ZONING AMENDMENTS

§ 9-3.2401 Initiation: Fees.

Any zoning amendment may be initiated by:
(a) 
Filing with the Commission a resolution of intention of the Council;
(b) 
Passage of a resolution of intention by the Commission; or
(c) 
Filing with the Commission a petition of one or more record owners, or their authorized agents, of property which is the subject of the proposed amendment. A petition for amendment shall be accompanied by a fee set by the Council.

§ 9-3.2402 Commission hearings.

Upon receipt of a petition or resolution of intention to amend the provisions of this chapter the Commission shall set a date for a public hearing thereon. Such date shall not be later than 45 days after the receipt of such petition or resolution unless CEQA needs to be considered.

§ 9-3.2403 Commission hearings: Notices.

Notice of the public hearing required by the provisions of Section 9-3.2402 of this article shall be given as required by law. Additional notice of the time and place of such hearing and the purpose thereof shall be given by posting at least three notices thereof not less than 10 days prior to such hearing along the streets upon which the property proposed to be affected abuts.
Each such notice shall consist of the words "Notice of Proposed Zoning Change" in letters not less than one inch in height and a statement in small letters setting forth a general description of the property proposed to be affected, the time and place of the public hearing thereon, and such other information as the Commission deems necessary.

§ 9-3.2404 Commission recommendations.

At the conclusion of the public hearing required by the provisions of Section 9-3.2402 of this article, or continuations thereof, the Commission shall make a report of its findings and recommendations with respect to the proposed zoning amendment. The Commission report shall include a list of the persons who testified at the hearing, a summary of the facts adduced at the hearing, the findings of the Commission, and copies of any maps or other data and/or documentary evidence submitted in connection with the proposed zoning amendments. A copy of such report and recommendation shall be transmitted to the Council within 90 days after the first notice of such hearing; provided, however, such time may be extended with the consent of the Council or the petitioner for such amendment. In the event the Commission fails to report to the Council within such 90 day period of time or within the agreed extension of time, the zoning amendment shall be deemed approved by the Commission.

§ 9-3.2405 Council action: Hearings.

Upon the receipt of the recommendation of the Commission, or following the expiration of the 90 day period of time or agreed upon extension of time, the Council shall hold a public hearing on the petition or resolution of intention to amend the provisions of this chapter. Notice of such hearing shall be given as provided by law. At the conclusion of such hearing, the Council, within one year, may adopt the proposed amendment, or any part thereof, set forth in the petition or resolution of intention in such form as the Council deems desirable.
