TITLE, PURPOSE, COMMUNITY DEVELOPMENT OBJECTIVE, MISCELLANEOUS LEGAL PROVISIONS
§ 27-101 Title.

This chapter shall be known and may be cited as the "Morton Borough Zoning Ordinance."
§ 27-102 Purpose.

1.
To promote, protect, and facilitate the public health, safety, and welfare; coordinated and practical community development; proper density of population; the provision of adequate light and air, police protection, vehicle parking and loading space, transportation, water, sewerage, schools, public grounds, and other public requirements.
2.
To prevent the overcrowding of land; blight; danger and congestion in travel and transportation; loss of health, life, or property from fire, flood, panic, or other dangers.
§ 27-103 Statement of Community Development Objective.

A statement of goals and objectives concerning the future of the Borough relative to the issues of land use, municipal services and transportation is contained in the Morton Borough Comprehensive Plan.
§ 27-104 Miscellaneous Legal Provisions.

Application. The provisions of this chapter shall apply to all buildings, structures, uses, land and all accessory buildings, structures and uses. Nothing in this chapter shall require any change in plans or construction of a use for which a building permit has been heretofore issued prior to the effective date of this chapter.

Interpretation of Chapter Provisions.
A.
In interpreting the language of this chapter to determine the extent of the restriction upon the use of the property, the language shall be interpreted, where doubt exists as to the intended meaning of the language written and enacted by the Borough Council, in favor the property owner and against any implied extension of the restriction.
B.
The provisions of this chapter shall be held to be the minimum requirements for the promotion of the health, safety, and general welfare of the Borough. It is not intended to interfere with, abrogate, annul or cancel other rules, regulations, ordinances, covenants or restrictions except where this chapter imposes greater restrictions, in which case, the provisions of this chapter shall apply.

Severability. Should any section or provision of this chapter be declared by a Court of competent jurisdiction to be invalid, such decision shall not affect the validity of this chapter as a whole, or of any other part thereof.

Amendment. The Borough Council may, from time to time, amend, supplement, change, modify or repeal this chapter including the Zoning Map, in accordance with the provisions of the Pennsylvania Municipalities Planning Code, 53 P.S. § 10101 et seq.
5.
All ordinances or parts of ordinances inconsistent herewith are hereby revoked and all prior existing zoning regulations are hereby repealed.
6.
Enactment. This chapter shall become effective on April 12, 1995, and shall remain in force until modified, amended or rescinded by the Council of the Borough of Morton, Delaware County, Pennsylvania.
