13.35 Sign

Regulations

13.35.010 Purpose

The purpose of this Chapter to support the rural nature, natural landscape, and scenic beauty of the community to create an aesthetically pleasing environment for both visitors and residents while allowing promoting economic development and commercial business. This Chapter is designed as a comprehensive sign regulation to mitigate over-concentration and improper placement of signs. This Chapter also promotes public health, safety, and welfare by providing size limitations, location requirements, and construction standards for signs. It is the public interest to prohibit signs that confuse or mislead, or that obstruct vision necessary for traffic safety, that are dangerous, or unsightly. The regulations in this Chapter are to be construed as a reasonable, effective, consistent, content-neutral, and nondiscriminatory series of sign standards.

13.35.020 Applicability And Conflict

  1. Applicability. No signs shall be erected or maintained in any land use zone, except those signs specifically listed and described in this Chapter and any tables. The number and area of signs as outlined in this Chapter are intended to be maximum standards.
  2. Conflict. If any provision of this Chapter conflicts, with any other chapter or section adopted by the City which regulates signs, the stricter regulation shall govern.

13.35.030 Definitions

  1. “Animated sign” means any sign that uses or displays video components or elements, animation of any kind including video or pictures or otherwise, or has any moving components.
  2. “Awning, Canopy, or Marquee Sign” means a “Projecting” sign where specified in the Sign Table under Section 13.35.090. It includes any sign attached to or painted on a freestanding canopy or awning or a sign placed on an awning which projects more than twelve (12) inches from a building.
  3. “Banner” means a “Specialty Sign” where specified in the Sign Table under Section 13.35.090.  It also refers to a temporary sign on a flexible material on which a sign is painted or printed. Examples include: cloth, paper, vinyl, or similar material.
  4. “Billboard” means a sign which directs attention to a business, activity, commodity, service, entertainment or communication which is not conducted, sold, or offered at the premises on which the sign is located, or which does not pertain to the premises upon which the sign is located.
  5. “Business Sign” means any type of sign specified in the Sign Table under Section 13.35.090 that is one of three (3) categories:
    1. An on-premise sign for a business in a residential zone, such as a sign for home occupation or a sign designating a multi-family development.
    2. An on-premise sign for a business located in the C-2P, C-3P, or Manufacturing Zone, and includes Common Development Centers.
    3. An on-premise sign in the C-1P Zone.
  6. “Construction Sign” means an “Identification and Information” or “Property Sign” where specified in the Sign Table under Section 13.35.090. It is a temporary sign erected on premises where construction is taking place, during the period of such construction, indicating the names of the architects, engineers, landscape architects, contractors or similar artisans, and the owners, financial supporters, sponsors, and similar individuals or firms having a role or interest with respect to the structure or project.
  7. “Department” means the Department of the City charged with the enforcement of this Chapter.
  8. “Directional Sign” means a “Identification or Information” sign specified in the Sign Table under Section 13.35.090, and includes a non-commercial sign limited to directional messages. Examples include: enter, exit, drive through lane, or similar signs as determined by the City. Logos or business names will not be permitted as needed to complete the directional message.
  9. “Freestanding Sign” means a “Business Sign” that is fixed on a non-movable pole and not attached to a building.
  10. “Government” means a sign of Marriott-Slaterville City or other local government as approved by Marriott-Slaterville City. It does not include any state or federal government authority exempt from local law.
  11. “Ideological Sign” means a sign or display communicating a message or ideas for non-commercial purposes, and which does not constitute any of the following: business sign, construction sign, direction sign, mural, billboard, on-premises sign, off-premise sign, real estate sign, political sign, model complex sign, garage sale signs, banner, or home occupation sign.
  12. “Low Profile Sign” or “Monument Sign” means a “Business Sign” that is a monument style (not on a pole) and not attached to a building. On slopes this height is measured at the mid-point of the sign.
  13. “Mural” means a picture or graphic illustration applied directly to a wall of a building which does not advertise or promote a particular business, service, or product.
  14. “On-premise Sign” means a sign which advertises or directs attention to a business, product, service or activity which is available on the premises where the sign is located.
  15. “Political Sign” means a sign pertaining to any national, state, or local election.
  16. “Portable Sign” means a “Specialty Sign” where specified in the Sign Table under Section 13.35.080, and includes any sign that is not permanently affixed to a building, structure or the ground.
  17. “Projecting Sign” means a “Business Sign” sign that is wholly or partly dependent upon a building for support and which projects more than twelve (12) inches from such building and includes an awning.
  18. “Real Estate Sign” means a “Identification and Information” sign as specified in the Sign Table under Section 13.35.090, and is used to advertise the financing, development, sale, transfer, lease, exchange or rent of real property or properties.
  19. “Roof Sign” means a “Specialty Sign” where specified in the Sign Table under Section 13.35.090 and includes any sign on or above a roof of a building or structure.
  20. “Sign Area” means the sign area of freestanding and low profile signs shall be calculated as follows:
    1. A line shall be drawn horizontally across the lowest point of copy or cabinet. The area below this is considered the base and will not be included as sign area. Above the base, lines shall be drawn across the top and bottom of each area of individual copy, continuous message or cabinets. These lines shall extend to the edge of the sign on monoliths and to the poles or pole covers on other types of signs. The area within these lines shall be included in the sign area calculation.  If blank areas or air spaces between the copy or cabinet are less than six (6) inches then these areas shall also be included in the sign area calculation. Irregular spaces shall be measured at the median point. Any area above the highest point of copy or cabinet shall be considered a topper since it is not required for the support or any copy.
    2. The sign area calculation shall not include any portion of a topper as long as the portion of a topper does not exceed 25% of the total allowable sign area.
    3. For all signs other than freestanding and low profile signs, the sign area shall include the entire face of the sign, frame, and art work incidental to its decoration and shall include any spacing between letters, figures, and designs but shall not include the bracing or structure. When the sign consists only of letters, designs, or figures, the total area of the sign shall be calculated by using no more than two standard geometric figures within which all of the fixed lettering, spacing between letters, and/or artwork is inscribed.
    4. Standard geometric figures include the square, rectangle, triangle, circle, and half circle.
    5. Proper font tails lower case letters will not be included in the sign area calculation.  Customized or extended mils are included.
    6. All sides of a sign which are visible from any one vantage point shall be measured in determining the area of a sign, except that only one side of a sign shall be measured if the two (2) sides are back to back or separated by an angle or forty-five (45) degrees or less.  If the two (2) sides arc not of equal size, the larger side shall be measured. A back-to-back sign shall have parallel and mirror image faces (same face on both sides), separated by not more than four (4) feet.
  21. “Sign Plan” means a site plan shall showing the following information:
    1. Building locations and dimensions.
    2. Sign color schemes.
    3. Size, location, and type of any existing sign and all proposed sign(s).
    4. Nearest street intersections.
    5. Zoning.
    6. Name of applicant and the sign installer.
    7. Show evidence that corner visibility triangle requirements are met.
  22. “Temporary Sign” means a “Specialty Sign” where specified in the Sign Table under Section 13.35.090, and includes a sign constructed of cloth, canvas, fabric, paint, plywood, or other light material. Temporary signs are limited to be displayed only for a short period of time not to exceed ninety (90) day unless otherwise limited or provided in this Chapter.
  23. “Wall Sign” means a sign that is flat or flush when it is fastened to or painted on a wall or parapet of a building or structure in such a manner that the wall becomes part of the structure or forms the background surface. Such signs cannot project more than twelve (12) inches from such building or structure, or intrude into any setback area.
  24. “Window Signs” means a “Specialty Sign” where specified in the Sign Table under Section 13.35.090. A window sign is considered a “Temporary Sign” and includes a sign that is applied or attached to the exterior or interior of a window or located inside a building within six (6) feet of the interior side of a window and displayed so as to attract attention of persons outside the building. A window sign does not include merchandise or models of products or services incorporated in a window display.

13.35.040 Sign Permit Required

  1. Application and Plan. All sign permit application shall include a sign plan and is approved by the Building Official in conjunction with the Building Permit and is subject to any site plan approval by the Planning Commission under criteria set forth in this Chapter. A sign permit application shall include the following:
    1. Standard building permit application for a sign that includes:
      1. Name, address, and signature of owner of the property where the sign is located and/or applicant.
      2. Street address or location of the property on which the sign is to be located, along with the name and address of the property owner.
    2. Type of sign defined under this Chapter and conformance to this Chapter.
    3. A sign plan with measurements showing the proposed location of the sign along with the locations of all existing signs on the same premise.
    4. Specifications and drawings showing the colors, materials, design, dimensions, structural supports, and electrical components of each sign.
    5. Sign permit application fee. A sign permit fee shall be assessed for each individual proposed sign in an amount specified in the building code.
    6. No Permit. No new permit shall issue on a site where any illegal sign exists on the premises.
  2. Inspection. Upon completion of the installation of a new sign a request shall be made to the Building Official for a final inspection. The request must include the installer’s name, permit number (if permit required) address of installation and type of sign.
  3. Exempt signs: The following types of signs shall not require a sign permit:
    1. Temporary signs.
    2. Identification and Informational Signs.
    3. Political signs.
    4. Property Signs.
    5. Change of copy or message on legal billboards and other legal related signs.
    6. Ideological signs.
    7. Other signs under six (6) square feet in area.

13.35.050 General Provisions

Except as otherwise specifically provided by ordinance, the following provisions apply in all zones and for all signs:

  1. Applicability. This Chapter does not apply to or is limited as follows:
    1. Building decorations that are not an integral part of a sign are not considered signs.
    2. Traffic control devices and related governmental signs.
    3. Flags shall not be subject to this Chapter, except such shall be located on the owner’s private property, not exceed fifty (50) feet in height in any residential zone, and not constitute a public nuisance.
    4. Ideological signs shall not be subject to regulation, except such shall be located on the owner’s private property and not constitute a public nuisance.
    5. Political are not subject to this Chapter, except political signs shall be removed immediately after the election for which such signs are intended, shall be located on the owner’s private property, and shall not constitute a public nuisance.
  2. Federal and State Law. All signs along state highways and interstates must comply with all local, state, and federal regulations including the Federal Highway Beautification Act.
  3. Materials. Sign plans shall include the type of materials. Sign frames shall be predominantly natural colors, muted earth tone materials.
  4. Sign Table. All signs shall comply with the “Sign Table” provided in this Chapter.
  5. Common Development Centers. In Commercial or Manufacturing Zones where there is located multiple lots as part of a single development application the site is deemed a “Common Development Center” and the Business Sign is considered “on-premise” for the purposes of sign location. Allocation of sign space shall be based upon the size of the units in the overall development with the larger uses having the most space and so forth.
  6. Identification. Each sign shall be identified by a label, nameplate or trademark identifying the manufacturer and/or installer of the sign, except those signs, that do not require a sign plan.
  7. Owner Consent. A sign shall not be placed on any property without written consent of the owner or the owner’s authorized agent.
  8. Overhangs. No sign shall extend over a trail, walkway, or sidewalk unless specifically provided in this Chapter.
  9. Public Property and Right-of-Way. Non-governmental signs are prohibited on public property and the public right-of-way, except as an exercise of constitutionally protected free speech.
  10. Prohibited Signs. Unless excepted, the following signs are prohibited.
    1. Animated sign.
    2. Inflatable devices including blimps or balloons used as signs, except in connection with a weekend or single day special event.
    3. Noise producing devices in connection with any sign or for advertising purposes. Such devices include, but are not limited to: audible transmissions or speakers, alarms, bells, whistles, or any other sound or noise making device or instrument.
    4. Signs located, erected, or painted upon any infrastructure, light pole, utility pole, retaining wall, fence, rocks, trees, or any other natural feature.
    5. Signs that may obstruct any door, fire escape, stairway, or any opening intended to provide ingress and egress to or from any building or structure.
    6. Strobe lights.
    7. Signs which advertise activities that are illegal, misleading, or fraudulent under local, state, or federal laws.
    8. Signs on wireless communications towers.
  11. Street Clear Area. No sign shall be permitted in the “clear area” in any direction at an intersection of a streets or at a driveway.
    1. If the sign is placed at the interaction of two streets, the sign must not interfere with the forty (40) foot corner visibility triangle starting at the edge of the public right-of-way as determined by the Building Official.
    2. Signs located near a driveway entrance onto a street shall be setback from any driveway intersection based upon the street classification as follows:
      1. Minor or standard road is a minimum sign setback of fifteen (15) feet.
      2. Collector road is a minimum sign setback of twenty-five (25) feet.
      3. Arterial road is a minimum sign setback of thirty (30) feet.
  12. Non-conforming. A nonconforming sign or sign structure shall be brought into conformity with this Chapter if more than fifty (50) percent of the sign structure and or fifty (50) percent of the value of the nonconforming sign or sign structure is abandoned for at least one (1) year, destroyed, dismantled, reconstructed, relocated, or replaced.

13.35.060 Specific Standards

  1. Conformance. In addition to the regulations set forth in this Chapter, all sign are subject to the standards set forth in local, state, and federal laws.
  2. Freestanding Signs. The Sign Table designated the zones in which freestanding signs are allowed, and it lists their maximum size, maximum number, maximum height, and minimum setbacks in those zones. Only one (1) freestanding sign per business location is allowed.
  3. Low Profile, and Wall Signs:
    1. The Sign Table designates the zones in which low profile, and wall signs are allowed, and it list their maximum size, maximum, numbers, maximum height, and minimum setbacks in those zones. A low profile, wall, must be placed on the side of the building from which it draws its allowed square footage. The total square footage is determined by the length of the exterior wall of the building to be served by the sign. The square footage may be used as wall sign(s),  or on a low profile sign with a corresponding reduction of the wall sign square footage. There shall be no more than one (1) low profile sign per freestanding building.
    2. In the all zones, a low profile sign is allowed at each entrance that indicates the name of the subdivision or development.
    3. Comply with the Section 13.35.050.
  4. Projecting Sign. These signs include an awning or canopy sign and are only allowed in Commercial and Manufacturing Zones. Such signs are in addition to any other sign permitted by this Section. Any awning or canopy sips must meet the following regulations:
    1. Excepting a sidewalk, no projecting sign shall project across any property line or into a setback area. No projecting sign shall be less than 10 feet above the ground or sidewalk.
    2. A maximum of one-half (0.5) square feet of signage for each linear foot of awning or canopy.
    3. The sign or signs must be placed on the side of the awning or canopy from which it draws its allowed square footage, and may not extend above, below or beyond the awning or canopy.
    4. Only one (1) awning sign is permitted per property, unless the property is a corner lot in which case two (2) awning signs are permitted.
    5. Comply with the Section 13.35.050.
  5. Temporary Signs. Temporary signs are regulated as follows:
    1. Applicability. Temporary signs include: construction signs, real estate signs, model signs, political signs, garage sale signs, banners, off-premise open house signs, off-premise development directory signs, temporary window signs, and signs for temporary uses involving retail sales.
    2. Generally. The following general regulations apply to temporary signs:
      1. Temporary signs, unless otherwise restricted in each category, shall be installed for a duration not to exceed the purpose which the temporary sign serves or the length of the special event.
      2. Not obstruct a road or sidewalk, not be located on the public right-of-way, not interfere with the intersection visibility requirements, or not constitute a danger to public safety.
    3. Banners shall:
      1. Not exceed one-half (0.50) square feet of banner space for each linear foot of property line.
      2. Must be placed on the side of the building from which it draws its allowed square footage.
      3. Are allowed for a maximum period of three (3) months per calendar year, and are in addition to any other signage permitted by this Chapter.
      4. Be kept in good repair and remain firmly attached to the ground or building.
    4. Construction Signs. Only one (1) sign shall allowed per lot and shall not be erected until a building permit has been issued. The sign shall be removed within fourteen (14) days after the issuance of a certificate of occupancy.
    5. Real Estate Signs. Shall be erected on private property with the permission of the property owner. Shall not be erected on public property or right-of-way.
    6. Model Site Signs. Such signs shall be use for model homes or buildings as follows:
      1. One (1) sign per model lot not to exceed six (6) square feet.
      2. Two (2) off-site directional signs, not to exceed four (4) square feet that are to be placed no sooner than two (2) hours before opening and be removed one (1) hour after closing.
    7. Garage Sale Signs. One (1) sign not to exceed six (6) square feet.
    8. Temporary Retail. Such uses are allowed a temporary sign up to thirty-two (32) square feet in total area. Temporary retail use signs are to be removed when the use ends. Said signs are to be properly secured, mounted, or anchored into the ground. Flyers or standard page sized price signs for merchandise or items on display is permitted.
    9. Window Signs. Temporary window signs may be placed for a period not to exceed four (4) months per calendar year.

13.35.070 Billboards

Billboards are not permitted in any zone. Any billboard in existence on or before January 1, 2017, may continue if the City has a bona fide permit or documentation of the same. All billboards shall conform to all state and federal regulations. This section does not apply to a billboard along an interstate highway that is owned exclusively by the property owner in a C-3P Zone and used in conjunction with a development project where such billboard shall does not exceed six-hundred (600) square feet in size, seventy (70) feet in height, is at least five-hundred (500) feet from any other billboard, and meets applicable setback requirements of state or federal law. Comply with the Section 13.35.050, as applicable.

13.35.080 Lighting Requirements

1. Illumination. Requirements are as follows:

a. Any illumination is subject to Dark Sky compliance as set forth in Chapter 15.26 unless otherwise provided.

b. Permanent signs may be non-illuminated, illuminated by Dark Sky compliant light fixtures, halo illuminated, reverse lit, or illuminated by external indirect illumination

and comply with the Lighting Zone Map specified in Chapter 15.16.

c. Where required the light source shall be dimmed, shaded, shielded, or directed so that the light intensity or brightness does not adversely affect surrounding, nor adversely

affect safe vision of pedestrians or operators of vehicles in the area of the sign.

d. No sign shall have any reflective surface, except for safety related signs and traffic control devices.


2. LED Standards. LED signs shall be limited to text only and are considered internally illuminated signs. Such signs shall not exceed the lumen output requirements of Chapter

15.16. Any lighting extending beyond the area considered to be the sign area, as defined in this Chapter, shall be treated as Class 3 lighting and shall comply with the lumen limits.


3. Neon. Only small window neon signs are allowed at a business located in any commercial or manufacturing zone, and shall be turned off when the business is closed.


4. Special Events. Lighting for special events, such as spotlight or other lighting that may not conform to Chapter 15.23 for Dark Sky Compliant Outdoor Lighting, is subject to a special permit approved by the City that is valid for not more than ten (10) days per year,


5. Hours of Operation. Lighted signs shall have functioning automatic timers. The Lighting Zone Map determines the hours of operation for sign illumination. Illuminated signs shall turn off as follows: a. 9:00 PM until sunrise if located in Lighting Zone 1. b. 10:00 PM until sunrise if located in Lighting Zones 2. c. 11:00 PM until sunrise in Lighting Zone 3, or the time the business closes, whichever is later.
