ARTICLE VII

- C-2 GENERAL BUSINESS DISTRICT

Sec. 37-25. - Use regulations.

In district C-2, no building, structure, land or premises shall be used, and no building or structure shall be erected, constructed, reconstructed, moved or altered after June 15, 1965, except for one or more of the following uses:

(a)

Any use permitted in district C-1.

(b)

Armories or assembly halls.

(c)

Automobile parking lots.

(d)

Automobile sales rooms and used car lots including repair facilities when appurtenant to such sales activity.

(e)

Bakeries.

(f)

Bicycle repair shops, electric appliance and fix-it shops.

(g)

Bus passenger station.

(h)

Repealed by Ord. No. 3005.

(i)

Drive-in restaurants, ice cream shops, refreshment stands, etc., where persons are served in automobiles.

(j)

Dry cleaning establishments and laundries employing not more than five persons on the premises and using nonexplosive cleaning fluids.

(k)

Electrical appliance sales and repair.

(l)

Filling stations; provided that all gasoline storage tanks are located below the surface of the ground.

(m)

Greenhouses, commercial.

(n)

Hospitals for small animals if within an enclosed building.

(o)

Ice delivery stations for storage and sale of ice at retail only.

(p)

Newsstands.

(q)

Printing and publishing plants, including bookbinding.

(r)

Radio and television broadcasting stations and studios, except towers.

(s)

Seed stores.

(t)

Shops for custom work, or manufacture of articles to be sold at retail only, on the premises; provided that in such manufacture the space occupied by the manufacturing permitted herein shall not exceed 50 percent of the total floor area of the entire building; and further provided that such manufacturing use does not emit any vibrations, noise, odor, dust, noxious gas, smoke, particulate matter, glare or heat detectable outside of the building.

(u)

Storage garages for automobiles.

(v)

Storage in bulk of, or warehouse for, such materials as are incidental to sale at retail on the premises except stores for retail sales described in section 37-25(28).

(w)

Stores, shops and markets for retail trades; provided that merchandise is not displayed, stored or offered for sale on the premises outside of a building within a required front yard.

(x)

Swimming pools, commercial.

(y)

Theaters (indoor).

(z)

Upholstery shops.

(aa)

Accessory uses customarily incident to any of the above uses, including signs, as provided in chapter 29 and shops for retail sales of merchandise, some of which is permitted under use regulations for this zone, and some of which is not; provided that sales of items not permitted in this zone shall be contracted in the city, and delivered from warehouse or storage areas not in violation of applicable zoning codes; and no bulk storage of nonpermitted items shall be made in the zone where the sales contracting office is located.

Sec. 37-26. - Height and area regulations.

In district C-2, the height of buildings, the minimum dimensions of lots and yards, and the minimum lot area per family permitted upon any lot shall be as follows; provided that buildings erected for dwelling purposes exclusively shall comply with the front, side and rear yard requirements of district R-1:

(a)

Height. Buildings or structures shall not exceed 120 feet and shall not exceed ten stories in height.

(b)

Front yard. No front yard is required; except that where a lot in district C-2 lines within the same block and fronts upon the same street with a portion of a district R-1 to C-1, inclusive, and no lot within the district C-2 is occupied by a building with a front yard of less depth than required in that portion of a district R-1 to C-1, inclusive, adjoining, then in such case the front yard requirements of such adjoining district R-1 to C-1, inclusive, shall likewise apply to such lot in district C-2.

(c)

Side yards. Same as district C-1; except that on a corner lot no side yard need be provided.

(d)

Rear yards. No rear yard required.

(e)

Lot area per family. Same as district R-3.

(f)

Lot width. No minimum.
