GC GENERAL COMMERCIAL

§ 27-1001 Intent.

To provide for the development of certain areas for a broad variety of retail and service commercial establishments and activities serving a broader clientele.

§ 27-1002 Uses by Right.

1. 
The following are the permitted uses of land and buildings in the GC District:
A. 
Uses permitted by right in the NC District.
B. 
Retail stores or businesses.
C. 
Office buildings.
D. 
Office or shop for a contractor or craftsman (plumber, carpenter, electrician, printer, etc.).
E. 
Greenhouse or plant nursery.
F. 
Automobile sales and/or service establishments; provided, that all repair, lubrication and other similar facilities shall be completely enclosed within a building.
G. 
Restaurants (including drive-in establishments).
H. 
Indoor amusements, recreation, or entertainment.
I. 
Funeral parlors.
J. 
Accessory buildings and customarily incidental to the above when located on the same lot.
K. 
Uses which, in the opinion of Borough Council, are of the same general character as the above uses, and which will not be detrimental to the intended purposes of this chapter.

§ 27-1003 Uses by Special Exception.

1. 
The following uses are permitted by special exception granted by the Zoning Hearing Board:
A. 
Warehouse, storage, or wholesaling within a completely enclosed building.
B. 
Vocational or business school.
C. 
Adult motion picture theaters, adult mini-motion picture theaters, adult cabarets, and adult book stores.
(1) 
Any of the above uses shall not be located within a seventy-five-foot radius of a residential zoning district.
(2) 
Any of the above uses shall not be located within two-hundred-fifty-foot radius of any churches or public or private educational institutions.
(3) 
Any of the above uses shall not be located within seventy-five-foot radius of two other such uses except that such restrictions may be waived by the Zoning Hearing Board if it is found:
(a) 
The proposed use will not be contrary to the public interest or injurious to nearby properties and that the spirit and intent of this chapter will be observed.
(b) 
The proposed use will not enlarge or encourage the development of a "skid row" area.
(c) 
The establishment of an additional use of this type in the area will not be contrary to any program of neighborhood conservation or improvement, either residential or nonresidential.
(d) 
All applicable regulations of this chapter will be observed.
(4) 
Signs.
(a) 
Advertisements, displays and other promotional materials shall not be shown or exhibited so as to be visible to the public from pedestrian sidewalks or walkways or from other areas public or semi-public; and such displays shall be considered as signs.
(b) 
All building openings, entries, windows, etc., for adult motion picture theaters and adult mini-motion picture theaters shall be located, covered or screened in such a manner as to prevent a view into the interior of any public or semi-public area.
D. 
Uses which, in the opinion of Borough Council, are of the same general character as the above uses, and which will not be detrimental to the intended purposes of this chapter.

§ 27-1004 Lot Requirements.

1. 
Minimum lot area: 10,000 square feet.
2. 
Minimum lot width: 100 feet at the BSL.
3. 
Maximum lot coverage: no more than 60% of any lot shall be covered by buildings, and not more than 75% shall be covered by buildings and other impervious surfaces.

§ 27-1005 Building Setback Requirements.

1. 
Minimum setback distance from a street right-of-way: 25 feet.
2. 
Minimum side yard setbacks: two side yards, each having a minimum width of 10 feet, except that where a side lot abuts a residential district, a side yard of at least 20 feet in width shall be provided.
3. 
Minimum rear yard setback: 25 feet.

§ 27-1006 Maximum Building Height.

No building height shall exceed 35 feet or three stories in height, whichever is lesser.
