ENFORCEMENT: VIOLATIONS

§ 9-3.2601 Enforcement.

It shall be the duty of the Code Enforcement Officer to enforce the provisions of this chapter pertaining to the use of land or buildings and the erection, construction, reconstruction, moving, alteration, or addition to any building or structure.

§ 9-3.2602 Enforcement: Appeals.

The Planning Commission shall have the power to hear and decide appeals based on the enforcement of the provisions of this chapter pursuant to the appeals procedure provided in Part 6 of Article 23 of this chapter.

§ 9-3.2603 Conflicting permits and licenses.

Any permit or license issued by any department or officer of the City in conflict with the provisions of this chapter is hereby declared to be null and void.

§ 9-3.2604 Violations: Public nuisances.

Any building or structure erected, constructed, altered, enlarged, converted, moved, or maintained contrary to the provisions of this chapter, and any use of land or buildings operated or maintained contrary to the provisions of this chapter are hereby declared to be public nuisances.

§ 9-3.2605 Violations: Public nuisances: Abatement.

The City Attorney, upon order of the Council, shall commence the necessary proceedings for the abatement, removal, and enjoinment of the public nuisances described in Section 9-3.2504 of this article in the manner prescribed by law in the courts which may have jurisdiction to grant such relief as will accomplish such abatement and restraint. The remedies provided for in this section shall be in addition to any other remedies or penalties provided for violations of the provisions of this chapter.

§ 9-3.2606 Violations: Penalties.

Any person, whether as principal, agent, employee, or otherwise, violating or causing the violation of any of the provisions of this chapter shall be deemed guilty of a misdemeanor and, upon conviction, shall be punishable as set forth in Chapter 2 of Title 1 of this Code.
