CHAPTER 80
Donation Bins
§ 80-1 Legislative intent and title.
This chapter shall regulate the placement of clothing bins/containers and other collection/drop-off boxes associated with charities and not-for-profit organizations within the Town of Marlborough. All for-profit organizations/businesses can only apply for permit after seeking and receiving approval by the Town Board of the Town of Marlborough.
§ 80-2 Permit required.
Prior to the placement of a receptacle bin, container or collection/drop-off box on public or private property by either charities and not-for-profit organizations or profit organizations or businesses, a permit must be obtained.
§ 80-3 Application.
Applications may be obtained from the Town of Marlborough Building Department.
Contents. The application form must state the following:
The name and address of the charity/not-for-profit organization and the name and address for the contact person.
The length of time the bin will be left in place.
The times for emptying the bin.
The telephone number for the person responsible for the maintenance of the bin.
The street address where the bin is to be located and the name and telephone number of the owner of the property where the bin is located. The number of the bin and the location of the bin container on permitted premises shall be determined by the Town of Marlborough Code Enforcement Officer.
Said bin container shall not be moved except after obtaining written approval for such change of location from the Town of Marlborough Code Enforcement Officer.
§ 80-4 Fees and deposits.
Fee. The permit fee shall be $75, collected in advance at the time of the filing of the application.
Deposit. A refundable deposit of $250 must be paid to the Town of Marlborough upon issuance of a permit. In the event the applicant abandons the bin, or fails to maintain the area surrounding the bin in good condition, the Town of Marlborough shall have the right to use said deposit to clean and maintain the area and remove the bin.
§ 80-5 Violations; penalties for offenses.
Bins must be kept in good condition, snow removal must be provided for and, in the event the bin is damaged and rendered nonworkable, must be removed within five business days of notification.
In the event the container is not kept in a clean and orderly fashion, and after due notice by the Building Inspector/Code Enforcement Office within five business days that such violation exists, forfeiture of the deposit of $250 as well as immediate removal and loss of privileges for placement of a container for 12 months shall ensue.
