ARTICLE XI

- M-2 HEAVY INDUSTRIAL DISTRICT

Sec. 37-37. - Use regulations.

(a)

In district M-2, no building, structure, land or premises shall be used and no building or structure shall be erected, constructed, reconstructed, moved or altered after June 15, 1965, except for one or more of the following uses:

(1)

Any use permitted in district M-1.

(2)

Ammonia, bleaching powder or chemical plants.

(3)

Asphalt and concrete mixing plants.

(4)

Assaying works (other than gold or silver).

(5)

Blooming or rolling mills.

(6)

Breweries or distilleries.

(7)

Chemical laboratories.

(8)

Cider mills.

(9)

Coal car dumps.

(10)

Coal distillation and by-products plants.

(11)

Coal hoists, pockets or treaties.

(12)

Coke ovens.

(13)

Cooperage works and stave mills.

(14)

Cotton ginning or bailing works.

(15)

Dog kennels (commercial).

(16)

Dog pounds.

(17)

Enameling works.

(18)

Electric power plants.

(19)

Electroplating.

(20)

Forges.

(21)

Foundries (iron, brass, bronze, aluminum).

(22)

Hides and skins (storage, curing or tanning).

(23)

Japanning works.

(24)

Lumber mills.

(25)

Machine shops.

(26)

Manufacturing of such products as: adding machines, cash registers, typewriters, alcohol, asphalt, basket material, boats, boilers, boxes, bronze, burial vaults, cans, carbon batteries, electric lamps, carbon or lamp black, celluloid or plastic materials, petro-chemicals, clay, shale and glass products, creosote, cutlery, or tools, disinfectants, insecticides, dyes, electrical machinery, engines, furniture, glass, iron and steel, locomotives, motor cars, bicycles, airplanes, pumps, nuts, bolts, screws, etc., oil cloth, linoleum, paint, lacquer, oil, turpentine, varnish, enamel, etc., railway cars, rubber, synthetic rubber, rubber products, soap, starch, glucose, dextrin, tar products, tools, vinegar or beverages.

Metal stamping, shearing, punching works, etc.

(28)

Monument or marble works.

(29)

Planing mills.

(30)

Plumbing and sheet metal shops.

(31)

Railroad roundhouses or shops.

(32)

Salt works.

(33)

Salvage or junk yards, by special use permit only; provided that such yards shall be completely enclosed and effectively screened by a solid fence or wall at least eight feet high.

(34)

Steel furnaces.

(35)

Stone cutting.

(36)

Structural iron or pipe works.

(37)

Sugar refineries.

(38)

Tar distillation or manufacture.

(39)

Wire or rod mills.

(40)

Wood distillation plants (charcoal, tar, turpentine, etc.).

(41)

Wool scouring works.

(42)

Accessory uses customarily incident to any of the above uses, including signs, as provided in section 37-7.

(43)

Insulation manufacturing plant.

(44)

Storage yards for storage of new and used tires.

(45)

Medical marijuana cultivation facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana cultivation facility applies for a zoning permit.

Medical marijuana-infused products manufacturing facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana-infused products manufacturing facility applies for a zoning permit.

(47)

Medical marijuana testing facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana testing facility applies for a zoning permit.

(48)

Medical marijuana transportation facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana transportation facility applies for a zoning permit.

(b)

The following additional uses may be permitted after the location of such uses have been approved by the city council, after report by the chief of the fire department and planning commission:

(1)

Acid manufacture.

(2)

Cement, lime, gypsum or plaster of Paris manufacture.

(3)

Distillation of bones.

(4)

Explosives manufacture or storage.

(5)

Fat rendering.

(6)

Fertilizer manufacture.

(7)

Garbage, offal or dead animals, reduction or dumping.

(8)

Glue manufacture.

(9)

Petroleum, or its products, refining of.

(10)

Smelting of tin, copper, zinc or iron ores.

(11)

Stockyards or slaughter of animals.

(12)

Wholesale storage of gasoline or LP gas.

Sec. 37-38. - Performance standards.

(a)

No use shall be permitted or operated that produce vibration, concussion, dirt, fly ash, odor, noxious gases, heat and glare perceptible at any point along the district boundary line.

(b)

No use shall be permitted or operated that produces a noise level greater than that noise level produced by the average traffic in the area.

(c)

No use shall be permitted or operated that produces smoke, or particulate matter with a density of greater than three measured by the Ringelmann Chart, published and used by the United States Bureau of Mines, for a period not exceeding six minutes in any one hour.

Sec. 37-39. - Height and area regulations.

In district M-2, the height of building and the minimum dimensions of lots and yards shall be as follows:

(a)

Height. Same as district M-1.

(b)

Front yards. Same as district M-1.

(c)

Side yards. Same as district C-1.

(d)

Rear yards. Same as district C-1.

(e)

Width of lot. No minimum.

(f)

Parking regulations. See section 37-7.
