13.06 Agricultural

Zone A-1

13.06.010 Purpose And Intent

The purpose of the A-1 Zone is to designate farm areas that are likely to undergo a more intensive urban development, to set up guidelines to continue agricultural pursuits, including the keeping of farm animals, and to direct orderly low-density residential development in a continuing rural environment. A developer must consider Rural Residential Subdivisions as an option on developments of 10 acres or more.

13.06.020 Agricultural Preferred Use

Agriculture is the preferred use in Agricultural Zone A-1. All agriculture operations shall be permitted at any time, including the operation of farm machinery and no agricultural use shall be subject to restriction because it interferes with other uses permitted in the zone.

13.06.030 Permitted Uses

  1. Accessory building or use customarily incidental to any permitted or conditional use.
  2. Agriculture, agricultural experiment station, apiary, aquarium.
  3. Animals or fowl kept for family food production as an accessory use to a primary residential use.
  4. Cemetery.
  5. Residential facility for the elderly, youth, or disabled subject to Chapter 13.08.
  6. Church, synagogue, or similar building used for regular religious worship.
  7. Residential conservation Subdivision as provided in the Subdivision Regulations.
  8. Corral, stable, or building for keeping of animals or fowl, provided such building is located in accordance with Chapter 13.26.090.
  9. Fruit or vegetable stand for produce grown on the premises only.
  10. Golf course, except miniature golf course.
  11. Home occupations - with no visiting clientele.
  12. Household pets and exotic pets as permitted by Title 9.
  13. Parking as an accessory to uses allowed in this zone.
  14. Agriculture in the Community as provided in Chapter 15.01.
  15. Keeping of one (1) horse (private stable) if the pasture area used for the horse is 20,000 square feet or more. One additional horse for each 10,000 square feet of pasture area used for horses.
  16. Public building, public park, recreation grounds and associated buildings, public school, private educational institution having a curriculum similar to that ordinarily given in public schools.
  17. Single-family dwelling.
  18. Temporary buildings or use incidental to construction work. Such buildings shall be removed upon completion or abandonment of the construction work.
  19. Parking of (1) school bus. No on-street parking is permitted of any type of bus.

13.06.040 Permitted Uses Requiring Two (2) Acres Minimum Lot Area

1. Two family dwelling.

13.06.050 Permitted Uses Requiring Five (5) Acres Minimum Lot Area

  1. Dairy farm and milk processing and sale provided at least fifty (50) percent of milk processed and sold is produced on the premises.
  2. Sales, rental, and service (no storage) of new and used motor vehicles, recreational vehicles, appliances and equipment, trailers, camping equipment, cycling shop, hunting and fishing supplies, outdoor outfitting, and recreational supplies on a parcel adjacent to or within 150 feet of the overlay area of the Central Business District.

13.06.060 Conditional Uses

The following uses shall be permitted only when authorized by a Conditional Use Permit obtained as provided in Chapter 13.23 of this Zoning Ordinance:

  1. Animal hospital or clinic, dog breeding, dog kennels, or dog training school, on a minimum of two (2) acres and not exceeding 10 dogs of more than 10 weeks old, per acre, at any time, provided any building or enclosure for animals shall be detached from any structure used for residential purposes, be located not less than one hundred (100) feet from a public street, and be located not less than fifty (50) feet from any side or rear property line. Additionally, the requirements of Chapter 13.26 must also be followed.
  2. Child day care, or preschool limited to a maximum eight (8) children.
  3. Seasonal amusement.
  4. Greenhouse, sod farm, or nursery including sales and accessory uses for the same.
  5. Home occupations - with visiting clientele.
  6. Private park, playground, or recreation grounds including accessory buildings.
  7. Private equestrian training and stable facilities on a minimum of five (5) acres of land and at a density of not more than six (6) horses per acre.
  8. Public utility substation.
  9. Commercial raising, harvesting, processing, dressing and marketing of chickens, turkeys, or other fowl, rabbits, fish, frogs, or beaver on farms having a minimum area of five (5) acres.
  10. On a minimum of two (2) acres, where the owner is a permanent resident, the following may be parked: a. One (1) vehicle not more than twenty-four thousand (24,000) pounds gross vehicle weight, including one (1) associated trailer. b. Two (2) light construction vehicles (example: skidsteer, mini excavator, or similar equipment).
  11. Wastewater treatment or disposal facilities meeting the requirements of the Utah State Division of Health Code of Waste Water Regulations.

13.06.070 Site Development Standards

  1. Minimum lot area - 40,000 square feet, except permitted uses requiring 2 & 5 acres minimum in which case the minimum lot area is 2 & 5 acres. Notwithstanding requirement of 40,000 square feet minimum, if requirements of 14.11 are met, a site may be developed according to Chapter 13.03.
  2. Minimum lot width - 150 feet.
  3. Minimum yard setbacks
    1. Front - 30 feet
    2. Side
      1. dwelling: 10 feet with total width of two side yards not less than 24 feet.
      2. other main building: 20 feet on each side.
      3. accessory building: 10 feet except one (1) foot if located at least six (6) feet in rear yard of main building.
    3. Side facing street on corner lot: 30 feet.
    4. Rear
      1. main building: 30 feet
      2. accessory building: One (1) foot except ten (10) feet where accessory building rears on side yard of adjacent corner lot.

13.06.080 Sign Regulations

The height, size, and location of all signs shall be in accordance with the regulations set forth in Chapter 13.35 of this Zoning Ordinance.
