ARTICLE 4

1-I BUILDING PERMITS REQUIRED

Section 4-1-I-1 APPLICATION, BUILDING PERMIT.

No building permit shall be issued until the applicant has complied with all requirements of Chapter 4-1, Chapter 4-2 and Chapter 4-3 of this Title, including but not limited to preliminary and final plan approval, and with other applicable ordinances of the City.

Section 4-1-I-2 BUILDING PERMITS, STREETS AND UTILITIES REQUIRED.

No building permit shall be issued for construction on any lot unless and until all improvements required under Chapter 2, Article 4-2-E of this Title for the subdivision containing the lot have been completed and accepted by the appropriate jurisdiction or unless guarantees of the completion of such improvements have been provided in accordance with Chapter 2, Article 4-2-F of this Title. The Community Development Director may, for good cause shown, issue permits for footings and foundations on a lot where the improvements have not been completed; provided, that life safety concerns have been addressed. Items to be considered in determining if footings and foundation permits will be issued shall include, but not be limited to provision and maintenance of acceptable access to the construction site for both deliveries and emergency vehicles and a guarantee that no combustible materials will be delivered to the site until all required improvements have been accepted.

Section 4-1-I-3 PLOT PLAN, FLOOR PLAN REQUIRED.

Applications for building permits shall be filed with the Community Development Director upon forms prescribed, setting forth the legal description of the lot, tract or parcel of land, together with a description of the building or structure to be constructed, erected or altered thereon, including the size and shape, square foot area, principal material of construction, location of the building or structure upon the lot, tract or parcel, the intended use, as well as its density and intensity of use. A plot plan, floor plan, elevated drawings and first floor elevation in reference to corners of the lot and adjacent corners is required. The drawings required above shall bear the seal of a registered architect or engineer, except for detached one- and two-family dwellings and their accessory buildings, for which the need for plans shall be determined by the Community Development Director.

Section 4-1-I-4 CONFORMITY WITH CHAPTERS.

No permit shall be issued for any building, structure or construction unless the proposed building or structure when built and the land on which it is located will conform in every respect with all the provisions of Chapter 4-1, Chapter 4-2 and Chapter 4-3 of this Title and the Building Code of the City and with other applicable ordinances of the City.*

Section 4-1-I-5 ACTION ON APPLICATION.

The Building Official shall have the authority to act within the provisions of this Article upon all applications for building permits, and the same shall be approved or denied, or corrections requested, not later than the tenth business day succeeding the day of filing.

Section 4-1-I-6 SEPARATE PERMIT REQUIRED.

There shall be a separate permit for each building or structure to be constructed, erected or altered.

Section 4-1-I-7 REVOCATION OF BUILDING PERMIT.

A permit may be revoked by the Building Official at any time prior to the completion of the building or structure for which the same was issued in accordance with Article L of this Chapter.

Section 4-1-I-8 CERTIFICATE OF OCCUPANCY.

No change in the character of use of any land or change of occupant of a non-residential building shall be made nor shall any new or existing building or structure be hereafter occupied or used until a certificate of occupancy is issued by the Building Official certifying that such building or use complies with all regulations of this Chapter, Building Code* and all other ordinances and regulations applicable thereto.

Section 4-1-I-9 EVIDENCE OF COMPLIANCE.

No certificate of occupancy shall be issued unless the Community Development Director has determined that the proposed use will be in conformance with Chapters 1, 2 and 3 of this Title and other applicable ordinances of the City. The Community Development Director may submit the question of such conformance to the Planning Commission for review in any case in which the Community Development Director does not believe that the issue of conformance is clear. In case of such a referral, the Community Development Director or the Building Official shall give the applicant at least 5 days' actual notice of the review by the Planning Commission, which review shall occur at the next regular meeting of the Commission for which such notice can be given. Evidence of compliance must be provided to the Community Development Director by the applicant.

Section 4-1-I-10 REVOCATION OF CERTIFICATES OF OCCUPANCY.

A certificate of occupancy may be revoked by the Building Official upon evidence of noncompliance with Chapter 4-1, Chapter 4-2 or Chapter 4-3 of this Title or with the applicable Building Codes.*
