1-P STREET RENAMING

Section 4-1-P-1 HEARING AND ACTIONS ON STREET RENAMING PROPOSALS.

  • Reviews, Actions:  A request to rename a street within the City shall require the approval of the City Council, with a recommendation thereon by the Planning Commission.  If the Planning Commission shall fail to make a recommendation on a proposed renaming, the Planning Commission is deemed to have recommended denial of the proposal.

  • Public Hearing Required:  Prior to voting on a street renaming proposal the Planning Commission shall hold a public hearing on the proposal.  Notice of the proposed renaming shall be published one time in an official city newspaper at least 20 days prior to such hearing.  In addition, notice of the proposed renaming shall be mailed by the applicant to all owners of record of all lands adjacent to the street proposed to be renamed at least 20 days prior to the public hearing on such proposal.  When the notice has been properly addressed and deposited in the mail, failure of a party to receive such notice shall not invalidate any subsequent action taken by the Planning Commission or City Council.

  • Action by City Council:  Following the receipt of the recommendation and summary of the Planning Commission action on the proposed renaming, the City Council may adopt, override or modify such recommendation by ordinance.

    Section 4-1-P-2 CRITERIA FOR REVIEW.

    The criteria for review of a proposed street renaming should include, where applicable, the following factors, which may be considered by the Planning Commission and City Council.  These criteria are not intended to be all inclusive and every criteria listed may not be applicable to every application.  The Planning Commission and City Council should weigh these criteria giving each the importance, in their sole discretion, they believe each deserves on a specific application.

    1. Impact on public safety departments and their ability to locate residences and business along the renamed street.
    2. Number of existing residences and commercial businesses located along the street to be renamed;  the impact on them; and their support for such action.
    3. The character of the neighborhood the street traverses.
    4. The type of street proposed to be renamed and the length thereof, both inside and outside of Lenexa.
    5. Whether or not the street has a consistent naming convention for its entire length.
    6. Consistency with the County street naming convention.
    7. Recommendation of professional City staff.
    8. Comments of residents and businesses at public hearing.
    9. The relative gain to public health, safety and welfare due to the renaming of the street as compared to the hardship resulting from the failure to do so.
    10. The financial impact on the City and/or the adjacent residents and businesses of renaming the street as a result of changing street signs; readdressing; etc.
    11. Recommendations of other public entitites, including but not limited to Johnson County; U.S. Postal Service and adjacent cities in which the street continues.
    12. Any historical significance attached to the existing street name or the proposed street name or whether the street name honors a person, place, institution, group, entity or event.
    13. Whether or not the street name enhances a neighborhood through the association of a street name with its location.
    14. To correct a misspelling; eliminate duplication of name spelling or phonetics.

    Section 4-1-P-3 WAITING PERIOD FOR REAPPLICATION.

    In the event the City Council denies a request to rename a street, the same or a substantially similar proposal shall not be resubmitted for 1 year, unless the waiting period is waived by the City Council by separate motion.
