CHAPTER 4

RESIDENTIAL ZONING DISTRICTS

4.1 GENERAL PURPOSE

The residential zoning districts established in this Chapter are intended to:

  1. Preserve and enhance the quality of living in residential neighborhoods;
  2. Regulate structures and uses which may affect the character or desirability of residential areas;
  3. Provide a variety of housing choices, locations and cost options through varying housing densities, types and designs;
  4. Ensure adequate light, air, privacy and open space;
  5. Promote strong residential neighborhoods with a sense of connection to the community;
  6. Foster citizen involvement in the community and interaction between neighbors;
  7. Maintain a connection to the natural environment by incorporation of natural features into the development setting; and
  8. Maintain an appropriate relationship and scale between the built and natural environment.

4.2 R-1 SINGLE FAMILY RESIDENCE DISTRICT

The purpose of the R-1, Single Family Residence District, is to provide for low density, single family, detached residential dwelling units along with directly related complementary uses.

4.3 R-1S SINGLE FAMILY RESIDENCE DISTRICT, SMALL LOT

The purpose of the R-1S, Single Family Residence District, Small Lot, is to provide for low density, single family, detached residential dwelling units on smaller lots along with directly related complementary uses.

4.4 R-2 SINGLE AND TWO-FAMILY RESIDENCE DISTRICT

The purpose of the R-2, Single and Two-Family Residence District, is to provide for low to moderate density one- and two-unit dwelling units along with directly related complementary uses.

An R-2 district is not a multiple family or multiple residential district for purposes of planning and development under this Ordinance, or for purposes under state, federal or local law or regulation.

4.5 RT-1 TRADITIONAL NEIGHBORHOOD -- SINGLE FAMILY RESIDENCE DISTRICT

The purpose of the RT-1, Traditional Neighborhood – Single Family Residence District, is to provide for single family, detached residential dwelling units generally located in a grid development pattern along with directly related complementary uses.

The Community Development Department may, in its discretion, recommend to the applicant, the Planning Commission and City Council that any use designated in the Table as “C”= Conditionally Permitted be instead considered as an Interim Permitted Use.

4.11 STANDARDS APPLICABLE TO RESIDENTIAL ZONING DISTRICTS

  1. Zero Setback Provisions. In the R-2, R-3 and R-4 Districts, the side setback for a single-family attached dwelling may be reduced to zero (0) feet along the common wall, provided the following conditions are satisfied:
    1. Lot Area.
      1. The combined area of the base lot and individual unit lots contain the required amount of lot area per unit as prescribed elsewhere in this Chapter.
      2. All structures shall comply with the lot area requirements as provided in this Chapter.
    2. Setbacks.
      1. Unit lots shall meet all required setbacks from the boundaries of the base lot.
      2. Except for setbacks along the common property line, all structures shall comply with all other setback requirements as provided in the zoning district regulations.
    3. Other Requirements.
      1. Separate utility services shall be furnished and provided to each dwelling unit.
      2. There shall be a common party firewall up to new construction standards found in the Minnesota State Building Code.
      3. The applicant will record all required agreements, easements, and deed restrictions on all structures that abut the zero side lot line.
      4. The property and structures will comply with all other relevant zoning district regulations.
  2. Common Interest Community (Condominiums). Residential lots of non-single family structures may be divided for the purpose of common interest ownership provided that:
    1. The principal structure containing the housing units shall meet the setback distances of the applicable zoning district.
    2. Each condominium unit shall have the minimum lot area for the type of housing unit and usable open space specified in the area and building size regulations of this Ordinance.
  3. Additional Requirements.

    1. There shall be a front yard having a depth of not less than 30 feet unless adjacent structures on each side of the subject property on the same side of the same block have a front yard setback different from the required setback, in which case the front yard minimum setback shall be the average setback of the adjacent structures. If there is only one (1) adjacent structure, the front yard minimum setback shall be the average of the required setback and the setback of the adjacent structure. In no case shall the minimum front yard setback requirement exceed thirty (30) feet. (See Chapter 13 “Front Yard Averaging”)

    2. There shall be a street side yard having a depth of not less than 10 feet, unless adjacent residential, non-residential or accessory structures on the same side of the same block have a street side yard setback different from the required setback, in which case the street side yard minimum setback shall be the average setbacks of adjacent structures. If there is only one (1) adjacent structure, the street side yard minimum setback shall be the average of the required setback and the setback of the adjacent structure. In no case shall the minimum front yard setback requirement exceed ten (10) feet.

    3. In the case where a lot has more than one front lot line, lot lines for the property that are not front lot lines shall be considered side lot lines. (See Chapter 13 “Lot Types”)

    4. The measurements of the setback of an adjacent structure shall not include any portion of the structure located within a public right-of-way. In such an instance, the setback line is assumed to be the property line.

A front yard abutting the vehicle turn-around portion of a cul-de-sac, as defined in Section10.02, Subd. 7 of the City Code, shall have a depth of not less than 15 feet; provided, however, that if one or more existing structures have front yards abutting the same turn-around, the minimum depth of a front yard for a new structure shall be the lesser of: (1) the front yard setbacks of the existing structure on that turn-around or (2) 30 feet.

    9. A parking lot associated with a permitted or conditional use in a residential zoning district shall maintain a setback of five (5) feet from any lot line of an abutting lot. X
    10. In the R-4 District, buildings shall not exceed four stories or 45 feet in height, provided that any building exceeding three stories in height shall set back from all yard lines required in this Section an additional distance of one foot for every one foot that the building exceeds the height of 30 feet.       X
    11. For buildings exceeding three stories in height, there shall be a side yard on each side of a building having a width of 15 feet plus one foot of side yard for each one foot of building height over 30 feet.      
    12. Where a lot has less area or width than herein required, and was of record on or before October 1, 1968 that lot may be used only for single family dwelling purposes, unless such lot is re-platted in such a way as to provide the minimum area and width required.      X
