(§ 5.24, Ord. 342, as amended by § 173, Ord. 1095, eff. November 20, 2010)

§ 9-3.1902 Erection of light standards and signs within building lines: Approval: Agreements.

In any commercial, highway-commercial, or industrial district the following structures may be permitted within building lines:
(a)
Lighting standards where the supporting pole does not exceed ten (10″) inches in diameter; the setback from the property line shall not be less than five (5′) feet; and
(b)
Appurtenant signs where the supporting pole does not exceed two (2″) inches in diameter and is not more than ten (10″) inches in diameter; the minimum setback to the pole shall be five (5′) feet, and the minimum distance from the curb grade to the bottom of the sign shall be twelve (12′) feet.
Such approval may be given by the City Inspector upon receipt of a satisfactory agreement, approved by the City Attorney, which guarantees the removal of any such structures within the building line area on the order of the Council and at such time as the street upon which such signs border is proposed for widening. Such removal shall be at the expense of the property owner involved without any liability whatsoever on the part of the City.
