ARTICLE 21

11 C-F Community Facility District

21.1101 Purpose

The C-F Community Facility District is intended to provide for the zoning and common classification of most publicly owned land within the Village. Public land may be zoned within the District by the Village, or may be allowed within other districts established in this Article depending upon specified use regulations.

21.1102 Use, Lot And Bulk Regulations

Use, lot and bulk regulations applying specifically to the C-F Community Facility District are set forth in the sections which follow. Also applying to the C-F Community Facility District are regulations set forth in other Articles of this Chapter as follows:

Article 21-3 – Rules and Definitions Article 21-4 – General Provisions Article 21-12 – Planned Developments Article 21-15 – Off Street Parking and Loading Article 21-17 – Signs Article 21-20 – Administration and Enforcement

21.1103 Permitted Uses

Uses of land or buildings, as hereinafter listed, shall be permitted in accordance with the conditions specified. Unless otherwise specifically set forth, wherever a permitted use is named as a major category, it shall be deemed to include only those itemized uses listed under the said category. No building or zoning lot in the C-F District shall be devoted to any use other than a use permitted in the C-F District, and no building or structure shall be erected, altered, enlarged or occupied in the C-F District except for a permitted use in the C-F District unless otherwise specifically allowed by this Article. Permitted uses are:

  1. Active recreation uses, public
  2. Libraries, public
  3. Municipal and township government administrative offices
  4. Parks, public, and playgrounds
  5. Police and fire stations
  6. Schools, public and private
  7. Post office
  8. Conservation areas
  9. Forest Preserve Land
  10. Nature preserves
  11. Municipal utility buildings and structures
  12. Municipal sewage treatment facilities
  13. Water works, reservoirs, pumping stations, filtration plants and wells
  14. Municipal Public Works garage maintenance facilities
  15. Institutional
  16. Open Space
  17. Communications towers
  18. Federal, state, county government administrative offices

21.1104 Special Uses

  1. Above-ground storage tanks - excluding municipal water towers
  2. Amphitheaters and fairgrounds, public
  3. Communication towers
  4. Cultural facilities, public
  5. Private utility buildings and structures
  6. Solid waste transfer stations
  7. Hospitals
  8. Golf Courses
  9. Museums
  10. Public cemeteries and mausoleums
  11. Churches, temples or synagogues.

21.1105 Accessory Uses

Accessory uses, buildings or other structures customarily incidental to and commonly associated with a permitted or special use may be permitted, provided they are operated and maintained under the same ownership and on the same lot as the permitted use, do not include structures or structural features inconsistent with the permitted use, and do not involve the conduct of any separate business, profession, trade or industry.

Accessory uses may include the following:

  1. Athletic fields and stadia accessory to educational institutions.
  2. Commercial sale of food or nonalcoholic beverages, if incidental to a public structure or facility.
  3. Public garages and parking lots, accessory to a permitted or special use.
  4. Residence of groundskeeper for park or educational institutions.
  5. Signs, as regulated in Article 21-17.
  6. Swimming pools and tennis courts incidental to public structures or facilities.
  7. Water retention or detention areas.

21.1106 Site And Structure Provisions

Uses in the C-F Community Facility District shall conform to the following requirements:

  1. Minimum Lot Area. A minimum lot area is not required.
  2. Minimum Lot Width. A minimum lot width is not required.
  3. Required Yards. Required yards shall be provided and maintained in the C-F Community Facility District as described below. Special uses may require yards greater in depth than described when specifically required by the Village Board.
    1. Required Front Yards. A required front yard shall be provided and maintained with a depth equal to or greater than the required front yards on adjacent properties.
    2. Required Side Yards. Each required side yard shall be provided and maintained equal in depth to the required side yard on the adjacent property. If the adjacent property is in a residential district, the required side yard shall be at least twenty-five (25) feet.
    On a corner side yard, a required side yard shall be provided and maintained equal in depth to the required front yard.
  4. Required Rear Yard. A required rear yard of thirty feet (30’) shall be provided and maintained.
  5. Floor Area Ratio. The maximum floor area ratio shall be 1.0. However, greater floor area ratios may be granted as a special use by the Village Board.
  6. Building Height. The maximum height of all buildings or structures may be fifty (50) feet. However, taller structures, excluding communication towers and municipal water towers, may be permitted as special uses by the Village Board.
  7. Special Requirements. Uses in the C-F Community Facility District shall conform to the requirements set forth hereinafter.
    1. Parking and Loading Requirements. All uses shall conform to the applicable requirements for off-street parking and loading set forth in Article 21-15.
    2. Sign Requirements. All uses shall conform to the applicable requirements for signs set forth in Article 21-17.
    3. Sewer and Water. All structures and uses requiring sanitary facilities shall be served by either a municipal sewer and water system, a private community sewer and water system, or a private individual sewage disposal system and water supply system approved by the Kendall County Health Department and the Village Engineer.
    4. Refuse Areas. All refuse areas shall be screened as required in Article 21-13, Site Development Requirements, Section 21.1303.
    5. Required Landscaping and Screening. All development in the C-F Community Facility District shall provide screening and landscaping in accordance with provisions in Article 21-13, Site Development Requirements, Section 21.1303.
    6. Lighting. All exterior lighting, building and parking lot lights and landscape lighting shall be directed away from adjacent highways, streets and properties. A lighting plan shall be prepared and be reviewed and approved by the Village engineer prior to the issuance of building permits.
