- OVERLAY DISTRICTS

5-8-601: - COMMUTER CORRIDOR OVERLAY DISTRICT (CC):

A.

Purpose and intent:

1.

The purpose and intent of this chapter is to improve safety conditions, reduce congestion and delays, sustain traffic speeds, provide property owners with safe access to these roadways, and promote desirable land use development patterns to include aesthetic considerations. These roadways are intended to serve, in part, as Kuna's gateway scenic corridors for public presentation purposes.

2.

All regulations imposed by the City of Kuna in any zone shall continue to apply in areas within the described applicable areas. In cases where the provisions of this chapter are in conflict with other portions of City Code the more restrictive standard, as determined by the director, shall prevail.

B.

Applicability: The Commuter Corridor Overlay District is hereby established for all land within the incorporated City Limits of the City of Kuna and any land outside the City limits for which annexation has been requested within the following described areas:

1.

Meridian Road/State Highway 69: The area within one-quarter mile (one thousand three hundred twenty (1,320) feet) east and west aligning with the centerline of State Highway 69, also known as Meridian Road and its future southern alignments. The portion of State Highway 69 that curves and becomes East Kuna Road is excluded from the overlay district beyond a distance of one thousand three hundred twenty (1,320) feet west of the north/south aligning township section line underlaying State Highway 69.

2.

Ten Mile Road: The area within one-quarter mile (one thousand three hundred twenty (1,320) feet) east and west aligning with the centerline of Ten Mile Road and its future southern alignments.

3.

Kuna Mora Road: The area within one-quarter mile (one thousand three hundred twenty (1,320) feet) north and south aligning with the centerline of Kuna Mora Road and its future southern annexation.

4.

Approaches within the Commuter Corridor: Approach permits shall be required by the Idaho Transportation Department (ITD) and Ada County Highway District (ACHD). Traffic Counts, traffic studies and improvements may be required by ITD, ACHD and/or the City of Kuna. New approaches directly accessing State Highway 69, Ten Mile Road or Kuna Mora Road shall be limited to the following circumstances:

a.

Continued roadway access is afforded to existing residences on parcels created prior to adoption of this chapter, provided the residential access does not pose a health or safety hazard as determined by the city engineer, and provided, access closure as part of some future land use action would not landlock the property.

b.

Agricultural field access (for lands designated agriculture and in active use); the access shall be located at a place with good sight distance.

c.

When local fire districts or other emergency service providers require a secondary access onto these roadways to provide for emergency services. These accesses shall be limited to emergency use only and closed except during an emergency. The fire district shall determine the method of access closure.

C.

General standards within the Commuter Corridor Overlay District:

1.

Permit required: The applicant shall have approved permit(s) from the Idaho Transportation Department (ITD) for construction of any access to the State Highway 69 or construction done in the highway right-of-way. The applicant shall have an approved permit(s) from Ada County Highway District, and/or the City of Kuna for construction of any access to Ten Mile Road, Kuna Mora Road and/or construction done in the roadway right-of-way.

2.

Right-of-way width: State Highway 69 right-of-way width reservations shall be established by ITD. Right-of-way width reservations for Ten Mile Road and/or Kuna Mora Road shall be established by ACHD in consultation with the City of Kuna.

3.

Public/Private Street Connections for State Highway 69: Public or private street connections shall access State Highway 69 at the section line road and the half-mile mark (mid-mile) between section line roads. These mid-mile connecting streets shall serve as collector roads. The street shall be designed to collect and distribute traffic.

4.

Public/Private Street Connections for Ten Mile Road and Kuna Mora Road: Public or private street connections shall access Ten Mile Road and Kuna Mora Road at the section line road, mid-mile, and quarter-mile mark between section line roads. These connecting streets shall serve as collector roads. The street shall be designed to collect and distribute traffic. Any access beyond what is identified or direct access to Ten Mile Road or Kuna Mora Road shall be approved by the City and comply with ACHD standards.

5.

Frontage/Backage Roads: Where feasible, persons who develop property within the Commuter Corridor Overlay District shall dedicate lands and participate in the construction of a frontage/backage road to ACHD's standard for Collector roadways. The frontage/backage road shall generally parallel to roadways. The frontage/backage road shall be designed to accommodate future land use connectivity and provide an alternative means of roadway access to all properties fronting roadways within the Commuter Corridor Overlay District. The frontage/backage road is a feature of the City's access management control process.

a.

Frontage/backage roads shall connect to the section line, mid-mile collector or existing roadways. Distance of the intersection from centerline of State Highway 69, Ten Mile Road and Kuna Mora Road shall be in accordance to current ACHD policy.

b.

Frontage/backage roads shall accommodate public roadway access for buildable lots located adjacent to State Highway 69, Ten Mile Road and Kuna Mora Road.

6.

Setbacks: All structures placed within this overlay district shall comply with setback requirements of the underlying zone as shown in Chapter 2, Section 5, of this title.

7.

Existing Approaches: At time of development, existing approach(es) onto State Highway 69, Ten Mile Road and Kuna Mora Road shall be modified, reduced and/or abandoned and removed, provided this action does not landlock the subject property. New or modified accesses shall meet the requirements for location, design, right-of-way and other standards of the Ada County Highway District, ITD, and the City of Kuna. Ada County Highway District may require public access road dedication.

8.

Traffic Impact Study: A Traffic Impact Study (TIS) may be required by ITD, ACHD, and the City of Kuna.

9.

Exception: Property that is not located adjacent to a section road, mid-mile road or an alignment as determined by the City's Street Circulation Map; or not adjacent to a property with an existing frontage/backage road that provides connection to a section road or mid-mile road; or not adjacent to property in the same ownership with public or private road access; may be granted public access to State Highway 69, Ten Mile Road or Kuna Mora Roadway by the controlling authorities, on a case-by-case basis, and provided, such consideration does not pose an undo public health or safety hazard.

a.

Properties that fall under this section may still be required to construct a frontage/backage roads as described in this section.

5-8-602: - EAST KUNA INDUSTRIAL OVERLAY DISTRICT:

A.

Purpose and intent.

1.

The East Kuna Industrial Overlay District is intended to provide for large scale industrial development accommodating more intensive uses than found near the city core.

B.

Applicability.

1.

The East Kuna Industrial Overlay District is hereby established for land within the incorporated City Limits of the City of Kuna and any land outside the City Limits for which annexation has been requested as shown on the adopted East Kuna Industrial Overlay District Map.

C.

General Standards within the East Kuna Industrial Overlay District.

1.

If a conflict should arise between the provisions of this section and other chapters of this title, the provisions of this section shall prevail.

2.

Sidewalks. The sidewalk shall be constructed in accordance with KCC 5-10-13-B. Deferment of sidewalk development is permitted and will require the applicant to enter into an agreement detailing at what point in time sidewalks will be required to be installed onsite.

3.

Landscaping Standards.

a.

The landscape shall incorporate a water conserving design and be consistent with the natural vegetation coverage of the high desert climate.

b.

Whenever possible, existing vegetation coverage shall be utilized in place of new trees, plants and shrubs.

c.

New landscape installation should consist of native drought resistant planting.

d.

Boulders, rocks and other hard ground covers are encouraged in place of lawn and turf. If installed, lawn and turf areas shall not comprise more than twenty-five (25) percent of the total landscaped areas and shall consist of water conserving grasses, including but not limited to, Buffalo Grass, Blue Gamma Grass, Compact Fescue, Zerilawn, and/or Rhyzomotuous Tall Fescue.

4.

Fencing Standards.

a.

Fences not to exceed ten (10) feet in height, may be located or maintained on any property line except within vision clearance areas.

b.

Barbed wire may be permitted when used as the top section for security fences, provided barbed wires are a minimum seventy-two (72) inched above grade and do not project over public right-of-way.

c.

Exceptional height or materials may be approved on a case-by-case basis by the Planning and Zoning Commission at the recommendation of the Director or their designee.

5-8-603: - DOWNTOWN OVERLAY DISTRICT:

A.

Purpose and intent:

1.

The Downtown Overlay District is intended to provide a mixed-use of retail, office and residential services, with a presence of food service establishments, and entertainment within its confines, and preserve a variety of existing uses.

B.

Applicability:

1.

The Downtown Overlay District is hereby established for land within the incorporated City Limits of the City of Kuna and any land outside the City Limits for which annexation has been requested as shown on the adopted Downtown Overlay District Map.

a.

The Downtown Overly District shall be comprised of three (3) subdistricts:

i.

Old Town District.

ii.

Neighborhood Business District.

iii.

Railroad District.

C.

General standards within the Downtown Overlay District:

1.

Any exterior modification, rehabilitation, reconstruction, new structures, etc., within the Downtown Overlay District shall adhere to the adopted "City of Kuna Downtown Design Standards" Manual.

2.

If a conflict should arise between the provisions of the "City of Kuna Downtown Design Standards" Manual and other chapters of this title, the provisions of the "City of Kuna Downtown Design Standards" Manual shall prevail.
