Abutting
Abutting means directly touching and having common boundaries. Properties divided by a common property line are abutting. Properties across a public right-of-way are adjacent but not abutting. This term is synonymous with “adjoining.”

Accessory Building
Accessory Building means a building that is subordinate in area, extent or purpose to the principal use and building on the parcel and that is customarily used in conjunction with a permitted accessory use.

Accessory Dwelling Unit (ADU)
Accessory Dwelling Unit (ADU) means a second, subordinate dwelling unit located on the same lot as a principal dwelling unit. An ADU provides complete independent living facilities for one or more individuals, which include:

  • Private area separated by a door (private entrance from outside not required);
  • Private living area;
  • Private sleeping area;
  • Private bathroom; and 
  • Permanently installed connection for a cooking appliance.

Forms of ADUs include an i) attached or ii) detached ADU. Please see "Accessory Dwelling Unit, Attached" and "Accessory Dwelling Unit, Detachedfor definitions.

Accessory Dwelling Unit, Attached
Accessory Dwelling Unit, Attached means an ADU that is located within or attached to a principal dwelling. "Within" the principal dwelling means space such as a finished basement or attic. "Attached" to the principal dwelling means space such as a converted attached garage or structural addition. At least one common wall that is no less than eight feet wide is shared with the principal dwelling.

Accessory Dwelling Unit, Detached
Accessory Dwelling Unit, Detached means an ADU that is separated from the principal dwelling and may include conversion of a detached garage or other similar structure. No common wall is shared with the principal dwelling.

Accessory Structure
Accessory Structure means a detached uninhabited structure that is subordinate and incidental to the principal structure or use located on the same lot. Refer also to Structure, Accessory.

Accessory Use
Accessory Use means a use which is not permitted as a principal use, but is clearly subordinate and incidental to and customarily found in connection with and located on the same lot as the principal use, not including those designated as a home occupation. Refer also to Use, Accessory.

Adapted Plant
Adapted Plant means a plant that is not indigenous, or native, to Colorado, but is used in landscaping due to its adaptable qualities. It may be a nursery trade cultivar or variety; or a native to the region that does not naturally occur in the city limits.

Adaptive Reuse
Adaptive Reuse means the rehabilitation or renovation of an existing building or structure for a permitted use(s) other than the present use(s).

Addition
Addition means any activity that expands the enclosed footprint or increases the square footage of an existing structure.

Adjacent
Adjacent means being in close proximity. Properties that are directly across a public right-of-way or access easement are adjacent.

Adjoining
Adjoining means ​​​​directly touching and having common boundaries. Properties divided by a common property line are adjoining. Properties across a public right-of-way are adjacent but not adjoining. This term is synonymous with “abutting.”

Administrative Plat
Administrative Plat means a plat of one to four lots that is approved through an administrative action without the approval of the Planning Commission.

Adult Day Care
Adult Day Care means any program that provides health, social and related support services for four or more functionally impaired adults who require supervision due to cognitive or physical impairment or who cannot independently perform one or more activities of daily living. These services are provided to adults for a period of less than 12 hours during the day and are provided in a setting other than a participant's home or the residence of the facility operator.

A
Adult Entertainment means a business or establishment that offers its patrons services or entertainment characterized by an emphasis on matter depicting, describing, or relating to specified sexual activities or specified anatomical uses. These uses include, but are not limited to, an adult bookstore, adult video store, and adult motion picture theater. Refer to the City Code Chapter 3, Business Regulations, Chapter 14 Adult Entertainment Establishments for more information.

Advertising Vehicle
Advertising Vehicle means any vehicle or trailer that is visible from a public right-of-way that has a sign attached to it.

Agricultural and Animal-Oriented Uses
Agricultural and Animal-Oriented Uses means a use category primarily related to the raising of animals and plants and associated enterprises. Multiple permitted uses may be allowed in agricultural zones.

A
Agriculture-Oriented Uses mean a use category primarily related to the raising of plants and associated enterprises. Uses include, but are not limited to floriculture, horticulture, row and field crops, viticulture, and orchard. This definition also includes other uses that the Director or their designee interprets to be functionally similar to a land use in this use category.

All-Weather Surface means an improved surface that is constructed of concrete, asphalt, or a similar dust-free impermeable or permeable material designed to withstand all weather conditions.

Alley means a public or private way, other than a street, that is open to common use and affords a secondary means of vehicular and/or pedestrian access to the rear of the adjacent property.

Alteration
Alteration means the act or process which changes one or more of the exterior architectural features of a structure.

Alternative Tower Structure
Alternative Tower Structure means man-made trees, clock towers, bell steeples, light poles, buildings, and similar alternative design mounting structures that blend with the natural setting and surrounding structures, and conceal, where technically feasible, the presence of antennas or towers so as to make them visibly hidden with the surrounding area. This term also includes any antenna or antenna array attached to an alternative tower structure. Measurement of an alternative tower structure shall be from the grade of the structure to the top height of all equipment or concealment shrouds. A stand-alone pole in the right-of-way that accommodates small cell facilities is considered an alternative tower structure to the extent it meets the concealment standards. Alternative tower structures are not considered towers for the purposes of this Code.

Alternative Tower Structure Pole
Alternative Tower Structure Pole means a light pole or traffic signal pole located in the right of way with concealed wireless facility equipment. Measurement of the ATS pole shall be from the grade of the structure to height of the luminaire or mast-arm of the existing or proposed equipment.

Ambulatory or Outpatient Services
Ambulatory or Outpatient Services means the furnishing of healthcare services directly to patients without providing inpatient services. Establishments providing ambulatory or outpatient services include, but are not limited to, clinics, family planning and outpatient care centers, and medical and diagnostic laboratories.

Ambulatory Surgical Care Facilities
Ambulatory Surgical Care Facilities means an establishment licensed by the State as an ambulatory surgical care facility with an organized medical staff of physicians, with permanent facilities that are equipped and operated primarily for the purpose of performing surgical procedures. Accommodations for patient recovery are not to exceed twenty-three (23) hours after surgery.

Amphitheater
Amphitheater means a semi-enclosed structure designed for the enactment of the performing arts or other entertainment uses that include entertainment-related facilities and uses.

Antenna
Antenna means any device used to transmit and/or receive radio or electromagnetic waves such as, but not limited to panel antennas, reflecting discs, microwave dishes, whip antennas, directional and non-directional antennas consisting of one or more elements, multiple antenna configurations, or other similar devices and configurations. Exterior apparatus designed for telephone, radio, or television communications through the sending and/or receiving of wireless communications signals.

Animal Boarding and Care Facility
Animal Boarding and Care Facility means a full-service animal treatment and boarding facility licensed by the State of Colorado, which may or may not offer inside overnight boarding or kenneling. The facility may offer veterinary care, grooming, training, retail sales of pet supplies, outdoor pet play areas, daycare and inside overnight boarding for canines and felines. The facility shall only accommodate privately-owned domesticated pets which are boarded by their owner. Animals shall not be bred, sold or let for hire from this facility. This use shall not include rescue shelters, impounded canines or fostering.

Animal Husbandry
Animal Husbandry means the care and raising of horses, donkeys, mules, alpaca, llama, wool-bearing animals, and associated enterprises for the personal use of residents of the property.

Animal-Oriented Uses means a use category primarily related to the raising of animals and plants and associated enterprises. Uses include, but are not limited to, beekeeping, kennel, and stables. This definition also includes other uses that the Director or their designee interprets to be functionally similar to a land use in this use category.

Animal Rescue Organization or Rescue Shelter
Animal Rescue Organization or Rescue Shelter means any not-for-profit organization licensed pursuant to the Colorado Pet Animal Care Facilities Act, C.R.S. § 35-80-101, et seq., and which has tax-exempt status under Section 501(c)(3) of the United States Internal Revenue Code, whose mission and practice is, in whole or in significant part, the rescue and placement of animals in permanent homes and holds all local and state licenses.

Apiary
Apiary means a place where one or more beehives are kept.

Appeal means a review of a decision, determination, order, or act of an administrative body pursuant to the terms of this Code.

Architectural Accent Lighting
Architectural Accent Lighting means lighting used to highlight or enhance a specific architectural element, feature, or symbol without providing a wash of light over an entire wall or façade.

Area of Shallow Flooding
Area of Shallow Flooding means an area susceptible to base flood depths ranging from one foot to three feet usually designated zone AO or AH on the city's flood insurance rate map (FIRM), or similar designation on an approved study, with a one percent or greater chance of flooding in any given year, where a clearly defined channel does not exist, the path of flooding is unpredictable, and velocity flow may be evident. Such flooding is characterized by ponding or sheet flow.

Area of Special Flood Hazard
Area of Special Flood Hazard means land within the floodplain subject to a one percent or greater chance of flooding in any given year. The area may be designated zone A, AE, OR A1-A30 AH, AO, or A99 on the city's flood insurance rate map (FIRM), or otherwise designed on an approved study.

Assembly
Assembly means a joining together of completely fabricated parts to create a finished product. Assembly may occur as a component of a retail business. Assembly as it pertains to the gathering of people shall be based on the International Building Code (IBC) definition of Assembly.

Assembly Facility, Public
Assembly Facility, Public refer to the definition of "Public Assembly Facility."

Assembly of Finished Goods
Assembly of Finished Goods means the process of assembling and packaging pre-manufactured items into a single final product.

Assembly of Prefabricated Parts
Assembly of Prefabricated Parts means the process of assembling and packaging pre-manufactured items into a single final product.

Assembly or Fabrication for Sale on Premises
Assembly or Fabrication for Sale on Premises means the process of assembling and packaging pre-manufactured items into a single final product to be sold in the same location.

Ballfield or Stadium
Ballfield or Stadium means an open-air facility or building with tiers of seats for spectators used for sporting, performances, lectures, or other recreational or cultural events not associated with educational facilities/schools.

Bank or Credit Union
Bank or Credit Union means any class of business that provides financial services and the transmission of funds, such as commercial banks, credit unions, brokerage offices, insurance companies, and real estate lending institutions. A bank or credit union may or may not include drive-through facilities and services.

Bar, Brew Pub, or Tavern
Bar, Brew Pub, or Tavern means a public drinking establishment that is licensed to sell either cereal malt beverages or alcoholic liquor for the consumption on the premises and where food may be available for consumption on or off the premises.

Base Flood
Base Flood means a flood having a one percent chance of being equaled or exceeded in any given year. Sometimes also known as a "100-year flood."

Base Flood Elevation (BFE)
Base Flood Elevation (BFE) means the elevation shown on a FEMA flood insurance rate map (FIRM) for zones AE or A1-A30 that indicate the water surface elevation resulting from a flood that has a one percent chance of equaling or exceeding that level in any given year.

If for a particular waterway BFEs are not shown or published in the FIRM or FIS, this may be the base flood elevation depicted or determined in another approved study.

Base Station
Base Station means a structure or equipment at a fixed location that enables FCC-licensed or authorized wireless communications between user equipment and a communications network. The definition of base station does not include or encompass a tower or any equipment associated with a tower. Base station does include, without limitation:

  • Equipment associated with wireless communications services such as private broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul that, at the time the relevant application is filed with the city, has been reviewed and approved under the applicable zoning or siting process, or under another State or local regulatory review process, even if the structure was not built for the sole or primary purpose of providing such support; and
  • Radio transceivers, antennas, coaxial or fiber-optic cable, regular and backup power supplied, and comparable equipment, regardless of technological configuration (including distributed antenna systems ("DAS") and small-cell networks) that, at the time the relevant application is filed with the city, has been reviewed and approved under the applicable zoning or siting process, or under another state or local regulatory review process, even if the structure was not built for the sole or primary purpose of providing such support.

The definition of “base station” does not include any structure that, at the time the relevant application is filed with the city, does not support or house equipment described in this definition.

Bee means the adult stage of the common domestic honeybee, Apis mellifera species.

Beekeeper
Beekeeper means any person who owns or maintains a bee colony.

Beekeeping
Beekeeping means the establishment and maintenance by a person of one or more colonies of honey bees for either personal use or the production and sale of honey and honey-based products.

Beer Garden
Beer Garden means a permanent establishment which includes any area out-of-doors and not completely contained within a building in which alcoholic beverages and/or food are served.

Berm
Berm means an earthen mound designed to provide visual interest, screen undesirable views, and/or decrease noise. To promote efficient irrigation and maintenance measures, berms shall not exceed a slope of three horizontal units to one vertical unit and shall be graded to appear as smooth, rounded, naturalistic forms.

Bicycle Parking, Long-Term
Bicycle Parking, Long-Term means space for parking of bicycles for residents. Such spaces may consist of bicycle lockers, bicycle racks in enclosed areas, or space within a building where a resident may park a bicycle for the day, overnight, or for extended periods of time.

Bicycle Parking, Short-Term
Bicycle Parking, Short-Term means space for temporary parking of bicycles for visitors and customers. Such spaces may be public or private and typically consist of outdoor bicycle racks.

Billboard
Billboard means a permanent sign structure in a fixed location which meets any one or more of the following criteria: a) it is used for the display of offsite commercial messages; b) the message display area, or any part thereof, is made available to message sponsors other than the owner(s) or operator(s) of the sign, typically for a fee or other consideration, i.e., general advertising for hire; c) the sign is a principal or secondary use of the land, rather than an appurtenant, accessory or auxiliary use serving some other principal use of the land.

Blank Wall
Blank Wall means any wall or portion of a wall that is visible from any right-of-way or pedestrian space, and that is without a window, door, building articulation, or other architectural feature.

Block means a portion of land within a subdivision, generally bounded by public or private rights-of-way (other than alleys), or the exterior boundary of a subdivision.

Block Face
Block Face means the side of a block facing a street.

Bowling Alley means an establishment containing long narrow tracks used in bowling and similar games.

Brewery means an establishment where malt liquors and fermented malt beverages are manufactured, served, and/or sold to the public for onsite or take-away consumption. Typically, a brewery has a state issued liquor license.

Brewery, Distillery, and Winery
Brewery, Distillery, and Winery means an establishment for processing of malt liquors, fermented malt beverages, spirituous liquors, or wines are manufactured. Processing activities may include, but are not limited to, wholesale sales, crushing, fermenting, blending, aging, storing, and bottling functions. Facilities may also include space for retail sales, tasting, indoor event rooms, and an outdoor area as part of the operations.

Buffer or Buffer Area
Buffer or Buffer Area means a landscaped area which physically separates and, at least partially, visually screens adjacent land uses or building types.

Bufferyard
Bufferyard means an area with a specified type and amount of planting on it, and any structures which may be required, situated between districts, or in the instance of mixes use development, between land uses, to eliminate or minimize conflicts between them.

Building Activation
Building Activation means the architectural practice of designing building facades in a form which engages the public, particularly the public right-of-way and pedestrian areas. A building may be “activated” either through such approaches as limiting wall length, increasing window transparency, varying building massing, or other building façade treatments which enhance visual quality and contribute to social vibrancy in the public realm.

Building Coverage
Building Coverage means that portion of a lot covered, or permitted to be covered, by principal and accessory buildings.

Building Frontage
Building Frontage means the linear dimension of a building or lease space that is parallel, or approximately parallel, to public street right-of-way, or a private drive.

Building Permit
Building Permit means a written document granting permission to construct, erect, repair or alter structures in accordance with the building and zoning codes of the city in effect at the time application for the permit is filed.

Build-to
Build-to means a line, parallel to the respective lot line, and internal to the lot, which defines the required maximum and minimum setback for the entire building façade as specified in the district regulations. The build-to-zone is the area between the build-to line for the minimum and maximum setbacks, and the space in which the front building wall must be constructed.

Build-to-Zone (BTZ)
Build-to-Zone (BTZ) means a zone established within a certain distance from the property line to a delineated fronting zone along which the building must be built, as depicted below with the letter A.

Bulk Plane
Bulk Plane means a building envelope created by a three-dimensional shape based on setbacks and height standards to determine the maximum volume of a new building. Bulk plane is used for the purpose of preserving neighborhood compatibility, privacy, and the adequate supply of light and air. The bulk plane begins at a height above every property line of a lot or parcel, and slopes upward at a defined angle until it intersects the bulk plane from the opposite side of the lot or parcel. The bulk plane created defines the volume within which a building can be constructed.

Bus or Taxi Depot
Bus or Taxi Depot means a central facility where passengers and goods are loaded and unloaded onto, or from buses or taxis, and from which buses or taxis are dispatched, routed, and maintained.

Cafeteria, Providing Service to On-Site Employees means an establishment that provides food services to employees on-site, where patrons order or select items and pay before eating, and where food and drink may be consumed on-premises or taken out. This definition includes establishments where specialty snacks such as ice cream, cookies, and nonalcoholic beverages are served.

Caliper means the measurement in diameter of a tree trunk measured six inches above the ground for trees up to four-inch size and 12 inches above the ground for larger sizes.

Camouflage Design Techniques means measures that are used in the design and siting of Wireless Communication Facilities with the intent to eliminate or minimize to the extent feasible the visual impact of such facilities to surrounding uses. A WCF Site utilizes Camouflage Design Techniques when it:

  • is integrated as an architectural feature of an existing structure such as a cupola while still appearing to some extent as a WCF; or
  • is integrated into an outdoor fixture such as a flagpole, while still appearing to some extent as a WCF; or
  • uses a design that mimics and is consistent with the nearby natural, or architectural features (such as an artificial tree) or is incorporated into (including without limitation, being attached to the exterior of such facility and painted to match it) or replaces existing permitted facilities (including without limitation, stop signs or other traffic signs or freestanding light standards) so that the presence of the WCF is not readily apparent.

This definition does not include the use of Concealment Design Techniques so that a facility looks like something other than a wireless Tower or Base Station.

Campground
Campground means any tract of land on which may be located accommodations for temporary occupancy exclusively for recreational purposes including tents, camping trailers, motor homes, or other recreational equipment which includes living accommodations, and which areas generally retain the natural, open character of the land.

Carnival
Carnival means an establishment with amusement activities; merry-go-rounds, Ferris wheels, and similar types of amusement rides; booths for the conduct of games of skill; food dispensing facilities; and sideshows; that are temporarily conducted outdoors and not within a theater, auditorium, gymnasium or other permanent building.

Carport means a roofed accessory attached or detached structure, primarily used for parking motor vehicles, that is open on at least two sides.

Carport, Temporary means a prefabricated structure, commonly comprised of a lightweight metal frame and a fabric roof, which is intended as a shelter for motor vehicles or other similar equipment, and is not attached to the primary residence.

Car Wash means a building containing facilities for washing one or more automobiles simultaneously, using production line methods such as a chain conveyor, blower, steam cleaning device, or other mechanical devices, or providing space, water, equipment, or soap for the complete or partial cleaning of such automobiles, whether by operator or by customer.

Catering Establishment
Catering Establishment means an establishment that prepares and stores food on-site in order to transport the food to an off-site location to be served to customers or set up in a buffet for customer self-service.

Cemetery and Crematory
Cemetery and Crematory means the use of property for services to prepare the human dead for burial or cremation, arranging funerals, and the interment of human remains, whether above or below ground, along with all accessory structures which are commonly and reasonably associated with such use.

Certificate of Appropriateness
Certificate of Appropriateness means the approval statement signed by the Historical Preservation Board which certifies the historical appropriateness of a proposed alteration to, construction of an addition to, or demolition (partial or full) of a landmark or property in a historic district. The issuance of a Certificate of Appropriateness authorizes the issuance of a building permit (if required) for said request.

Certificate of Compliance
Certificate of Compliance means a written record certifying that application, use, or approval is in adherence  with and to all applicable provisions of the Unified Land Use Code, together with all other standards, requirements, regulations, restrictions, and codes and ordinances of the city. The Official Zoning Map constitutes compliance with respect to the parcels of real property for which the certificate applies.

Certificate of Demolition
Certificate of Demolition means written record that the Historical Preservation Board determined that the proposed full or partial demolition of a landmark or contributing property within a historic district will not negatively impact the Historic District.

Certificate of Economic Hardship
Certificate of Economic Hardship means a form submitted by an applicant who received a denial for a Certificate of Appropriateness or Certificate of Demolition in order to claim that an economic situation prevents them from receiving an approval for an alteration to, relocation of, or demolition (partial or full) of a landmark or contributing property in a historic district, or for proposed new construction in a historic district.

Child Care Center or Pre-School
Child Care Center or Pre-School means a facility operated to provide full or part time care for any number of children in other than a residence or which is staffed by persons who are not full-time residents on site, and the operation of which has been approved in accordance with this Title. "Childcare center" does not include home childcare or childcare which is provided by an employer on the same premises as the business and solely for the benefit of the employees of that business. Childcare centers do not offer general medical services or overnight stays to the clients.

Child Respite Care Facility
Child Respite Care Facility means any facility operated to provide full or part time care for any number of children who are disabled and may require medical assistance. Child Respite Care Facilities are staffed by persons who are not full-time residents on site and may offer daytime and overnight stays. Child Respite Care Facilities do not provide educational curriculum, and are staffed at lower staff-to-client ratios than child daycare facilities.

Church Facilities
Church Facilities means any facility which is located on the same lot as a church or parsonage, but which is not used for the primary purpose of regular religious services, meetings, church school or related activities. Church facilities include, but are not limited to, full-time general education schools, childcare centers, bingo parlors, gymnasiums, and reception or banquet halls.

Circus means an event with a variety of shows, including, but not limited to, animal acts, feats of physical skill, and performances by entertainers such as jugglers or clowns, which is temporarily conducted out-of-doors and not within a theater, auditorium, gymnasium, or other permanent building.

Civic
Civic means a use category that provides services to the general public related to recreation, fellowship, worship, health, education, and transportation. Uses in this use category include, but are not limited to: childcare center; child respite care facility; college, university, or trade or vocational school (public or private); public assembly facility; school, elementary or secondary (public or private). This definition also includes other uses that the Director or their designee interprets to be functionally similar to a use in this use category.

Clinic, Acupuncture, Chiropractic, Dental, Medical Lab, Optometry, or Urgent Care
Clinic, Acupuncture, Chiropractic, Dental, Medical Lab, Optometry, or Urgent Care means a facility providing medical, psychiatric, or surgical service for sick or injured persons exclusively on an outpatient basis, including diagnostic services, treatment, training, administration, and services to outpatients, employees, or visitors. The term clinic includes immediate care facilities, where urgent care treatment is the dominant form of care provided at the facility, but does not include hospital, freestanding emergency medical care facility, or state-designated trauma center.

CLOMR (Conditional Letter of Map Revision) means FEMA’s comment on a proposed project, which does not revise an effective floodplain map, that would upon construction, affect the hydrologic or hydraulic characteristics of a flooding source and thus result in the modification of the existing regulatory floodplain.

Collocation

Compatibility, Architectural
Compatibility, Architectural means a condition in which buildings materials, colors, architectural features, massing and screening devices are complementary to surrounding buildings. Compatibility can be achieved by contrasting one style, form, or color palette against other nearby buildings. Compatibility does not mean “the same as.” Rather, compatibility refers to the sensitivity of development proposals in maintaining the character of existing development.

Language such as “stealth,” “camouflage,” or similar in any permit or other document is included in this definition to the extent such permit or other document reflects an intent at the time of approval to condition the site’s approval on a design that looks like something else.   Concealment can further include a design that mimics and is consistent with the nearby natural, or architectural features (such as an artificial tree), or is incorporated into (including without limitation, being attached to the exterior of such facility, and painted to match it) or replaces existing permitted facilities (including without limitation, stop signs or other traffic signs or freestanding light standards) so that the presence of the WCF is not apparent.  This definition does not include conditions that merely minimize visual impact but do not incorporate Concealment Design Techniques so that the facility looks like something other than a wireless Tower or Base Station.

Cottage Food Products means non-potentially hazardous foods that do not require refrigeration for safety and are prepared for sale in the kitchen of a cottage food operation. In accordance with the Colorado Cottage Foods Act, as amended from time to time, cottage food products include:

  • pickled fruits and vegetables with a finished equilibrium pH of 4.6 or below;

  • spices, teas, dehydrated produce, nuts, seeds, honey, jams, jellies, preserves, fruit butter, flour, and baked goods, including candies, fruit empanadas, tortillas, and other similar products;

  • up to 250 dozen whole eggs per month may also be sold;

  • canned fruits and applesauce;

  • pickled vegetables and fruits with a finished pH of 4.6 or below; and 

  • dehydrated produce including freeze-dried produce.

Demolition by Neglect means a situation in which a property owner intentionally allows a historic property to suffer severe deterioration, potentially beyond the point of repair often with the intent to circumvent historic preservation regulations.

Design Guidelines mean a set of design parameters for alterations, additions, demolition, and new construction to landmarks and within historic districts. These guidelines are adopted by City Council and used by the Historical Preservation Board and/or Director to evaluate the appropriateness of a project's design and ensure that the proposed work respects the historic character and integrity of the landmark or historic district.

Drug, Alcohol or Psychiatric Treatment Center means a facility that provides for the treatment or counseling of persons having drug or alcohol abuse problems or psychiatric illnesses under the supervision of professional health care or social services providers.

Dry Cleaning Store or Laundromat means a facility used for cleaning fabrics, textiles, wearing apparel, or articles of any sort by immersion and agitation, or by immersions only, in water or volatile solvents.

Dry Cleaning, Commercial Operations means a commercial facility where fabrics are cleaned with substantially non-aqueous solvents on a commercial or wholesale basis.

Duplex means a building on a single lot that contains two separate single-family dwelling units that do not share living areas. Duplexes may be configured as side-by-side units that share a party wall or as multi-story buildings in which one unit is located over the other unit.

Dwelling Unit
Dwelling Unit means one or more connected rooms that are structurally divided from other dwelling units or from all other rooms in the same building and providing residence, for including permanent provisions for living, sleeping, eating, cooking, and sanitation. No such dwelling unit shall be occupied by more than one unrelated individual over the age of 12 years who is required to register as a sex offender under the provisions of C.R.S. § 18-3-412.5, as amended. Provided, however that this Section shall not require a resident to leave the home upon becoming 12 years of age.

Units may have either private or shared access and may be arranged in a variety of configurations, including back-to-back, side-to-side, or over-under. Dwelling, Multi-Family means any building structurally divided into five or more separate dwelling units on a single parcel. The term includes apartments and excludes slot homes. Ownership may be in the form of fee-simple ownership of the entire parcel or in the form of a condominium.

Dwelling, Single-Family Attached / Duplex
Dwelling, Single-Family Attached / Duplex means a principal residential structure, including a duplex or townhouse but not a mobile home, designed and used as a residential dwelling unit, that is located on its own lot, shares a common wall with one other single-family attached dwelling, and can include rooming and boarding as an accessory use. No such dwelling unit shall be occupied by more than one unrelated individual over the age of 12 years who is required to register as a sex offender under the provisions of C.R.S. § 16-22-103, as amended. Provided however, that this Section shall not require a resident to leave the home upon becoming 12 years of age, nor shall this Section apply to any child required to register as a sex offender under said statute who is placed pursuant to C.R.S. § 19-1-103(51.3), in a foster care home certified or licensed pursuant to C.R.S. Article 6 of Title 26.

Provided however, that this Section shall not require a resident to leave the home upon becoming 12 years of age, nor shall this Section apply to any child required to register as a sex offender under said statute who is placed pursuant to C.R.S. § 19-1-103(51.3), in a foster care home certified or licensed pursuant to C.R.S. Article 6 of Title 26.

Electric Distribution means a part of a system for distributing power from an electric transmission system to a consumer that operates at less than 69,000 volts.

Electric vehicle
Electric vehicle means any vehicle that operates, either partially or exclusively, on electrical energy from the grid, or an off-board source, that is stored on-board for motive purpose. "Electric vehicle" includes the following:

  • "Battery electric vehicle (BEV)" means any vehicle that operates exclusively on electrical energy from an off-board source that is stored in the vehicle's batteries; and produces zero tailpipe emissions or pollution when stationary or operating.
  • "Plug-in hybrid electric vehicle (PHEV)" means an electric vehicle that:
    • contains an internal combustion engine and also allows power to be delivered to drive wheels by an electric motor;
    • charges its battery primarily by connecting to the grid or other off-board electrical source;
    • may additionally be able to sustain battery charge using an on-board internal-combustion-driven generator; and
    • has the ability to travel powered by electricity.
  • "Neighborhood electric vehicle" means a self-propelled, electrically powered four-wheeled motor vehicle whose speed attainable in one mile is more than twenty miles per hour and not more than twenty-five miles per hour and conforms to federal regulations under Title 49 C.F.R. Part 571.500.
  • "Medium-speed electric vehicle" means a self-propelled, electrically powered four-wheeled motor vehicle equipped with a roll cage or crush proof body design, whose speed attainable in one mile is more than twenty-five miles per hour but not more than thirty-five miles per hour and otherwise meets or exceeds the federal regulations set forth in 49 C.F.R. Sec. 571.500.

Electric Vehicle Charging Station
Electric Vehicle Charging Station means a public or private parking space that is served by battery charging station equipment that has as its primary purpose the transfer of electric energy (by conductive or inductive means) to a battery or other energy storage device in an electric vehicle. An electric vehicle charging station equipped with Level 1 or Level 2 charging equipment is permitted outright as an accessory use to any principal use.

Elementary/Secondary School means an educational establishment for children between Kindergarten and 12th grade.

Elevated Building
Elevated Building means a non-basement building (i) built, in the case of a building in the floodplain, to have the top of the elevated floor above the ground level by means of pilings, columns (posts and piers) or shear walls parallel to the flow of the water and (ii) adequately anchored so as to not impair the structural integrity of the building during a flood of up to the magnitude of the base flood. In the case of floodplain areas, “elevated building” also includes a building elevated by means of fill or solid foundation perimeter walls with openings sufficient to facilitate the unimpeded movement of flood waters.

No more than two persons may occupy one bedroom at a time. There are eight types of group homes:

  • Group Home for Persons with Disabilities. A dwelling unit that is shared by four or more persons with disabilities living together as a single housekeeping unit. Professional staff may provide 24-hour supervision or supportive services and may reside in the dwelling unit.
  • Group Home for the Elderly. A group home of persons 60 years of age or older who do not require medical attention associated with a residential health care facility. Group homes for elderly persons shall be licensed as an assisted living residence or alternative care facility by the Colorado Department of Public Health and Environment.
  • Group Home for Mentally Ill Persons. A state-licensed group home exclusively for the care of persons with mental illness, as defined and regulated by the Colorado Department of Public Health and Environment.

  • Group Home for Children Awaiting Disposition. A state-licensed group home for children up to 18 years age who are not related to the head of the household, and who are awaiting disposition to foster homes or other accommodations.
  • Group Home for Recovery Residence. A state-licensed, sober-living-environment group home exclusively for use by adults who are recovering from substance use disorders, as defined and regulated by the Colorado Board of Health and the National Association of Recovery Residences.
  • Group Home for Children. A residential facility for children, which is licensed by the state department of social services for the purpose of providing foster family care.
  • Group Home for Persons with Disabilities. A dwelling unit that is shared by four or more persons with disabilities living together as a single housekeeping unit. Professional staff may provide 24-hour supervision or supportive services and may reside in the dwelling unit. A state-licensed group home exclusively for the care of persons with developmental disabilities, as defined and regulated by the Colorado Department of Human Services, Division for Developmental Services, and the Colorado Department of Public Health and Environment.

Group Living
Group Living means a use category with residential occupancy of a dwelling by a means other than found in Household Living typically providing communal kitchen/dining facilities. Uses include, but are not limited to, foster family care home; group home for persons with disabilities; group home for the elderly; independent living facility; recovery residences and nursing home/congregate housing. This definition also includes other uses that the Director or their designee interprets to be functionally similar to a land use in this use category.​​​​

Gymnastic, Dance Studio, or Martial Arts Facility
Gymnastic, Dance Studio, or Martial Arts Facility means a facility that offers its primary floor area for the practice of gymnastics, dance, martial arts, and similar physical activities. Such a facility may include, but is not limited to, workout or exercise equipment, gymnasiums, and snack bar-refreshment services.

Hardscape
Hardscape means any non-living materials or structural site improvements, that may include, buildings, paving, walkways, walls, fences, arbors, patios, site furnishings, decorative rock, stones, and similar materials.

Hardscaping
Hardscaping means an outdoor amenity space created using paving or other impervious cover. The percentage of hardscaping on a site contributes to the Public and Private Open Space. Walkways, driveways, and other areas of impervious cover that are not used as an amenity space do not count toward the hardscaping calculation.

Hardware Store
Hardware Store means a facility selling tools, implements, and other items used in home life and activities such as gardening, home repair, plumbing, painting, auto repair, fasteners, building materials, hand tools, power tools, keys, locks, hinges, chains, plumbing supplies, electrical supplies, cleaning products, housewares, tools, utensils, paint, and lawn and garden products directly to consumers for use at home or for business, and may include specialty departments for plants and nursery products, pet food and supplies, and other household supplies.

Health and Fitness Club
Health and Fitness Club means a facility used for exercise, fitness, sports, and sports instruction including martial arts schools, yoga studios, and dance instruction studios as a business.

Height
Height means the vertical distance above a point of reference measured to the highest point of the coping of a flat roof, the deck line of a mansard roof, or to the average height of the highest gable of a pitched or hipped roof. The point of reference shall be selected by either of the following, whichever yields a greater height of building:

  • The elevation of the highest adjoining sidewalk or ground surface within a five-foot horizontal distance of the exterior wall of the building when the sidewalk or ground is not more than 10 feet above the lowest grade; or
  • An elevation 10 feet higher than the lowest grade when the sidewalk or ground surface is more than 10 feet above lowest grade.

The height of a stepped or terraced building is the maximum height of any segment of the building.

Highest Adjacent Grade
Highest Adjacent Grade means the highest natural elevation of the ground surface prior to construction next to the proposed walls of a structure.

High-Water-Use Turf
High-Water-Use Turf means turfgrass that has an exceptionally high-water requirement to prevent dormancy, typically one-and-one-half inches of water or more per week.

Historic Designation
Historic Designation means the formal recognition of a historic structure, site, or district.

Historic District
Historic District means a defined geographical area consisting of properties that are contributing or non-contributing to the established history and significance of the area to local, state, or national history.

Historic Landmark
Historic Landmark means any resources in the city, at least 40 years old, both public and private, including buildings, homes, replicas, structures, objects, properties, cultural landscapes or sites that have importance in history, architecture, archeology, or cultural of this city, state or nation, as determined by the Board and having received a historic designation.

Historic Property
Historic Property means a district, site, building, structure, or object significant in American history, architecture, engineering, archeology, or culture at the national, state, or local level.

Historical Preservation Commission
Historical Preservation Commission means the group of people tasked with advising staff and City Council on any requests for alterations to, additions to, relocation of, or demolition of a historic resource, often a landmark or contributing property within a historic district. The Commission is also responsible for evaluating the eligibility of potential historic resources, conducting surveys, assisting in public education efforts regarding historic resources, and making recommendations regarding design standards and guidelines for historic resources.

Historic Significance means the meaning or value ascribed to a building, structure, object, site, or district based on criteria for evaluation.

Historic Structure
Historic Structure means any structure that:

  • Is listed individually on the national register of historic places by the department of the interior, or preliminarily by the secretary of the interior as meeting the requirements for individual listing on the National Register; or by the Colorado Historical Society; or
  • Is certified or preliminarily determined by the secretary of the interior as contributing to the historical significance of a registered historic district or a district preliminarily determined by the secretary to qualify as a registered historic district;
  • Is individually listed on a state or local inventory of historic places in states or communities with historic preservation programs approved by the secretary of the interior, or directly by the secretary of interior in states without approved programs.

Historic Tree
Historic Tree means:

  • any existing, healthy tree with a depth at breast height (DBH) of 36 inches or greater;
  • an existing tree of any species with a DBH of 36 inches or greater that the City Council determines to be of unique and intrinsic value to the general public because of its size, age, historic association, or ecological value; or

  • any existing "champion tree" selected and duly designated at the State or national level by the American Forestry Association.

Hive
Hive means a structure intended for the housing of one bee colony. A hive, including the attached honey supers, shall not exceed 12 cubic feet in size.

Home Childcare
Home Childcare means any childcare facility which is operated in a private residence which is staffed only by full-time residents of the premises. Home childcare is limited to the full or part time care of not more than six children, including those of the operator, and not more than two additional children for before and after school care. Operation of home childcare facilities must be approved in accordance with this Title.

Home Furnishing Store
Home Furnishing Store means retail or service activities for the selling of home furnishings, appliances, and electronics that can either be easily installed or are intended to be used as furniture. Stores that sell a substantial amount of raw materials, such as lumber and brick, are not including within this use category. Similar uses include, but are not limited to, household appliance sales, upholstery shops, and furniture stores.

Home Improvement Center (with garden center)
Home Improvement Center (with garden center) means a store which sells hardware, lumber, building materials, interior decorations, and other items with the purpose of aiding the do-it-yourself handyman with home improvements or repair. This use includes specialty building material stores, such as lumber yards.

Home Occupation
Home Occupation means any business or service of limited scope that is conducted entirely within a dwelling and carried on solely by its residents. A home occupation is clearly incidental and secondary to the principal use for residential purposes and does not include any exterior alterations of the property that may affect the residential character of the neighborhood.

Hospice Center
Hospice Center means a licensed facility providing palliative and supportive medical and health services to meet the physical, psychological, social, spiritual, and special needs of terminally ill patients and their families in a home‐like setting.

Hospital
Hospital means a facility in which patients or injured persons are given medical, surgical and/or psychiatric care on an inpatient or outpatient basis, or an institution for the care of injuries, diseases, or other human ailments.

Household Living
Household Living means a use category with residential occupancy of a dwelling unit by a household on a month-to-month or longer basis in structures with self-contained dwelling units including kitchens. Household living can occur in the following type of residential units: apartment; dwelling, single-family attached / duplex; dwelling, single-family, detached; multiplex (three to six residential units); and townhouse.

Hotel or Motel
Hotel or Motel means a building, a portion of a building, or a group of buildings used to provide sleeping accommodations for transients on a daily or weekly basis, whether such establishments are designated as a hotel, inn, hostel, motel, motor inn, motor lodge, or otherwise.

Impervious Surface means man-made structures, improvements and surfaces that prevent or significantly limit the infiltration of stormwater. Examples of impervious structures and improvements are: buildings, structures, roads, driveways, parking lots, decks, swimming pools, patios, and sidewalks. Porous asphalt and concrete pavement are considered impervious surfaces.

Independent Living Facility
Independent Living Facility means a facility for persons who are socially and functionally independent all or most of the time. Residents are capable of moving about, taking care of their personal hygiene, preparing and eating their own meals, performing most housekeeping tasks, and monitoring their own medications. Residents are able to reason, identify, and meet their needs and deal appropriately with other people.

Indoor Storage means a facility for the keeping of business, personal property, and office records, including mini warehouses.

Insurable Structure
Insurable Structure means a structure which qualifies for coverage under the National Flood Insurance Program; a walled and roofed building, including a gas or liquid storage tank, that is principally above ground, as well as a manufactured home. The terms "structure" and "building" are interchangeable in the National Flood Insurance Program (NFIP).

Invasive Plant Species
Invasive Plant Species means introduced species that can thrive in areas beyond their natural range of dispersal. These plants are characteristically adaptable, aggressive, and have a high reproductive capacity. Their vigor combined with a lack of natural enemies often leads to outbreak populations, displacement of native plants, and dominance of native plant communities. Also, any plant species listed by the U.S. Department of Agriculture as a noxious weed in the State of Colorado is considered an invasive plant species.

Inventory
Inventory means a catalog of buildings, structures, objects, and sites within the city that are listed, eligible for listing, or non-eligible for listing in the Littleton Historic Register.

Irrigation System
Irrigation System means an overall system of various components, including pipelines, sprayers, bubblers, drip emitters and other materials, including timers, designed, and installed to ensure that all landscaped areas and plant materials are adequately watered on a regular basis. An irrigation system shall include a backflow prevention device. "Irrigation system" does not include the use of portable sprinklers, hoses, or hand watering.

Kennel means a facility in which four or more household pets are temporarily housed, groomed, bred, boarded, or trained; and may also be incidentally treated for medical conditions. Kennel includes for-profit facilities, as well as not-for-profit or public facilities at which abandoned or rescued animals are housed and offered for adoption. Kennels may also sell animals.

Lamp
Lamp means a generic term for a source producing light sometimes referred to as bulbs or tubes and include both traditional light sources that generate light by a glowing filament or gas discharge source (metal halide, high-pressure sodium, incandescent, fluorescent and induction, neon, arson, mercury or other gases) and solid-state lighting.

Landmark
Landmark means an individual property designated to the Littleton Historic Register recognizing its contribution to the city's history based on its significant architecture, engineering, archeology, and/or culture.

Living Facility, Independent
Living Facility, Independent means a residential rental properties restricted to adults at least 55 years of age or older. This facility will have central dining facilities that provide residents as part of their monthly fee with access to meals and other services such as housekeeping, linen service, transportation, and social and recreational activities. Such properties do not provide, in a majority of the units, assistance with activities of daily living such as supervision of medication, bathing, dressing, toileting, etc. There are no licensed skilled nursing beds in the property.

LOMR (Letter of Map Revision)  means FEMA’s official revision of an effective flood insurance rate map. Lowest Floor
Lowest Floor means the lowest floor of the lowest enclosed area (including basements). Any floor used for living purposes which includes working, storage, sleeping, cooking and eating, or recreation or any combination thereof. This includes any floor that could be converted to such a use such as a basement or crawl space. The lowest floor is a determinate for the floor insurance premium for a building, home or business. An unfinished or flood resistant enclosure, useable solely for parking or vehicles, building access, or state in an area other than a basement area is not considered a buildings lowest floor; provided that such enclosure is not built so as to render the structure in violation of the applicable non elevation design requirement of Section 60.3 of the National Flood Insurance Program regulations.

Low-Water-Use Plants means plants that require less than 30 percent of reference evapotranspiration to maintain optimum appearance.

Lumber Yard
Lumber Yard means an establishment where lumber and other building materials such as brick, tile, cement, insulation, roofing materials, and the like are sold at retail. The sale of items, such as heating and plumbing supplies, electrical supplies, paint, glass, hardware, and wallpaper is permitted at retail and deemed to be customary and incidental to the sale of lumber and other building materials. Major Nonconformity Use
Major Nonconformity Use means those nonconforming uses or structures that the Director finds have the following characteristics to such an extent that they should, over time, be eliminated:

  • Generation of nuisances;
  • Incompatibility with adjacent properties;
  • Incompatibility with the Comprehensive Plan;
  • Generation of substantiated criminal complaints; or
  • Pose a risk to public health and safety.

Manufactured Home
Manufactured Home means a structure, constructed on or after June 15, 1976, in compliance with the rules and definitions of the United States Department of Housing and Urban Development, transportable in one or more sections, which is built on a permanent chassis and is designed for use with or without a permanent foundation when connected to the required utilities for occupancy. The term "manufactured home" does not include recreational vehicles.

Master Development Plan
Master Development Plan means a set of plans and drawings that display how the regulations and standards of mixed-use development apply to the land, which include, but are not limited to, the location, scale and bulk of buildings and other structures; intensity of use or density of development; layout, configuration, and classification of public streets, roads, private drives, and pedestrian ways and trails; the design and arrangement of parking areas and facilities; common open space and amenities; provisions for drainage and provision of public facilities and services, and the covenants, conditions and restrictions relating to land use.

Medical Facilities
Medical Facilities means a use category with public and civic uses providing medical or surgical care to patients. Some uses may offer overnight care. The supporting technical data might be based on the standard step-backwater computer model used to develop the 100-year floodway or floodplain shown on the FIRM or other engineering evaluation.

Nursery or Garden Center means an enterprise that conducts the sale of plants grown off premises. The terms also include, as an accessory use, the sale of a limited selection of items (e.g., soil, planters, mulch,  garden accessories, etc., but not power equipment) that are directly related to the care and maintenance of landscapes. The term "nursery or garden center" does not include the cultivation of trees (or other vegetation normally associated with landscaping) where the principal use is growing nursery stock for sale at off-site retail businesses.

Pedestrian-Oriented
Pedestrian-Oriented means development that is designed to emphasize sidewalk, building, and site design that facilitates easy access for pedestrian movement over vehicular movement. Buildings in such developments are generally placed close to the street and the main entrance is oriented to the street sidewalk. There are generally windows and display areas along the street façades of buildings and outdoor areas (such as plazas) that are oriented to pedestrians. Although parking areas may be provided, they are not emphasized by the design of buildings.

Race Track (Vehicle) means a racing area that may be non-profit or for-profit, public or private, paved or unpaved, and that is used by vehicles, including but not limited to bicycles, automobiles, motorcycles, or any other motorized vehicles with competition against the clock or other vehicles.

Rain/Xeriscaped Gardens
Rain/Xeriscaped Gardens means landscaping features adapted to treat stormwater runoff which is directed into shallow vegetative depressions that allow filtration before the water enters the storm drain system. The feature may be designed to require little to no supplemental irrigation planted with drought tolerant plants well adapted to the local climate. These may be located in parking lot islands or within small pockets in residential land uses and may be under-drained or self-contained.

Reconstruction
Reconstruction means the act or process of depicting, by means of new construction, the form, features, and detailing of a non-surviving historic site, landscape, building, structure, or object for the purpose of replicating its appearance at a specific period of time and in its historic location.

Recovery Residence
Recovery Residence means any premises, place, facility, or building that provides housing accommodation for individuals with a primary diagnosis of a substance use disorder that:

  • Is free from alcohol and nonprescribed or illicit drugs;
  • Promotes independent living and life skill development; and
  • Provides structured activities and recovery support services that are primarily intended to promote recovery from substance use disorders.
  • Houses no more than two residents per bedroom, including any staff, at one time.

The actual start of construction means either the first placement of permanent construction of a structure on a lot, such as the pouring of slab or footings, the installation of piles, the construction of columns, or any work beyond excavation or the placement of a manufactured home on a foundation. Permanent construction does not include land preparation, such as clearing, grading and filling; nor does it include the installation of streets and/or walkways; nor does it include the excavation for basement, footings, piers, or foundations or the erection of temporary forms; nor does it include the installation on the property of accessory buildings, such as garages or sheds not occupied as dwelling units or not part of the main structure. For substantial improvement, the actual start of construction means the first alteration of any wall, ceiling, floor, or other structural part of a building, whether or not that alternative affects the external dimension of the building.

A studio does not include a tattoo parlor or body art or nude modeling studio.

Subdivision
Subdivision means the division of land into two or more lots, tracts, or parcels for the purpose of transfer of ownership or building development.

Substantial Change
Substantial Change means a modification that substantially changes the physical dimensions of an eligible support structure if after the modification, the structure meets any of the following criteria:

  • for towers other than alternative tower structures, it increases the height of the tower by more than 10 percent or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed 20 feet, whichever is greater;
  • for other eligible support structures, it increases the height of the structure by more than 10 percent or more than 10 feet, whichever is greater, as measured from the top of an existing antenna to the bottom of a proposed new antenna;
  • for towers, it involves adding an appurtenance to the body of the tower that would protrude from the edge of the tower more than 20 feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater;
  • for eligible support structures, it involves adding an appurtenance to the body of the structure that would protrude from the edge of the structure by more than six feet;
  • for any eligible support structure, it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed four cabinets per application;
  • for base stations, it involves installation of any new equipment cabinets on the ground if there are no pre-existing ground cabinets associated with the structure, or else involves installation of ground cabinets that are more than 10 percent larger in height or overall volume than any other ground cabinets associated with the structure;
  • for any eligible support structure, it entails any excavation or deployment outside the current site;
  • for any eligible support structure, it would undermine the concealment elements of the eligible support structure; or
  • for any eligible support structure, it does not comply with conditions associated with the siting approval of the construction or modification of the eligible support structure or base station equipment, unless the non-compliance is due to an increase in height, increase in width, addition of cabinets, or new excavation that would not exceed the thresholds identified above.

For purposes of determining whether a substantial change exists, changes in height are measured from the original support structure in cases where deployments are or will be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in height are measured from the dimensions of the tower or base station, inclusive of originally approved appurtenances and any modifications that were approved prior to February 22, 2012.

Substantial Damage
Substantial Damage  means damage, of any origin, sustained by a structure which results in cumulative costs (over a five-year period) to restore the structure to its original condition that equal or exceed 50% of the market value of the structure before the damage occurred.

Substantial Improvement means any reconstruction, rehabilitation, repair of wear, addition, or improvement of a structure, the cost of which equals or exceeds 50% of the fair market value of the structure before the "start of construction" of the improvement.

Substantial Improvement (Floodplain)
Substantial Improvement (Floodplain) means any repair, reconstruction, or improvement to a structure, the cumulative cost (over a five-year period) of which equals or exceeds 50% of the market value of the structure before start of construction of the improvement. The value of the structure shall be determined by the local jurisdiction having land use authority in the area of interest. This includes structures which have incurred substantial damage, regardless of the actual repair work performed. The term does not include either: a) any project for improvement of a structure to correct existing violations of state or local health sanitary, or safety code specifications which have been identified by the local cod enforcement official and which are the minimum necessary conditions, or b) any alteration of any officially designated historic structure provided that the alteration will not preclude the structure’s continued designation as a historic structure.

Tattoo Parlor and Body Art Studio means an establishment whose principal business activity is the practice of placing of designs, letters, figures, symbols, or other marks upon or under the skin of any person, using ink or other substances that result in the permanent coloration of the skin by means of the use of needles or other instruments designed to contact or puncture the skin.

Tiny Home Community
Tiny Home Community means single-family dwelling units of no greater than 750 square feet each, which are arranged in a community (a common plan of development). Units may be placed on a permanent foundation or attached to a chassis. A tiny home is not a manufactured home as defined by the U.S. Department of Housing and Urban Development (HUD) or a recreational vehicle as defined by the National Fire Protection Association (NFPA) and American National Standards Institute (ANSI).

Topsoil means native soil, which is to be stockpiled during construction activities and returned to landscaped areas, and may also refer to imported soil material where native topsoil is substandard or non-existent.

Tower
Tower means any structure that is designed and built for the sole or primary purpose of supporting any FCC-licensed or authorized antennas and their associated facilities, including structures that are constructed for wireless communications services including, but not limited to, private, broadcast, and public safety services, as well as unlicensed wireless services and fixed wireless services such as microwave backhaul, and the associated Site. The term includes radio and television transmission towers, self-supporting lattice towers, guy towers, monopoles, microwave towers, common carrier towers, cellular telephone towers, and the like. Alternative Tower Structures and Small Cell Facilities in the Rights-of-Way are not Towers.

Townhome means a single-family dwelling unit, with a private entrance, which is part of a structure whose dwelling units are attached horizontally in a linear arrangement, and having a totally exposed front and rear wall to be used for access, light, and ventilation. Transit-Oriented Development (TOD)
Transit-Oriented Development (TOD) is the functional integration of land use and transit via the creation of compact, walkable, mixed-use communities within walking distance of a transit facility. A TOD brings together people, jobs, and services and is designed in a way that makes it efficient, safe, and convenient to travel on foot or by bicycle, transit, or car.

Transmission Equipment

Tree, Historic means:

  • any existing, healthy tree with a depth at breast height (DBH) of 36 inches or greater;

  • any existing "champion tree" selected and duly designated at the State or national by the American Forestry Association.

Urban areas are most readily identified as those with smaller, narrower lots with minimal or no setbacks, urban, pedestrian-friendly streetscapes, and where the auto is parked either on the street, in the rear yard, or in structured parking.

  • The following above-ground utilities: Electric services, including high-voltage transmission lines (115 kilovolts or more) and electric generation plat; solar panel array with a gross site area of 10,000 square feet or greater; wind generating stations; natural gas transmission; natural gas distribution; mixed, manufactured, or liquefied petroleum gas production and/or distribution; combination electric and gas, and other utility services; water towers and supply; sanitary services; steam and air-conditioning supply; solid waste facilities; irrigation systems; sanitary service facility; establishments primarily engaged in waste systems or waste treatment facilities that collect, treat and dispose of waste; wireless communication facilities; and other similar facilities, as determined by the Zoning Administrator.

Utilities, Minor (Above-Grade) means above-grade utilities of less than 10,000 square feet of gross site area that have a localized impact on surrounding properties and are necessary to provide essential services, including, but not limited to, the following: electric transformers, switch boxes, telephone pedestals, and telephone boxes, television pedestals and televisions boxes, traffic boxes, and similar devices. Minor utilities include but are not limited to: collocated telecommunication antenna; public or municipally-owned utilities; small cell facilities; solar panel array (small scale); stormwater retention or detention facility; and telecommunication exchange. This definition also includes other uses that the Director or their designee interprets to be functionally similar to a land use in this use category.

Warehousing means a building used for the storage of goods, merchandise, and/or commodities which may be for later use or resale and are typically used by importers, exporters, wholesalers, retailers, transport businesses, and other similar entities. This definition does not include self-service storage.

Water Surface Elevation
Water Surface Elevation  means the elevation, in relation to the North American Vertical Datum (NAVD) of 1988 (or other datum where specified), of floods of various magnitudes and frequencies in the floodplains of coastal or riverine areas.

Watercourse
Watercourse means a channel, natural depression, slough, artificial channel, gulch, arroyo, stream, creek, pond, reservoir, or lake into which storm runoff and floodwater flows either regularly or infrequently. Wetlands
Wetlands mean those areas that are inundated or saturated by surface water or groundwater at a frequency and duration sufficient to support and that, under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions. Wetlands generally include swamps, marshes, bogs and other similar areas.

Wholesale Sales and Distribution
Wholesale Sales and Distribution means establishments primarily engaged in selling and/or distributing merchandise to retailers, users, firms, or other wholesalers, as well as activities involving the movement and storage of products and equipment.

Winery
Winery means an establishment where vinous liquors are manufactured, served, and/or sold to the public. Typically, a winery will have a state issued liquor license.

Wireless Communications Facility (WCF)
Wireless Communications Facility (WCF) means a major utility facility used to provide personal wireless services as defined at 47 USC section 332(c)(7)(C); or wireless information services provided to the public or to such classes of users as to be effectively available directly to the public via licensed or unlicensed frequencies; or wireless utility monitoring and control services. A WCF does not include a facility entirely enclosed within a permitted building where the installation does not require a modification of the exterior of the building; nor does it include a device attached to a building, used for serving that building only and that is otherwise permitted under other provisions of this Code. A WCF includes an antenna or antennas, including without limitation, direction, omni-directional and parabolic antennas, base stations, support equipment, alternative tower structures, and towers. It does not include the support structure to which the WCF or its components are attached if the use of such structures for WCFs is not the primary use. The term does not include mobile transmitting devices used by wireless service subscribers, such as vehicle or handheld radios/telephones and their associated transmitting antennas, nor does it include other facilities specifically excluded from the coverage of this section.

Yard means a required open space located on the same lot with a structure, between a lot line and the nearest setback line, unoccupied and unobstructed from the ground up, except for accessory structures, fences, or screening walls, or such projections as are expressly permitted in this Code.

Yard, Corner means a yard lying between the side lot line and the right-of-way of a street that is perpendicular to the front yard, and extending from the front yard to the rear yard.
