CHAPTER 33

SPECIALIZED HOUSING

11-33-1: PURPOSE:

The purpose of this chapter is to establish performance standards for residential uses that operate beyond the scope of traditional residential uses by providing temporary accommodations on an ongoing basis within certain residential areas. (Ord. 674, sec. 1, 7-17-2000)

11-33-3: BED AND BREAKFAST ESTABLISHMENTS AND BOARDING HOUSES:

   A.   District Application: Bed and breakfast establishments and boarding houses are allowed within the RA and RS-CBD zoning districts subject to the approval of an interim use permit.
   B.   Conditions Of Approval: In addition to general standards and criteria provided in chapter 5 of this title, a bed and breakfast establishment or boarding house may be allowed provided that:
      1.   A maximum of four (4) registered guest and transient resident sleeping rooms may be established in a structure.
      2.   The facility shall have a state license (hotel and food), and comply with building and fire codes as may be required or applicable.
      3.   The facility shall be owner or manager occupied.
      4.   The principal structure shall have a minimum size of one thousand five hundred (1,500) gross square feet and shall be located on a lot which meets the minimum lot size of the district in which it is located.
      5.   All registered guest and transient resident sleeping rooms shall be established within the principal structure.
      6.   Not more than the equivalent of one (1) full time person shall be employed in the operation of the facility who is not a resident of the structure.
      7.   Dining and other facilities shall not be open to the general public but shall be used exclusively by the registered guests and transient residents.
      8.   Two (2) off street parking spaces shall be provided for the home plus one (1) off street parking space for each registered guest and transient resident sleeping room. Parking areas shall be screened and landscaped pursuant to subsection 11-19-7I of this title.
      9.   Not more than one (1) identification sign not exceeding four (4) square feet in area may be attached to each wall which faces a street. The sign shall be reflective of the architectural features of the structure and may not be internally illuminated or lighted between ten o'clock (10:00) P.M. and six o'clock (6:00) A.M.
      10.   Adequate lighting shall be provided between the principal structure and the parking area for safety purposes. Any additional external lighting is prohibited. (Ord. 920, 4-7-2014; amd. Ord. 1078, 6-5-2023; Ord. 1080, 6-5-2023)

11-33-5: RESIDENTIAL SHELTERS:

   A.   District Application: Such uses may be allowed within residential districts subject to the approval of an interim use permit.
   B.   Conditions Of Approval:
      1.   Number of Residents:
         a.   Within an RS District on a lot accessed from a local residential street as defined by the Comprehensive Plan, there shall be no more than six (6) residents within a residential shelter.
         b.   Within an RS District on a lot accessed from a minor collector or higher functional classification roadway as may be allowed by Chapter 11-19 of this title, a RM, or a RH District, there shall be no more than sixteen (16) residents within a residential shelter unless the following conditions are met:
            (1)   The maximum number of residents permitted shall not exceed the fire certificate of occupancy
            (2)   The use complies with all other performance standards of this section.
      2.   No external building improvements are undertaken which alter the original residential character of the home structure unless approved by the city council.
      3.   No on street parking shall be allowed. Adequate off street parking shall be required by the city based on the staff and resident needs of each specific facility. Private driveways shall be of adequate width to accommodate effective vehicle circulation and are to be equipped with a turnaround area to prevent backing maneuvers onto public streets. Driveways shall be maintained in an open manner at all times and emergency vehicle access shall be available. Adequate sight distance at the access point shall be available.
      4.   Landscaping buffering from surrounding residential uses shall be provided consistent with the requirements contained in section 11-21-9.A of this title. A privacy fence of appropriate residential design may be required to limit off site impacts. Landscape screening from surrounding residential uses may be required by the Zoning Administrator depending on the type, location and proximity of residential areas to a specific facility.
      5.   Submission of detailed program information including goals, policies, activity schedule, staffing patterns and targeted capacity which may result in the imposition of reasonable conditions to limit the off site impacts.
      6.   A residential shelter shall be located a minimum of five hundred (500) radial feet, as measured in a straight line from the closest point of the property line of the parcel upon which the use is located to the property line of another residential shelter.
      7.   Additional conditions may be required by the city in order to address the specific impacts of a proposed facility. (Ord. 674, sec. 1, 7-17-2000; amd. Ord. 1031, 6-1-2020; Ord. 1052, sec. 7, 9-7-2021)

11-33-7: SACRED COMMUNITIES:

   A.   Conditional Use.
      1.   Dwelling in micro units within a sacred community shall be allowed upon approval of a conditional use permit subject to the requirements of this section.
      2.   Once approved additional conditional use permit applications shall not be required for individual units.
   B.   Operating Plan Required. A written plan approved by the religious institution’s governing board shall be submitted with application for a conditional use permit to allow dwelling in micro units within a scared community that outlines:
      1.   Disposal of water and sewage in accordance with subsection 11-33-7 .C of this section.
      2.   Exterior lighting installed in accordance with section 11-16-17 of this title.
      3.   Provision of access to public streets and adequate off-street parking in compliance with chapter 19 of this title.
      4.   Protocols for security and addressing conduct by residents dwelling in micro units within the sacred community.
      5.   Safety protocols for residents dwelling in micro units within the sacred community.
   C.   Utilities. Residents of micro units shall have access to water and electric utilities either by:
      1.   Connecting the micro units to the utilities that are serving the principal building on the lot or by other comparable means; or
      2.   By providing the residents access to permanent common kitchen facilities and common facilities for toilet, bathing, and laundry with the number and type of fixtures required for an R-2 boarding house under Minnesota Rules, part 1305.2902.
      3.   Any units that are plumbed shall not be included in determining the minimum number of fixtures required for the common facilities.
   D.   Setbacks. Micro units shall be setback a minimum of ten feet (10;) from other structures or property lines.
   E.   Insurance. Micro units within a scared community as allowed by this section shall be appropriately insured.
   F.   Occupancy. Between one third (1/3) and forty (40) percent of the micro units shall be occupied by designated volunteers as defined by Minnesota Statutes 327.30, Subd. 1.
   G.   Annual Certification. The religious institutional shall annually certify to the Zoning Administrator that it has complied with the eligibility requirements set forth by Minnesota Statutes 327.30, Subd. 2 for residents dwelling in micro units within a scared community allowed by this section.
