1-M ADMINISTRATION

Section 4-1-M-1 PLANNING COMMISSION CONTINUED.

The  Planning Commission of the City of Lenexa, Johnson County, Kansas, previously created, is hereby continued. It is referred to throughout this Chapter and Chapter 4-2 and Chapter 4-3 of this Title as "the Planning Commission".

Section 4-1-M-2 PLANNING COMMISSION MEMBERSHIP.

The Planning Commission shall consist of nine (9) members. Not less than seven (7) members shall be residents of the City. Up to two (2) members may reside outside of, but within 3 miles of, the corporate limits of the City. The members shall be appointed by the Mayor, with the consent of the City Council. Members shall serve 3-year terms staggered so that 3 terms expire each year, as such terms were originally established. The term of office shall commence on May 1 of the calendar year. Vacancies shall be filled by appointment for the unexpired term. Recommendations by the Mayor to fill any vacancy shall be made to the Council as soon as reasonably practicable after the effective date of such vacancy. Members of the Commission shall serve without compensation.

Notwithstanding the foregoing, beginning January 1, 2018, the terms of all members shall commence on March  1 instead of May 1 and shall terminate three (3) years later on the last day of February.  To transition to the new terms, beginning January 1, 2018, the terms of all members expiring in 2018, 2019 or 2020 shall be shortened two months to expire the last day in February instead of April 30 in the same year the term would have otherwise expired.  Thereafter, the terms of office shall remain three years.

Section 4-1-M-3 COMMISSION MEETINGS; OFFICERS.

  • Meetings: The members of the Planning Commission shall meet at least once a month at such time and place as they may fix by resolution. Special meetings may be called at any time by the chairperson or, in his or her absence, by the vice chairperson or upon request of a majority of Commission members in accordance with the Commission's by-laws. A majority of the Planning Commission shall constitute a quorum for the transaction of business. The Planning Commission shall cause a proper record to be kept of its proceedings.
  • Officers: The Planning Commission shall elect, at the first regular meeting in May, their own chairperson and vice chairperson who shall serve for one year and until their successors are elected.  Notwithstanding the foregoing, beginning January 1, 2018, the members shall elect their officers at the first regular meeting in March and at the first regular meeting in March for each year thereafter.  To transition to the new terms, the sitting officers as of January 1, 2018 shall have their terms shortened by approximately two months.  Thereafter, the terms of office for officers shall remain one year.  The Community Development Director shall serve as the secretary to the Planning Commission.

    Section 4-1-M-4 COMMISSION POWERS AND DUTIES.

    The powers and duties of the Planning Commission are as provided by state law, this Code, and other applicable ordinances, resolutions, laws or regulations.

    Section 4-1-M-7 COMMISSION BYLAWS.

    The Planning Commission shall have the power to adopt bylaws to govern its meetings and operations. Such bylaws shall be consistent with the requirements of State law and with this Chapter. Proposed bylaws shall be considered at a public hearing prior to adoption and, after adoption, shall be made available to the public through the Department of Community Development.

    Section 4-1-M-8 COMMUNITY DEVELOPMENT DIRECTOR.

  • The primary responsibility for the interpretation and administration of this Chapter and Chapter 4-2 and Chapter 4-3 of this Title shall be that of the Community Development Director of the City.
  • The Community Development Director shall have the full authority to delegate both responsibility and authority under this Chapter and Chapter 4-2 and Chapter 4-3 of this Title; wherever the term "Community Development Director" is used, it shall include both the Community Development Director and the Community Development Director's designee(s).
