I Title, Purpose And Intent
This Ordinance shall be known, cited and referred to as the “City of New Richmond Zoning Ordinance” except as referred to herein, where it shall be known as “this Ordinance”.
The general intent of this Ordinance is to regulate and restrict the use of all structures, lands and waters and to:
It is the policy of the City of New Richmond that the enforcement, amendment, and administration of this Ordinance shall be accomplished by adhering to the recommendations contained in the Comprehensive Plan as developed and amended from time to time by the Plan Commission and Common Council. The Common Council recognizes the Comprehensive Plan as the guiding policy for responsibility to regulate land use and development in accordance with the purpose and provisions set forth in this Ordinance.
It is not intended by this Chapter to repeal, abrogate, annul, impair or interfere with any existing easements, covenants, deed restrictions, agreements, rules, regulations or permits previously adopted or issued pursuant to law. However, whenever this Chapter imposes greater restrictions, or such documents, and no non-conformities are involved, the provisions of this Chapter shall govern.
It is hereby declared to be the intention of the City that several provisions of this Ordinance are separable in accordance with the following:
The functions and uses of Table 3 are broad categories. Whenever in any zoning district a form or function is not allowed in Table 3, the use shall be considered prohibited. The Common Council, or the Plan Commission, on their own initiative or upon request, may conduct a study to determine if the proposed use is acceptable and if so what zoning district would be most appropriate and the determination as to conditions and standards relating to development of the use. Based on the findings in the study, the Common Council or the applicant may choose to initiate a Zoning Ordinance amendment to provide for the proposed form or function or the Common Council may find that the form or function is not appropriate..png)
