33 T TIDAL AND SUBMERGED LANDS ZONE

§ 25.33.002 Intent and purpose.

The purpose of this zone is to provide for the permanent classification for tidal and submerged lands and to allow for the public use and enjoyment of the tidelands, to protect the natural and scenic resources and the natural ecological features of the zone, and further, to permit those uses that specifically serve the general public health, safety and welfare.

§ 25.33.004 Uses permitted.

The following uses are permitted in the T zone:
(A) 
Swimming and associated water recreation;
(B) 
Boating;
(C) 
Fishing, except as noted in Section 25.33.006(D);
(D) 
Ecological reserves;
(E) 
Marine life refuges.

§ 25.33.006 Uses prohibited.

The following uses are prohibited in the T zone:
(A) 
No building, structure, well head or pipeline shall be constructed over these lands. Structures include jetties, groins, seawalls, earth fills, riprap, piers, boat launching ramps and sand bypassing equipment, except for maintenance or extensions of existing sewer pipelines.
(B) 
No dredging, sand removal, sand redistribution or marine mining operations shall be permitted oceanward of mean high tide.
(C) 
No wells of any sort shall be drilled into these lands.
(D) 
No fishing shall be permitted within those areas designated as ecological reserves.
(E) 
No use shall be permitted which restricts public access.

§ 25.33.008 Development standards.

Any proposed development plans shall be submitted to the planning commission for review. Upon completion of environmental documents, the planning commission shall hold a public hearing and forward recommendations to the city council. The city council shall then hold necessary public hearings to review the proposal.
