ARTICLE VI

- C-1 LOCAL BUSINESS DISTRICT

Sec. 37-23. - Use regulations.

In district C-1, no building, structure, land or premises shall be used, and no building or structure shall be erected, constructed, reconstructed, moved or altered after June 15, 1965, except for one or more of the following uses:

(1)

Any use permitted in district C-O.

(2)

Antique shop.

(3)

Art gallery.

(4)

Art shop.

(5)

Automobile parking lots (patron parking only).

(6)

Banks, savings and loan establishments.

(7)

Barbershop.

(8)

Beauty shop.

(9)

Book store.

(10)

Cafeteria.

(11)

Camera shop.

(12)

Candy store.

(13)

Catering service.

(14)

Cigar store.

(15)

Chemist shop.

(16)

Clinic (dental or medical, allowing overnight patients only in emergency cases).

(17)

Clothing store.

(18)

Club (private).

(19)

Confectionery.

(20)

Dancing school.

(21)

Delicatessen.

(22)

Department store.

(23)

Dress or millinery shop.

(24)

Dressmaking shop.

(25)

Drugstore.

Dry cleaning pickup, laundry pickup station and self-service laundry and cleaning.

This includes restaurants that hold valid licenses issued by the state under RSMo § 311.095, except that restaurants that hold such licenses shall not be located within 300 feet of any school, church or other building regularly used as a place of religious worship as provided in RSMo § 311.080.2.

(77)

Medical marijuana dispensary facility. Shall not be located within 500 feet of any then-existing elementary school, secondary school, child day-care center, or church. As used in the previous sentence, "then-existing" shall mean any elementary school, secondary school, child day-care center, or church with a building permit from the city to be constructed, or under construction, or completed and in use at the time the medical marijuana dispensary facility applies for a zoning permit.

The above-specified uses shall be retail or service establishments exclusively; no drive-in or curb service shall be permitted where food or beverages are served, and no alcoholic beverages shall be consumed on the premises except in those restaurants that hold valid licenses from the state under RSMo § 311.095, as included in subsection (62) of this section. No merchandise shall be displayed or stored outside a building unless such merchandise is screened or enclosed to the extent that it cannot be seen from off the property.

Sec. 37-24. - Height and area regulations.

In district C-1, the height of the buildings, the minimum dimensions of lots and yards, and the minimum lot area per family permitted on any lot shall be as follows; provided that buildings erected exclusively for dwelling purposes shall comply with the front, side and rear yard requirements of district R-1:

(a)

Height. Buildings or structures shall not exceed 30 feet and shall not exceed two stories.

(b)

Front yards. Same as district R-1.

(c)

Side yards. No side yard is required; except that where a side line of a lot in this district abuts upon the side line of a lot in districts R-1 to R-3, inclusive, a side yard of 15 feet shall be provided. A side yard of 15 feet shall be provided on the street side of a corner lot.

(d)

Rear yards. The depth of the rear yard shall be at least 20 feet where an alley exists; except that on a corner lot no rear yard is required within 50 feet of a side street. Where the rear line adjoins districts R-1 to R-3, inclusive, a rear yard of not less than 15 feet shall be provided.

(e)

Lot area per family. Same as district R-3.

(f)

Lot width. No minimum.
