CHAPTER 17

64 - AMENDMENTS TO COMPREHENSIVE DEVELOPMENT PLAN

Sec. 17.64.010.- Purpose.

The purpose of this chapter is to provide a procedure to allow for the amendment of the comprehensive development plan of the city. Amendments which are completed according to this chapter shall become a part of the comprehensive plan and shall have the same force and effect as the original documents.

Sec. 17.64.020. - Application for amendment.

An application for an amendment to the comprehensive plan may be initiated by any of the following individuals or groups:

A.

City council;

B.

Planning commission;

C.

City staff;

D.

A property owner;

E.

A citizen of the city.

An application for a proposed amendment must be filed with the director of planning not less than three months prior to the date set by the planning commission to review proposed amendments. The application shall be submitted on a form furnished by the city.

Sec. 17.64.030. - Review of amendments by planning commission.

The planning commission shall hold a public hearing concerning all proposed amendments. Notice of the public hearing shall be published in a newspaper of general circulation at least ten days prior to the date set for the hearing. No amendment shall be recommended for approval by the planning commission to the city council unless two-thirds of the full membership of the planning commission approves the amendment.

Sec. 17.64.040. - City council action.

After the planning commission has held a public hearing concerning an amendment to the comprehensive plan, the amendment shall be considered in a public hearing by the city council. Notice of the public hearing shall be published in a newspaper of general circulation at least ten days prior to the date set for the hearing. No amendment shall be approved and made a part of the Comprehensive Plan unless it is passed by the affirmative vote of not less than two-thirds of the entire membership of the city council.

Sec. 17.64.050. - Time for review.

A review and updating of the comprehensive plan shall occur at least every ten years. The first review of the comprehensive plan after passage of the 2013 Update of the 2009 Citywide Comprehensive Plan (Resolution No. 18, Series 2013) shall be completed on or before December 31, 2023. Subsequent reviews shall be completed on or before December 31 in every tenth year thereafter. Additional reviews of the comprehensive plan may occur more often as necessary.

Sec. 17.64.060. - Same application.

The same proposal for an amendment to the comprehensive plan may be considered and reviewed only once in a calendar year unless there exists a substantial change of conditions since the time the application was previously considered.

Sec. 17.64.070. - Criteria for amendment.

Before an amendment to the comprehensive plan may be adopted, it must be demonstrated that each of the following criteria have been met or are not applicable in order to approve the amendment:

A.

The amendment request is consistent with the goals, policies and intent of the comprehensive plan of the city;

B.

The amendment request will not result in adverse impacts to existing or planned services to the citizens of the city;

C.

The amendment request demonstrates a need exists for the amendment through either changed conditions or past error which support adjustments to the city's comprehensive plan;

D.

The planning commission and/or city council may consider other factors in reviewing an application as they deem appropriate and may request additional information which is necessary for an adequate review and evaluation of the amendment.
