165.24 FENCE

REGULATIONS.

   1.   Fences, when located within a front, side or rear yard, or within five feet of a lot line, shall be subject to the following location and height restrictions (fence may be built on the property line):
      A.   No portion of a fence, excluding arbors, shall exceed seven feet in height.
      B.   Fences shall be located so no part thereof is within three feet of an alley or five feet of a street right-of-way.
      C.   In residential districts, fences within the front yard and street side yard on a corner lot shall not exceed four feet in height, excluding arbors, and shall contain openings constituting no less than 80 percent of the surface area of the fence and shall be placed a minimum of one foot from the sidewalk. Fences built parallel to the street side yard line but set back in conformance with the required street side yard setback requirement may have a maximum height of seven feet.

      D.   Front yard fences may not extend into the area of the front yard between the front lot line and the front yard setback requirement designated in this chapter.
   2.   Fenced enclosures shall be provided for permanent outdoor swimming and landscaping pools with a depth of 30 inches or more, and shall be subject to the following requirements:
      A.   Fences must be at least four feet in height from ground level but not exceed seven feet and have no spaces that would allow a four- inch sphere to pass through.
      B.   Fences must have a self-closing and self-latching device on the gate.
      C.   Fences must be located so no part thereof is within three feet of an alley.
   3.   Barbed wire and electric fences are subject to the following requirements:
      A.   Barbed wire and electric fences are not allowed in residential or commercially zoned areas.
      B.   Barbed wire and electric fences are prohibited within five feet of a public sidewalk or within four feet of a street right-of-way where a public sidewalk does not exist.
      C.   In the case where barbed wire fences are necessary for the protection of domestic animals, all barbed wire, whether suspended vertically or horizontally, must be at least five feet above the average level grade of the fenced area.
      D.   Except for the enclosure of livestock operations in Agricultural zones (i.e. A-1), electric fences are not permitted in any district.
      E.   No electric fence shall carry a charge greater than 25 milliamperes or a pulsating current longer than one-tenth of one second in a one- second cycle. All electric fence chargers shall carry the seal of an approved testing laboratory.
   4.   All fences require a permit before construction. Building permits for a fence shall be issued by the Zoning Administrator.
