CHAPTER 4

R-1 SINGLE-FAMILY RESIDENCE DISTRICT

5-4-1: PURPOSE:

The R-1 district is established to encourage the orderly transition of land from agricultural to low density residential use; to provide areas well suited as to location and topography; to meet the market demands for large lots; and to prohibit any uses which are incompatible. The principal use of land is for single-family dwellings on large lots where minimum community services may be appropriate. (Ord. 76-O-227, 12-2-1976)

5-4-2: PERMITTED USES:

The following uses are permitted:
Accessory uses, including off street parking facilities in accordance with the provisions of chapter 13 of this title.
Agricultural, except that the keeping of equine animals shall be subject to the provisions of section 5-2-14 of this title.
Parks, when publicly owned and operated.
Signs (see subsection 5-20-19A of this title).
Single-family detached dwellings and permitted accessory uses. (Ord. 76-O-227, 12-2-1976; amd. Ord. 91-O-596, 11-4-1991)

5-4-3: SPECIAL USES:

The following uses may be allowed by special use permit in accordance with the provisions of chapter 17 of this title:
Church.
Municipal building.
Planned development in accordance with chapter 14 of this title.
Swimming and tennis clubs, private (nonprofit). (Ord. 91-O-596, 11-4-1991)

5-4-4: OFF STREET PARKING OR STORAGE OF VEHICLES:

   A.   Commercial Motor Vehicles:
      1.   The parking or storing on public or private property of commercial motor vehicles other than in a garage is hereby prohibited.
      2.   "Commercial motor vehicle" or "CMV" means a motor vehicle used in commerce, designed to transport passengers or property if:
         a.   The vehicle has a GVWR of twenty six thousand one (26,001) pounds or more or such a lesser GVWR as subsequently determined by federal regulations or the secretary of state; or any combination of vehicles with a GCWR of twenty six thousand one (26,001) pounds or more, provided the GVWR of any vehicle or vehicles being towed is ten thousand one (10,001) pounds or more; or
         b.   The vehicle is designed to transport sixteen (16) or more persons; or
         c.   The vehicle is transporting hazardous materials and is required to be placarded in accordance with 49 CFR part 172, subpart F.
      d.   The vehicle contains commercial graphics that cover at least twenty percent (20%) of the vehicle's surface.

5-4-5: MINIMUM LOT SIZE:

   A.   Every single-family dwelling hereafter erected shall be located on a lot having an area of not less than one acre, and a width at the established building line of not less than one hundred fifty feet (150') and a minimum lot depth of one hundred seventy five feet (175'). Private septic systems are prohibited for any lot less than one acre.
   B.   All nonresidential principal uses of buildings as permitted herein shall be located on a tract of land having an area of not less than one acre with a minimum width of one hundred fifty feet (150') at the building line.
   C.   Minimum lot sizes for special uses shall be prescribed and conditions stipulated at the time a special use permit is authorized, but in no case shall any such lot have an area of less than one acre and a width at the established building line of one hundred fifty feet (150'). 5-4-6: YARD AREAS:

No building shall be erected or enlarged unless the following yards are provided and maintained in connection with such building structures or enlargement:
   A.   Front Yard: A front yard of not less than seventy five feet (75').
   B.   Side Yards: There shall be two (2) side yards, each of which shall be not less than thirty five feet (35') wide and a side yard adjoining a street shall not be less than seventy five feet (75') wide.
   C.   Rear Yard: A rear yard of not less than fifty feet (50'). (Ord. 76-O-227, 12-2-1976)

5-4-7: MAXIMUM LOT COVERAGE:

Not more than thirty five percent (35%) of the lot area may be occupied by principal buildings and structures, including accessory buildings. (Ord. 95-O-681, 1-4-1995)

5-4-8: MAXIMUM FLOOR AREA RATIO:

Maximum floor area ratio shall not exceed 0.30. See section 5-1-6, "Definitions", of this title, for information regarding calculation of floor area ratio. (Ord. 95-O-681, 1-4-1995)

5-4-9: BUILDING HEIGHT:

No building or any other structure shall exceed a height of thirty five feet (35') or two and one-half (21/2) stories, whichever is lower. (Ord. 95-O-681, 1-4-1995)

5-4-10: GROUND FLOOR AREA:

Dwellings (single-family) shall have a minimum habitable floor area of not less than two thousand five hundred (2,500) square feet. Dwellings of more than one story shall have a minimum ground floor habitable area of not less than one thousand five hundred (1,500) square feet. (Ord. 95-O-681, 1-4-1995)
