B-1 COMMUNITY

BUSINESS DISTRICT

§ 154.145 DISTRICT DEFINED.

   The B-1 Community Business District primarily encompasses the long-established commercial areas of the village where a wide range of goods and services is offered to the general public at retail or wholesale.

§ 154.146 USE RESTRICTIONS.

   The following use restrictions shall apply:
   (A)   Retail only. Every commercial or service establishment located in this District shall deal directly with consumers.
   (B)   Processing incidental. Any processing or treatment of goods on any premises must be clearly incidental to the retail business conducted on such premises.
   (C)   Unenclosed activities, special use permit. In the B-1 District, a special use permit is required to conduct any commercial, service, or storage activities outside a completely enclosed building.
   (D)   No drive-ins. No commercial or service establishment shall offer goods or services direct to customers waiting in parked motor vehicles, or sell food or beverages for consumption on the premises in parked motor vehicles. Thus, service stations, drive-in restaurants, and the like are excluded from the B-1 District.
   (E)   Refuse containers. All refuse generated by any establishment located within the B-1 District shall be stored in tightly-covered containers placed in visually-screened areas.
   (F)   Screening. Along the side and rear lot lines of any lot abutting any residential district, screening (a wall, solid fence, or closely-planted shrubbery) at least six feet high and of sufficient density to completely block the view from the adjacent residential property shall be installed.

§ 154.147 LOT AND BUILDING REQUIREMENTS.

   Special lot and building requirements are applicable to the B-1 District:

Generally, none required except as necessary to comply with applicable off-street parking and loading requirements. However, any lot that abuts any residential district shall meet the front setback and side setback (on the side abutting the residential use) requirements of such residential district (see § 154.025)

§ 154.148 PERMITTED USES.

   The following uses shall be permitted in the B-1 Community Business District (see definitions in § 154.007(B)):
   (A)   Churches and related facilities;
   (B)   Clubs and lodges;
   (C)   Commercial establishments, wholesale, and retail, except those listed under § 154.149;
   (D)   Government uses;
   (E)   Medical/dental clinics;
   (F)   Offices;
   (G)   Service establishments;
   (H)   Solar ground- and roof-mount; and
   (I)   Accessory uses in accordance with § 154.031.

§ 154.149 SPECIAL USES.

   The following may be permitted as special uses in the B-1 District in accordance with § 154.083, to-wit:
   (A)   Any use, such as drive-in restaurants, drive-in banks, service stations, and the like, that offers goods or services directly to customers waiting in parked vehicles, or that sells food or beverages for consumption on the premises in parked motor vehicles;
   (B)   Churches and related religious facilities;
   (C)   Community solar gardens;
   (D)   Dwelling units, if located above the first story;
   (E)   Nursing homes;
   (F)   Schools;
   (G)   Utility substations; and
   (H)   Any use permitted in the MR-1 District (see Sec. 40-4-29).
