CHAPTER 1

TITLE, PURPOSE AND INTERPRETATION

11-1-1: TITLE:

This title shall be known as the ZONING ORDINANCE OF THE VILLAGE OF MILAN, ILLINOIS. (Ord. 1301, 3-15-2004)

11-1-2: OBJECTIVES:

The zoning regulations and districts as herein established have been made with the following objectives:
   A.   The assurance that adequate light, air and safety from fire and other dangers may be conserved;
   B.   That traffic congestion be lessened or avoided; and
   C.   That public health, safety, comfort, morals, and welfare might otherwise be promoted. (Ord. 1301, 3-15-2004)

11-1-3: INTERPRETATION:

   A.   The provisions of this title shall be minimum requirements, adopted for the promotion of the public health, safety, convenience, comfort, prosperity and general welfare. Where this title imposes greater restrictions upon the use of buildings or other structures, or law or ordinance, the provisions of this title shall prevail.
   B.   Implementation of building codes and regulations shall apply based upon the use of the property rather than the zoning designation of said property. Application of these codes will prevail unless superseded by the provisions of this title. (Ord. 1301, 3-15-2004)

11-1-4: VALIDITY:

Should any section, subsection, clause or provision of this title be declared by the courts to be invalid, the same shall not affect the validity of this title as a whole or any part thereof, other than that which is so declared to be invalid. (Ord. 1301, 3-15-2004; amd. 2011 Code)
