The purpose of this chapter is to provide for and regulate the location and safe construction of wind powered generators in the city of Nauvoo. This will ensure the conservation of energy and promotion of safety and security. (Ord. 2007-4, 5-31-2007)
10-6A-2: APPLICABILITY:
This chapter will be applicable to all existing zoning areas and will apply to all real estate under the jurisdiction of the city of Nauvoo and the city's zoning ordinance. (Ord. 2007-4, 5-31-2007)
10-6A-3: CONSTRUCTION:
All wind powered generators shall be constructed and operated under the following conditions:
A. All wind powered generators shall be constructed to the acceptable industry standards.
B. No wind powered generators shall exceed a maximum height of forty five feet (45') including the highest point that the blade can reach and blades shall reach no lower than twenty five feet (25') from the highest point of ground level.
C. All setbacks must be met for each zoning area. This shall include any and all components used in constructing the tower and any stabilizing wires or supports.
D. All towers and supports shall be secured from any and all unauthorized persons to prevent playing on or climbing towers or supports.
E. A building permit shall be required and shall be reviewed by the city council even if the proposed construction cost is less than the amount required to be approved by the city council.
F. The city council may make adjustments in each building permit as it deems necessary for the safety and security of the citizens of Nauvoo and the aesthetic and historical features of the area. The city council shall have the absolute right to deny a building permit for a wind powered generator if the city council believes it is in the best interest of the city and the area where the proposed wind generator is to be constructed.
