80 ENFORCEMENT, LEGAL PROCEDURE, PENALTIES

§ 25.80.002 Enforcement procedure-Penalties.

(A) 
It shall be the duty of the city building inspector to enforce the provisions of this title, pertaining to the erecting, construction, reconstruction, moving, conversion, alteration or addition to any building or structure.
(B) 
It shall be the duty of the police department of the city and of all officers of the city otherwise charged with the enforcement of the law, to enforce this title and all the provisions of the same.
(C) 
Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any provisions of this title is guilty of a misdemeanor. Conviction of a misdemeanor shall be punishable by a fine of not more than one thousand dollars or by imprisonment in the city or county jail for a term not exceeding six months, or by both such fine and imprisonment. Upon being found guilty of an infraction, a person shall be punished by a fine as established by state law for infraction violations.
(D) 
Such person, firm or corporation is guilty of a separate offense for each and every day during any portion of which violation of this title is committed, continued or permitted by such person, firm or corporation and shall be punishable as herein provided.
(E) 
Any building setup, erected, built, moved or maintained and/or any use of property contrary to the provisions of this title, shall be and the same is declared to be unlawful and a public nuisance, and the city attorney shall, upon order of the city council, immediately commence action or actions, proceeding or proceedings, for the abatement, removal and enjoinment thereof in the manner provided by law, and shall take such other steps and shall apply to such court or courts as may have jurisdiction to grant such relief as will abate and remove such building or using any property contrary to the provisions of this title.
(F) 
All remedies provided for herein shall be cumulative and not exclusive.
