CHAPTER 18

82G MAPLE VALE SUBDIVISION, PLANNED RESIDENTIAL COMMUNITY PRC-6 ZONE

18.82G.005: NAME AND PURPOSE:

The name of this zone shall be the Maple Vale Subdivision PRC-6 Zone. The purpose of this development is to create an attractive, meaningful, and desirable environment within this residential community that maintains the atmosphere and honors the heritage of the area, and that is consistent with the purpose and vision of the PRC Zone and brings multiple property owners together to create one cohesive plan. The development will have a mix of larger rural lots with smaller estate lots, narrow tree lined streets, split rail fencing and other rural characteristics. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.010: PERMITTED USES:

One single-family residence per lot.
Parks and/or open space.
Temporary structures necessary for sales and/or construction activities, subject to subsection 18.84.200B of this title. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.020: PERMITTED ACCESSORY USES:

Accessory uses are permitted, provided that the use is incidental to the main dwelling unit and does not distract from or conflict with the character and purpose of the principal permitted use. All accessory uses are subject to acquisition of any approvals, permits, or licenses required to construct, operate, or maintain said use. Permitted accessory uses include:
Customary residential household pets as defined in section 18.08.010 of this title.
Fences and walls.
Home occupations subject to section 18.84.380 of this title.
One recreational area constructed on a commonly held parcel, consisting of open/green space, playground equipment, a volleyball court, and horse-shoe pits.
Owner occupied accessory apartments subject to section 18.84.410 of this title.
Pools, tennis courts, or other recreational facilities.
Private nurseries, greenhouses, or gardens.
The raising, care and keeping of limited numbers of livestock and fowl, excluding swine, for family food production or recreation. Also barns, corrals, pens and coops and other structures for the care and keeping of domestic livestock and fowl, subject to the following:
   A.   The number of animals kept shall not exceed one animal unit for each twenty thousand (20,000) square feet of lot area.
   B.   No structure for the housing of livestock or fowl or corrals for the close confinement of livestock shall be located closer than one hundred feet (100') to an existing dwelling on an adjacent lot or fifty feet (50') to such a dwelling on the same lot. 18.82G.030: CONDITIONAL USES:

The principal use of the Maple Vale Subdivision PRC-6 Zone is a single-family residential community. No conditional uses outside of the principal or accessory uses are permitted. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.040: LAND USE STANDARDS:

There are no land use standards except as outlined in sections 18.82G.010 and 18.82G.020 of this chapter. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.050: LOT STANDARDS:

The minimum lot size within the Maple Vale Subdivision PRC-6 Zone is twenty one thousand seven hundred (21,700) square feet (0.5 acre). The zone shall consist of no more than eighteen (18) lots. No new subdivision lots shall be permitted beyond those originally approved for the purpose of increasing this density. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.060: BUILDING SETBACKS:

The minimum setbacks for improvements constructed on lots in the Maple Vale Subdivision PRC-6 Zone are as follows:
   A.   Main Building:
      1.   Front yard setback: No less than thirty feet (30') measured from the property line.
      2.   Corner lot side yards: Measured the same as the front yard.
      3.   Rear yard setback: No less than twenty five feet (25') measured from the rear property line to the foundation of the home.
      4.   Side yard setback: No less than ten feet (10') measured from the property line to the foundation of the home.
   B.   Accessory Building: No accessory building shall be any closer to the front property line than the main building.
      1.   Setbacks for accessory buildings less than or equal to twelve feet (12') in height shall be as follows:
         a.   Rear yard setback: Three feet (3') from the property line to structure, but no less than fifteen feet (15') from any existing accessory structure on an adjacent lot, and no less than forty feet (40') from an existing residence on an adjacent lot.
         b.   Side yard setback: Three feet (3') from the property line to structure, but no less than fifteen feet (15') from any existing accessory structure on an adjacent lot, and no less than forty feet (40') from an existing residence on an adjacent lot.
      2.   Setbacks for accessory buildings greater than twelve feet (12') in height shall be as follows:
         a.   Rear yard setback: Ten feet (10') from the property line to structure, but no less than fifteen feet (15') from any existing accessory structure on an adjacent lot, and no less than forty feet (40') from an existing residence on an adjacent lot.
         b.   Side yard setback: Ten feet (10') from the property line to structure, but no less than fifteen feet (15') from any existing accessory structure on an adjacent lot, and no less than forty feet (40') from an existing residence on an adjacent lot. 18.82G.070: BUILDING HEIGHT:

No lot or parcel of land in this zone shall have a building or structure used for dwelling or public assembly which exceeds a height of two (2) stories with a maximum of forty feet (40') as defined in section 18.08.010 of this title. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.080: PARKING AND DRIVEWAY REQUIREMENTS:

A one-family dwelling shall provide at least four (4) off street parking spaces. At least two (2) of the spaces shall be located in an attached or detached garage that is fully enclosed. All dwelling units shall have a driveway made of hard surface material no less than thirty feet (30') in length and twelve feet (12') in width, measured from the property line to the required garage. 18.82G.090: OPEN SPACE:

A conservation easement shall be recorded on 0.4 acres of the lot that contains the existing house located at 2001 South Main Street. No buildings or structures shall be erected within this open space easement. The open space shall be maintained by the owner of that lot. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.100: STREET TREES:

Street trees shall be planted in all parkway planters in accordance with section 18.90.120 of this title. All street trees shall be October Glory Maples (Acer rubrum "October Glory"). (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)

18.82G.110: FENCING ABUTTING A STREET:

All fencing that abuts a property line parallel to a street shall be limited to four feet (4') in height and shall have a common split rail design and a common color. Lots one (1), two (2), three (3), four (4) and twelve (12) are required to install this fencing as part of a building permit for a new home in order to help emphasize and establish the rural character of the neighborhood. 18.82G.120: STREET AND CURB DESIGN:

The interior streets shall be designed to have a narrow, rural appearance. This shall be accomplished by utilizing the City's thirty two foot (32') right-of-way cross section and utilizing a low back curb. (Ord. 2018-04, 5-2-2018, eff. 5-30-2018)
