CHAPTER 9

NONCONFORMING USES AND STRUCTURES

10-9-1: NONCONFORMING STRUCTURES:

   A.   Maintenance Permitted: A nonconforming structure lawfully existing on the effective date hereof may be maintained except as otherwise provided in this title.
   B.   Enlargement; Alteration: A nonconforming structure may not be enlarged or structurally altered to an extent greater than fifty percent (50%) of the square footage of ground area occupied by said structure. Such addition shall conform to the use, height, yard and area requirements of the district in which it is located.
   C.   Rebuilding: A nonconforming structure damaged by fire or other act of God to an extent the owner feels is unrepairable may be replaced by a similar new structure which shall not occupy, in square feet of ground area, an area greater by fifty percent (50%) than the square footage of ground area occupied by the destroyed or dismantled building. 10-9-2: NONCONFORMING USES:

   A.   A nonconforming use lawfully existing on the effective date hereof may be continued.
   B.   A nonconforming use may be changed only to a use of the same or more restrictive classification.
   C.   A nonconforming use shall not be reestablished if discontinued for a period of six (6) months or the property is sold. (Ord., 8-24-1974)
