of floor area
3. Office:
 
Medical or dental office/clinic:
5 parking spaces per doctor, plus 1 space per each employee
Offices (business, professional and governmental):
5 spaces per 1,000 square feet of floor area
4. Automotive Service:
 
Autobody repair shop:
1 space per employee, plus 1 space per service bay (not including bay)
Automobile service station:
1 space per each 2 gasoline service bays (not including bays), 1 space per repair service bay (not including bay), 1 space per employee, 1 space per vehicle owned or leased, plus 5 spaces per 1,000 square feet of floor area devoted to retail sales
Car wash (automatic):
1 space per each employee, plus stacking spaces equal to 5 times the capacity of the wash bays
Car wash (manual):
1 space per employee, plus 4 spaces per washing bay (including bay), one of which shall be located directly in front of each bay
Gasoline station (self- service):
1 space per each 2 gasoline service bays (not including bays), 1 space per employee, plus 5 spaces per 1,000 square feet of floor area devoted to retail sales
5. Religious/Institutional:
 
Child day care center:
1 space per each employee, plus 2 spaces per each 15 children
Church or synagogue:
1 space per each 4 seats, or 1 space per each 90 lineal inches of seating capacity in main chapel or auditorium, based on design capacity
Vocational school (excluding correspondence schools):
1 space per each 5 students, plus 1 space per each 2 employees
6. Recreational/Civic:
 
Dance hall:
1 space per 3 persons of design capacity
Dance studio/school:
5 spaces per 1,000 square feet of floor area
Municipal building:
5 spaces per 1,000 square feet of floor area, plus 1 space for each vehicle leased, owned or rented by the Village
Park (publicly owned and operated):
As determined by the Zoning Administrator
Swimming and tennis clubs (private, nonprofit):
2 spaces per tennis court, 1 space per employee, plus additional parking for accessory uses as required by this schedule of parking requirements
 
10 spaces per 1,000 square feet of pool surface area, 5 spaces per 1,000 square feet of floor area devoted to accessory uses, plus adequate spaces to serve spectators, as determined by the Zoning Administrator
7. Research And Development:
 
Research and development facilities:
3.3 spaces per 1,000 square feet of floor area up to 50,000 square feet, and an additional 2.5 spaces per 1,000 square feet of floor area over 50,000
8. Other Uses:
Parking spaces for uses not listed in this schedule of parking requirements shall be provided according to the most similar use, or as determined by the Zoning Administrator

5-13-7: ADDITIONAL REGULATIONS, OFF-STREET LOADING:

   A.   Location: All required loading berths shall be located on the same zoning lot as the use served. No loading berth for vehicles over two (2) tons' capacity shall be closer than fifty feet (50') to any property in a residence district unless completely enclosed by building walls or a uniformly non-see through plant material, or any combination thereof, not less than six feet (6') in height. No permitted or required loading berth shall be located in any required front or side yard. No permitted or required loading berth shall be located within twenty five feet (25') of the nearest point of intersection of any two (2) streets.
   B.   Size: Unless otherwise specified, a required loading berth shall be at least ten feet in width by at least twenty five feet in length (10' x 25'), exclusive of aisles and maneuvering space, and shall have a vertical clearance of at least fourteen feet (14').
   C.   Access: Each required off-street loading berth shall be designed with appropriate means of vehicular access to a street or alley in a manner which will least interfere with traffic movement.
   D.   Surfacing: The minimum surfacing requirements shall be as follows:
      1.   All open off-street loading berths shall be improved with a geotextile fabric (200-pound strength); twelve inches (12") of CA-6, grade 8 or 9 (excluding crushed concrete); two inches (2") of bituminous binder and two inches (2") of bituminous surface material;
      2.   Alternative materials which provide equivalent strength may be used subject to approval by the Village Engineer.
   E.   Repair And Service: No motor vehicle repair work or service of any kind shall be permitted in conjunction with loading facilities provided in any PD-1 or PD-2 Districts.
   F.   Spaces: Spaces allocated to any off-street loading berth shall not, while so allocated, be used to satisfy the space requirements for any off-street parking facilities or portions thereof.
   G.   Loading Berths: For special uses other than prescribed for hereinafter, loading berths adequate in number and size to serve such uses as determined by the Zoning Administrator shall be provided.
   H.   Uses: Uses for which off-street loading facilities are required herein but which are located in buildings of less floor area than the minimum prescribed for such required facilities shall be provided with adequate receiving facilities off any adjacent alley, service drive or open space on the same lot which is accessible by motor vehicle.
