ARTICLE XXI

B-3 Planned Shopping District

§ 149-116 Permitted uses.

A. 
This zone district is designed for a building or a group of buildings used exclusively for retail sales and service. Before the issuance of a building or occupancy permit, the Planning Board shall ascertain that all of the following requirements are complied with.
B. 
Any business operating as a cannabis retailer or cannabis delivery service licensed under N.J.S.A. 24:6I-31 et seq. shall be expressly permitted within this zone.

§ 149-117 Prohibited uses.

No building or structure shall be erected or converted which is intended or designed to be used in whole or in part for any industry, manufacturer or residence. Also prohibited in this district are public garages or gasoline filling stations and any use prohibited in the General Business District.

§ 149-118 Maximum height; required yards.

The following requirements must be complied with in the Planned Shopping District:
A. 
Height. No building shall exceed a maximum of two stories or 28 feet, whichever is the lesser.
B. 
Front yard. There shall be a front yard of not less than 150 feet. No parking area shall be nearer than 20 feet to any property line nor 10 feet to any building.
C. 
Side yards. There shall be two side yards and each side yard shall be not less than 150 feet. No parking area shall be nearer than 20 feet to any property line nor 10 feet to any building.
D. 
Rear yard. There shall be a rear yard of 150 feet. No parking area shall be nearer than 20 feet to any property line.

§ 149-119 Design requirements.

The following requirements shall be in addition to those in Articles XI and XII.
A. 
Landscaping.
(1) 
Along each property line, a buffer area, not to be used for parking, shall be attractively planted with trees, shrubs, plants and grass lawns. Along the rear and side lines such buffer areas shall be at least 50 feet wide, and along the front line such buffer areas shall be 20 feet wide. All buffer areas shall be so designed so as not to interfere with adequate vision for pedestrians and motor vehicles entering and leaving the shopping area. Special plantings shall be provided throughout all buffer areas so that parking areas are not visible from adjacent residential property.
(2) 
Throughout the shopping center, there shall be installed and maintained areas of planting and grass lawns adjacent to sidewalks and pedestrianways which are required by Subsection B of this section.
(3) 
Plantings shall be installed in conjunction with screening required in Subsection A(1) of this section.
B. 
Traffic circulation.
(1) 
The shopping center site shall not be divided by any street.
(2) 
Direct ingress or egress shall be prohibited within 200 feet of any intersection.
(3) 
Pedestrian walks of not less than six feet between the parking areas and the stores shall be provided.
(4) 
Traffic movements through the parking area shall be organized and guided, by directional signs, lane markings and dividers so as to assure maximum safety.
(5) 
Adequate provision shall be made to assure safe pedestrian movement to and through the parking area. Sidewalks shall be provided wherever necessary.
C. 
Nuisances. No store or shop in the district shall use any noise-making devices, such as phonographs, loudspeakers, amplifiers, radios, television sets or similar devices, so situated as to be heard outside any building in the district. A public address system is permitted if operated by the management of the shopping center, provided that the sound is not audible in any residential district. No smoke, fumes or objectionable colors shall be emitted from any building. The display of merchandise on the exterior premises of any building is prohibited. All trash, garbage and debris of every kind shall be stored indoors until such time as they are collected for disposal. No sign shall be illuminated beyond the hours of operation of the use to which it pertains.
