ARTICLE 21

6 A-1, Agricultural District

21.601 Purpose

The purpose of the Agricultural District is to maintain open lands in a use that:

  1. Is consistent with the desired rural character identified in the Newark’s Comprehensive Land Use Plan,
  2. Fosters efficient land use patterns, which can be effectively served by public services,
  3. Preserves agriculturally productive farmland for farming, and
  4. Protects agricultural farmsteads from incompatible non-farm uses.

21.602 Uses

  1. Permitted.
    1. Agriculture, including:
      1. Beekeeping
      2. Field crops.
      3. Forestry.
      4. Green houses.
      5. Horticulture.
      6. Orchards.
      7. Produce stand.
      8. Truck farming.
      9. Viticulture.
    2. Plant nurseries, excluding retail sales.
    3. Single-family dwellings.
  2. Permitted Accessory Uses.
    1. Buildings accessory to farm operations.
    2. Guesthouse.
    3. Private stables for use by residents and their guests, provided that the total number of horses permitted on any given lot shall be determined by use of the following formula: one (1) horse for the first 40,000 square feet of land area, and one (1) additional horse for each additional 20,000 square feet of land area.
    4. Roadside stands for the sale of farm products grown and raised on or in the immediate area of the premises, provided:
      1. The stand complies with minimum setback requirements.
      2. Adequate parking is provided for customers pursuant to Article 21-15, Off-Street Parking and Loading.
      3. Signage must comply with requirements contained in Article 21-17, Signs.
    5. Servicing, repair and outdoor storage of farm machinery when accessory to the permitted uses listed above.
    6. Private swimming pools and tennis courts (either unlighted or lighted), in rear yards only, and subject to the setback regulations of this District.
    7. Those uses customarily accessory to the pursuit of agriculture.
  3. Special Uses.
    1. Aircraft landing fields.
    2. Agriculturally related research and facilities.
    3. Animal and poultry husbandry.
    4. Cemeteries, including crematories and mausoleums, provided no building shall be located less than one hundred (100) feet from side and rear property lines.
    5. Commercial feed lots.
    6. Fertilizer production, sales, storage, mixing and distribution.
    7. Fishing, hunting and game preserves.
    8. Grain elevators and storage, commercial.
    9. Kennels.
    10. Livestock depots, sales yards, and auction barns.
    11. Milk depots.
    12. Milk processing and distribution, including pasteurizing and manufacturing of ice cream and cheese.
    13. Practice pistol and rifle ranges, skeet or trap shooting.
    14. Commercial radio, television and communications towers.
    15. Recreational areas or campgrounds.
    16. Sales of feed and seed provided these activities are accessory to the primary activity of farming, but not including sales of farm machinery.
    17. Riding academies and commercial stables.
    18. Sewage treatment facilities and other public utilities (i.e. electrical substations and distributions centers, transmission towers, etc.).
    19. Other rural business uses not specifically listed above, when determined to be compatible with established uses on adjoining property.
    20. Public swimming pools and tennis courts.

21.603 Lot Requirements

  1. Minimum Lot Size – 25 acres.
  2. Minimum Lot Width – Not less than two hundred and fifty (250) feet shall be maintained at the front property line.

21.604 Yard And Setback Regulations

Every building hereafter erected or enlarged in this District shall provide and maintain a setback in accordance with the following:

  1. Setback from Highways – Not less than sixty (60) feet from any street, road and highway, as measured from the street right-of-way.
  2. Minimum Front and Corner Side Yards – Not less than sixty (60) feet from a front and corner side lot line.
  3. Minimum Interior Side Yards – Not less than twenty-five (25) feet from an interior side lot line.
  4. Minimum Rear Yards – Not less than sixty (60) feet from a rear lot line.
  5. Special Provision – Notwithstanding the above, no animals or poultry shall be housed, stabled, kenneled or yarded closer than five-hundred (500) feet from any lot line.

21.605 Height Limitations

  1. Single-Family Detached Dwellings – Not more than forty-five (45) feet.
  2. Other Permitted Uses – No height restriction.
  3. Agricultural Silos – Not more than ninety (90) feet.
  4. Special Uses – As determined by the Plan Commission and Village Board as part of any special use permit which may be issued.
