R-1 LOW DENSITY RESIDENTIAL

§ 27-401 Intent.

To provide for, and encourage, comparatively low-density residential development in those areas of the Borough best suited for such development because of existing land use patterns and the Borough's community development objectives.

§ 27-402 Uses by Right.

1. 
The following are the permitted uses of land and buildings of the R-1 district:
A. 
Single-family detached dwellings.
B. 
Professional office use-a professional office for the personal use of a physician, lawyer, dentist, or professional practitioner of a character similar to any of the foregoing, but specifically excluding funeral homes, realty offices, insurance offices, and similar practitioners which are provided for in the E-Business District, provided that the office is located within the residence of the professional person, and provided that the office is located within the residence of the professional person, and, provided further, that no goods are displayed nor professional identified other than by the display of a sign not to exceed 216 square inches in area with the name and profession of the person using the office, which sign shall be placed in a location approved and permitted by the Code Enforcement Officer, and, further provided, that no space is rented out or devoted to the use of other than the owner or tenant of said premises and not more than three assistants are therein employed and the essential character of the building as a residence is maintained.
C. 
Public parks, playgrounds.
D. 
Municipal uses.
E. 
Parking in accordance with Part 14, provided that no private driveway or off-street parking areas shall be used for the storage or parking of any commercial vehicle, non-passenger vehicle or truck in excess of one ton, except in such cases when construction or other work is being done on the premises and the parking or storage is of a temporary nature (for the purposes of this section "storage or parking" shall be defined as the leaving of such vehicle or truck unattended for a period in excess of two hours).
F. 
Signs in accordance with Part 15.
G. 
Accessory buildings customarily incidental of the above permitted uses, when located on the same lot.

§ 27-403 Uses by Special Exception.

1. 
The following uses are permitted only by special exception granted by the Zoning Hearing Board:
A. 
Home occupations-in accordance with § 27-1505.
B. 
Educational, religious and philanthropic institutions.
C. 
Residential day care centers in accordance with § 27-1522.
2. 
Uses which, in the opinion of the Borough Council are of the same general character as the above uses, and which will not be detrimental to the intended purposes of this chapter.

§ 27-404 Lot Requirements.

1. 
Minimum lot area: 9,000 square feet.
2. 
Minimum lot width: 65 feet at the building setback line.
3. 
Maximum lot coverage: no more than 25% of any lot shall be covered by buildings, and not more than 35% of any lot shall be covered by buildings and other impervious surfaces.
4. 
Uses by Special Exception. The area and bulk regulations for uses by special exceptions shall be established after analyzing the particular use which is proposed. In determining such regulations, the following shall be considered:
A. 
The nature and use and related activities conducted therewith in particular, the space needs or requirements of such uses and activities.
B. 
The area and bulk regulations set forth in this chapter for uses which are similar to those proposed in no case less than those set forth above.
C. 
Recognized space standards published in professional planning and design literature for architects, engineers and allied professions for educational or religious structures and uses.
D. 
The area required for off-street parking.

§ 27-405 Building Setback Requirements.

1. 
Minimum setback distance from a street right-of-way: 35 feet.
2. 
Minimum side yard setbacks: a total of 25 feet where two side yards are involved, with neither side yard being less than 10 feet.
3. 
Minimum rear yard setback: 25 feet.

§ 27-406 Maximum Building Height.

No principal building shall exceed 35 feet or three stories in height, whichever is lesser.
