The title shall be "An Ordinance Limiting and Restricting to Specific Districts and Regulating Therein Buildings and Structures According to Their Construction and the Nature and Extent of Their Use and the Nature and Extent of the Use of Land, Regulating and Determining the Area of Yards and Other Open Spaces Surrounding Buildings, Regulating and Limiting the Density of Population and for Said Purposes Dividing the Township into Districts and Prescribing the Penalties for the Violating of Its Provisions."

This Part 3 shall be known as the "Zoning Ordinance of the Township of Mount Holly."

In their interpretation and application, the provisions of this Part 3 shall be held to be minimum requirements adopted for the promotion of public health, safety, morals and general welfare. Among other purposes, the provisions of this Part 3 are intended to provide for adequate light, air and convenience of access, to lessen congestion in the streets, to secure safety from fire and other dangers, to avoid undue concentration of population by regulating and limiting the use of land and the height and bulk of buildings wherever erected, to limit and determine the size of yards and other open spaces, to regulate the density of population, to encourage the most appropriate use of land through the Township of Mount Holly, to ensure that development in Mount Holly does not conflict with the general welfare of neighboring communities and to encourage the appropriate and efficient expenditure of public funds by the coordination of public and private development.

It is not intended by this Part 3 to repeal, abrogate, annul or in any way impair or interfere with existing provisions of other laws or ordinances, except those specifically or impliedly repealed by this Part 3 or any private restrictions placed upon property by covenant, deed or other private agreement unless repugnant hereto. Where this Part 3 imposes a greater restriction upon the use of buildings or premises or upon the height of buildings or lot coverage or requires greater lot area or larger yards or other open spaces than are imposed or required by such existing provisions of law or ordinance or by such rules, regulations, or permits or by such private restrictions, the provisions of this Part 3 shall control.

No commercial use, other than office operations without overnight deliveries or customer traffic, may operate in the B-1, MRV, or any residential zone of the Township after 11:00 p.m. or earlier than 6:00 a.m. within 500 feet of any residential use as measured from the boundary of the property on which the commercial use is located to the boundary of property on which the residential use is located. Restaurants and licensed premises primarily serving food may, nevertheless, remain open as stated in Chapter 68, Article II, § 68-8, Hours of sale. The Township Manager may relax the 11:00 p.m. closing hour during special events, community festivals, celebrations, and the like. Such extension of hours shall be publicly announced at least 72 hours prior to the event. In no event shall such an extension permit a commercial use covered by this section to allow operation between the hours of 1:00 a.m. and 6:00 a.m.
