165.17 CENTRAL

BUSINESS COMMERCIAL DISTRICT.

   The intent of the Central Business Commercial District (C-1) is to establish and preserve a central business district convenient and attractive for a wide range of retail uses and businesses, government and professional offices, and places of amusement in a setting conducive to and safe for a high volume of pedestrian traffic.
   1.   Permitted Principal Uses and Structures.
      A.   Stores and shops for conducting any lawful retail business.
      B.   Personal service shops.
      C.   Banks, theaters, offices, restaurants and taverns.
      D.   Wholesale businesses and professional offices.
      E.   Post offices, police and fire departments and stations, and telephone offices.
      F.   Temples, churches and other public buildings.
      G.   Residential apartments above the first floor. No apartments shall be located on the first floor.
      H.   Those uses that, in the opinion of the Board of Adjustment, are of the same general character as those listed above as permitted uses, and which will not be detrimental to the district in which they are located.
   2.   Permitted Accessory Uses and Structures. Uses and structures accessory to a principal permitted use or a special exception use are permitted subject to the provisions of Section 165.25.
      A.   Awnings and canopies may extend out over the public sidewalk at a distance of not to exceed 2/3 of the width of the sidewalk.
      B.   Only iron or carbon steel frames may be used.
      C.   Only canvas and fabric canopies/awnings are allowed.
      D.   Awnings/canopies must be cleared of snow and ice within 24 hours of accumulation.
      E.   Must follow all other requirements of awnings/canopies in Section 165.25(16).
   3.   Special Exceptions. The following special exceptions are permitted in the C-1 District, subject to provisions of Section 165.31(4).
      A.   Carnivals, circuses, fairs, or road shows.
      B.   Radio or television broadcasting tower or station.
      C.   Automobile body repair shops.
      D.   Commercial parking lots, garages.
      E.   High technology wholesaling and manufacturing of medical and biogenetics, and Federal class-one medical devices.

   5.   Minimum Off-Street Parking and Loading Space. All parking and loading areas shall be constructed according to Section 165.25(14) of this chapter. Parking and loading facilities shall be provided in the following required amounts:
      A.   Parking.
         (1)   Dwellings – one space for each dwelling unit.
         (2)   Churches, temples and public buildings – one space for every six seats in main auditorium.
         (3)   Automotive service and repair establishments and automobile body repair shops – four spaces for every 300 square feet of floor area.
         (4)   Warehousing, storage, and manufacturing – one space for each employee on duty at any time plus one for each vehicle used by the industry.
      B.   Off-Street Loading. One space, 50 feet by 12 feet, for each 20,000 square feet of floor area or fraction thereof.
