13 LAND DEDICATIONS AND IMPACT FEES

12-13-1: LAND DEDICATION REQUIREMENTS FOR PARKS AND OTHER PUBLIC AREAS

  1. Required Dedications: Where a proposed public park or playground and other public use area, as determined by the plan commission and the Village board of trustees, is located in whole or in part within a subdivision or planned unit development, the applicant shall make available such lands to the Village.
    1. The total dedication (exclusive of public streets, alleys, and pedestrianways) shall not exceed ten percent (10%) of the total gross acreage owned or controlled by the subdivider.
    2. Where an area that is specifically designated by the Village board of trustees for a public park or playground and other public use exceeds the area equivalent to ten percent (10%) of the area of the total acreage owned by the subdivider, the entire area shall be reserved for such use on all subdivision plans and plats, and the acquisition of such additional area shall then be secured by the Village, or arrangements made for its acquisition within a period not to exceed three (3) years from the date of approval of the preliminary plat. The value of the subject land shall be established by three (3) qualified appraisers, one of whom shall be appointed by the Village, one by the subdivider, and one of whom shall be mutually agreed upon by the other two (2).
    3. Where less than ten percent (10%) of the total gross area being subdivided is proposed for public parks, playgrounds or other public use area, as designated by the plan commission and Village board of trustees, the subdivider shall dedicate such area that is less than ten percent (10%) and, in addition, pay to the Village a sum of money, so that either or both the dedication and the payment equal ten percent (10%) of the appraised value of the land before it is subdivided.
    4. In the event there are no public open spaces required by the plan commission and the Village board of trustees, but anticipated improvement or expansion of existing public facilities is required, the entire sum of money equal to the appraised value of land comprising an area equivalent to ten percent (10%) of the total area of the tract, shall be paid by the owner or subdivider to the Village. Sums of money so received by the Village shall be placed in a special fund to be known as the public land purchase and improvement fund, and allocated by the Village board of trustees solely for purchase of land and/or improvement of either newly purchased land or existing land for public parks or playgrounds and other public use.
  2. Exceptions:
    1. Minor subdivisions shall be exempt from land or fee dedication for parks and other public areas.
    2. Where plans do not exist for new or improvement of existing recreational or public facilities in the area where the subdivision is located, the plan commission may recommend waiving the land dedication requirement, subject to approval from the board of trustees. (Ord. 07-07, 3-26-2007)
