13.05 Residential

Estates Zone

13.05.010 Purpose And Intent

The major purpose of the RE-15 and RE-20 Zones is to provide and protect residential development at a medium density in a semi-agricultural or rural environment. It is also to provide for certain rural amenities on larger minimum lots, in conjunction with the primary residential nature of the zone. A developer must consider Rural Residential Subdivisions as an option on developments of 10 acres or more. (Ord. 2002-06).

13.05.020 Permitted Uses

  1. Accessory building or use customarily incidental to permitted or conditional use.
  2. Agricultural and agricultural experiment station.
  3. Animals and fowl, on parcels at least 20,000 square feet or more, may be kept for family food production as an incidental and accessory use to the residential use of the lot.
  4. Church, synagogue or similar building used for regular religious worship.
  5. Rural Residential Subdivision, in accordance with Chapter 13.22.
  6. Corral, stable, or building for keeping of animals or fowl, provided such building is located in accordance with Chapter 13.26.090.
  7. Golf course, except miniature golf.
  8. Greenhouse and nursery limited to sale of material produced on premises and with no retail shop operation.
  9. Home occupations with no visiting clientele.
  10. House pets and exotic pets as permitted by Title 9-1-9.
  11. Parking lot accessory to use permitted in this zone.
  12. Keeping of one (1) horse (private stable) if the pasture area used for the horse is 20,000 square feet or more. One additional horse for each 10,000 square feet of pasture area used for horses.
  13. Public building, public park, recreation grounds and associated buildings, public schools, private educational institutions having a curriculum similar to that ordinarily given in public schools.
  14. Single family dwelling.
  15. Temporary building or use incidental to construction work. Such building shall be removed upon the completion or abandonment of the construction work.
  16. On lots with minimum area of 20,000 square feet, school bus parking, provided the vehicle is parked at least 30 feet from a public street.

13.05.030 Permitted Uses Requiring Five Acres Minimum Lot Area

  1. Farms devoted to the hatching, raising, including fattening as incident to raising, of chickens, turkeys, or other fowl, rabbit, fish, frogs or beaver hatched or raised on the premises.
  2. Raising and grazing of horses, cattle, sheep or goats, including the supplementary feeding of such animals, provided that such raising or grazing is not a part of, nor conducted in conjunction with any livestock feed yard, livestock stales yard, slaughterhouse, animal by-products business or commercial riding academy.

13.05.040 Conditional Uses

The following uses shall be permitted only when authorized by a Conditional Use Permit as provided in Chapter 13.23 of this Zoning Ordinance:

  1. Childcare or nursery.
  2. Home occupations with visiting clientele.
  3. Private park, playground or recreation grounds and buildings not open to the general public and to which no admission is made but not including privately owned commercial amusement business.
  4. Repealed.
  5. Public utility station.
  6. Residential facility for persons with a disability meeting the requirements of Chapter 13.8 of this Zoning Ordinance.
  7. Residential facility for elderly persons meeting the requirements of Chapter 13.8 of this Zoning Ordinance.

13.05.050 Site Development Standards

  1. Minimum lot area
    1. For uses listed in 13.05.020 and 13.05.040 - 15,000 sq. ft. for RE-15 or 20,000 sq. ft. for RE-20 if connected to an approved public sewer system, or 40,000 sq. ft. in both zones if connected to an individual septic tank and drain field.
    2. For uses listed in 13.05.030 - Five Acres.
  2. Minimum lot width - 100 feet if connected to an approved public sewer system or 150 feet if connected to an individual septic tank and drain field.
  3. Minimum yard setbacks.
    1. Front - 30 feet.
    2. Side.
      1. dwelling: 10 feet with total width of two side yards not less than 24 feet.
      2. other main building: 20 feet on each side.
      3. accessory building: 10 feet except one (1) foot if located at least six (6) feet in rear yard of main building.
    3. Side facing street on corner lot - 30 feet.
    4. Rear.
      1. main building - 30 feet.
      2. accessory building - One (1) foot except ten (10) feet where accessory building rears on side yard of adjacent corner lot.
  4. Building height.
    1. Minimum - one story.
    2. Maximum - 2 ½ stories or 35 feet.

13.05.060 Sign Regulations

The height, size, and location of all signs shall be in accordance with the regulations set forth in Chapter 13.35 of this Zoning Ordinance.
