ARTICLE 21

7 Residential Districts

21.701 General Provisions

  1. Lot Standards – Notwithstanding requirements set forth in individual zoning districts which follow, minimum dimensions for single-family or two family dwellings in any residential district shall, unless otherwise approved as part of a planned development or special use, be as follows:
    1. Lot Width – Not less than eighty-five (85) feet, as measured at the front lot line (street right-of-way).
    2. Lot Depth – An average depth of one hundred thirty (135) feet.
    3. Minimum Size – Not less than eleven thousand (11,000) square feet.
  2. Septic.
    1. Unless otherwise approved by the Village Board, minimum lot size for a single-or two-family dwelling without public sewer or water shall be at least 40,000 square feet in area.
    2. The Kendall County Health Department may require building lots to be larger than the minimum specified above, depending upon soil suitability for such systems.
  3. Planned Developments – Lots may be reduced in area, width, and average lot depth below that otherwise required by regulations in the residential districts which follow, when subdivisions include open space beyond that otherwise required, and are processed as planned developments. See Article 32-12, Planned Developments, for applicable standards and procedures.
  4. Open Space/Greenbelt – Open space shall be provided for Village residents in the form of parks and greenbelts, consistent with regulatory and policy directives of the Village. Where parks and greenbelts illustrated on the Land Use Plan pass through a proposed residential subdivision unless otherwise recommended by the Plan Commission and approved by the Village Board or unless otherwise provided under an annexation agreement, land, in lieu of cash shall be provided according to the Village Land/Cash Ordinance. The Village has determined that the dedication of land in these areas is essential for implementing the continuous greenbelt and open space system adopted as part of the Village’s Comprehensive Land Use Plan:
    1. Purpose.
      1. To establish natural limits of growth throughout the Village.
      2. To visually set Newark apart from adjacent communities.
      3. To preserve existing natural resources and protect critical storm water drainage corridors.
      4. To provide conveniently located recreational amenities and facilities for residents of Newark.
    2. Greenbelt/Natural Features-Open Spaces.
      1. Where a greenbelt illustrated on Newark’s Comprehensive Land Use Plan passes through a proposed subdivision, a minimum width not less than one-hundred (100) feet shall be set aside for this amenity. This minimum width shall be increased to incorporate floodplain, steep slopes, wetlands, high quality native plant communities, major stands of trees, riparian zones, and/or other significant natural features that may exist within, or adjacent to these areas. The location and extent of a greenbelt shall be determined at the time of preliminary plan and/or plat.
      2. For the purpose of this Ordinance, these natural features shall be defined as follows:
        1. Floodplain. One hundred (100) year floodplain, as defined by the Federal Emergency and Management Agency (FEMA).
        2. Steep Slopes. Those land areas with slopes that equal or exceed thirty-five (35) percent, or 2.85:1.
        3. Wetlands. As defined through the currently applicable criteria established by the U.S. Army Corps of Engineers.
        4. High Quality Native Plant Communities. Those areas (i.e. prairie, savanna, etc.) which have a Natural Area Rating Index (NARI) of twenty (20) or greater, utilizing the Natural Area Rating Index, by Swink and Wilhelm, (1979).
        5. Major Stands of Trees. Mature woodlands, such as stands of oak/hickory forest, and floodplain forests, such as mature cottonwood, silver maple, sycamore, hackberry etc.
        6. Riparian Zone. Natural vegetation along the edge of a stream that: modulates temperature; provides nutrient input into the stream system; provides a buffer that intercepts surface runoff, filtering out sediments and pollutants; provides erosion control through soil stabilization; and serves as habitat and mitigation corridors for wildlife who utilize the stream for food and drink.
      3. The greenbelt/natural feature shall be recorded with the final plan and/or plat of subdivision as open space to be maintained as such in perpetuity.
      4. At the time of final platting, an easement, not less than fifteen feet wide, shall also be recorded to accommodate future development of a recreation path within the greenbelt. Said path shall be eight feet wide, and installed at such time as the Village determines appropriate. Unless otherwise approved by the Village Board, the path shall consist of crushed limestone, and shall be engineered to avoid erosion.
      5. Two-inch caliper native trees shall be planted along the perimeter of the greenbelt/natural feature to define as limits. The Village Board may waive tree plantings during review of a final plan or plat, if the greenbelt is wooded, or includes natural features that may be inconsistent with required tree plantings. Where required:
        1. Not less than one native tree shall be planted on each side of the greenbelt for each thirty (30) lineal feet that passes through the residential subdivision.
        2. Trees shall be planted in naturalistic groupings, and shall be worked into the existing landscape.
      6. Native grasses, wildflowers, or other native vegetation shall be installed where necessary to stabilize slopes within the greenbelt, in lieu of lawn or other traditional groundcover.
    3. Parks – The exact location of boundaries and parkland shall be determined as part of the preliminary plan or plat.
    4. Submittals – Unless otherwise waived by the Village Board, the following shall be submitted for staff review at the time of preliminary plat or plan to determine the existence, location and extent of wetlands, floodplain, native prairie, major stands of trees, steep slopes and other natural features that may fall within the environmental corridor depicted on the Land Use Plan:
      1. Items listed below shall be included on a site plan, at a scale not less than 1” – 100’, unless a larger scale is otherwise required by the Village Engineer:
        1. Location of FEMA floodplain.
        2. Existing contours at one-foot intervals.
        3. Existing and proposed drainage system, including all discharge points, collection, conveyance, and storage facilities.
        4. Proposed contours, at one-foot intervals.
        5. Drainage features, storm water management facilities, floodplain and wetland boundaries.
        6. Boundaries of predominate soil types.
        7. Location species and size of trees six inches or greater in caliper, if any.
        8. Delineation of riparian zone, if any, and location, species and size of trees, six inches or greater in caliper, that exist within the zone.
        9. Delineation of high quality native plant communities, if any, and a copy of the Natural Area Rating Index for the plant communities.
      2. Where wetlands exist within, or adjacent to the greenbelt, a wetland delineation report shall be submitted which includes:
        1. A map showing the exact location of wetlands within the development boundaries.
        2. An aerial photograph delineating wetland, development and watershed boundaries.
        3. Army Corps of Engineers data sheets with representative color photographs.
        4. Written description of the wetland(s) including a professional assessment of functional values.
      3. Protective covenants shall be submitted for the non-public greenbelt/natural features or park, which identify:
        1. Name, address and telephone number of the individual or group responsible for maintenance of the park or greenbelt.
        2. Required maintenance provisions and responsibilities for these resources.
        3. Terms and conditions associated with the use of the land
        4. Identification and anticipated use of proposed public land.
  5. Screen Plantings – Where a proposed residential subdivision abuts a more intensive land use, landscape screening shall be provided. Such screening may be accomplished through the provision of landscaped berms, a compact hedge, fence, wall or a combination of these methods, as recommended by the Plan Commission and approved by the Village Board, during the preliminary and final plan and/or plat review process:
    1. Required screening shall be a minimum of five (5) feet in height, at installation.
    2. The placement of a screen shall not impair the safety of pedestrian or vehicular traffic.
    3. Screening shall maintain a year round opacity not less than seventy-five (75) percent.
    4. Where screening is required, a landscape plan, prepared by a qualified landscape architect, shall be submitted with the preliminary and final plan and/or plat of subdivision, and shall show:
      1. Location, design, and dimensions of proposed fencing, if any.
      2. Location, species, size and quantity, of proposed trees and shrub plantings.
      3. Contours of proposed berms, if any.
      4. Limits of seed or sod, and identification of other groundcover, if any.
  6. Setback from Major Streets – Unless otherwise approved as part of a special use permit, all structures hereinafter constructed in residential districts shall be set back at least fifty (50) feet from the following major roads and highway, as measured from the existing street right-of-way, or such future right of way as recommended by the entity having jurisdiction over that road or highway:
    1. Illinois Route 71
    2. Newark Road
    3. Townhouse Road
    4. Johnson Street
  7. Public Utilities – Public utility and service uses shall only be allowed as a special use in residential districts. For purpose of this Ordinance, public utilities and service uses shall include, but not be limited to, the following:
    1. Essential services, including fully automated gas regulating stations, telephone exchanges and electric substations.
    2. Railroad passenger stations.
    3. Tower and antennas, commercial, for radio, television and telephone transmitting, receiving or relay stations.
    4. Wastewater treatment plant.
    5. Water works, reservoirs, pumping stations, filtration plants and wells.
  8. Chickens in Residential Districts.
    1. Up to eight domestic hens may be kept on properties zoned and occupied for single family residential use only.
    2. Roosters are prohibited in the village limits.
    3. No person shall slaughter any chickens in the village limits.
    4. Hens shall be kept within a fenced and covered enclosure in the rear yard only and set back a minimum of five (5) feet from side and rear lot lines.
    5. Hens shall be kept in the fenced enclosure at all times. Hen yards and coops shall be constructed and maintained to reasonably prevent the collection of standing water; and shall be cleaned of hen droppings, uneaten or discarded feed, feathers, and other waste with such frequency as is necessary to ensure the hen yard and coop do not become nuisances.
    6. All feed shall be kept in a container with a tightly fitted lid until put out for consumption for hens.
    7. No eggs or chickens shall be offered for sale on the premises.

21.702 R-E, Residential Estate District

Purpose. The purpose of this zone is to provide for a rural environment that allows for new single-family residential uses. It is designed for low-density occupancy on areas with few or no public improvements.

  1. Permitted Uses.
    1. Residential.
      1. Home occupations, as defined in Section 21.416.
      2. Single-family detached dwellings.
    2. Recreation/Open Space.
      1. Greenbelts.
      2. Parks, forest preserves, playgrounds or play fields.
      3. Private stables for use by residents and their guests, provided:
        1. That the total number of horses permitted on any given lot shall be determined by use of the following formula:

          One (1) horse for the first one (1) acre of land area, and one (1) additional horse for each additional one (1) acre of land.
        2. Stables shall be located at least one hundred-fifty (150) feet from the front lot line, and at least fifty (50) feet from a side and/or rear lot line.
        3. Pasture – No pasture may be located in a Front Yard unless it is outside of a line located in the Side Yard which is drawn parallel with the side lot line and a minimum of ten (10) feet toward the side lot line from the side wall of the residence adjacent to the Side Yard in question.
    3. Institutional.
      1. Elementary schools, public or private, non-boarding.
      2. Junior High schools, public or private, non-boarding.
    4. Agriculture. Agricultural uses, as provided according to Article 21-6, Permitted Uses, Section 21.602.
  2. Permitted Accessory Uses.
    1. Buildings accessory to the principal use, including private garages, provided they are located in the side or rear yard, and no closer than ten (10) feet to a side or rear property line. (See Section 21.302 definitions)
    2. Non-paying rooms for guests within an accessory building provided such facilities are used for the occasional housing of guests of the occupants of the principal building, and not for permanent occupancy by others as housekeeping units, and contain no kitchen facilities.
    3. Private greenhouse, subject to setback regulations of this District.
    4. Private swimming pools and tennis courts (either unlighted or lighted), in rear yards only, and subject to the setback regulations of this District.
    5. Sheds or buildings for domestic storage provided they are located in a rear yard only, and no closer than ten (10) feet to a side or rear property line.
  3. Special Uses.
    1. Residential.
      1. Congregate care facilities.
      2. Convalescent centers and nursing homes.
      3. Group homes.
      4. Model homes.
      5. Planned developments, as provided according to Article 21-12.
    2. Institutional/Governmental.
      1. Cemeteries, provided:
        1. Lot area consists of one (1) or more acres.
        2. Buildings are set back at least one-hundred (100) feet from side and rear property lines.
      2. Churches, temples or synagogues.
      3. Civic buildings, including governmental, police and fire.
      4. Community center buildings.
      5. Hospitals and/or medical clinics.
      6. Museums and galleries.
      7. Public utility and service facilities, as defined in Section 21.701G, above.
      8. Religious retreats.
      9. Schools: boarding.
      10. Schools: high school, college, university, and trade, public or private.
    3. Service.
      1. Bed and breakfast guesthouses.
      2. Day care centers and nursery schools, public or private.
      3. Kennels.
      4. Inns.
      5. Veterinarians or animal clinics.
    4. Recreation.
      1. Aircraft landing fields.
      2. Club or lodge building.
      3. Golf courses.
      4. Stables, commercial.
      5. Swim and/or tennis clubs.
  4. Lot Size Regulations.
    1. Residential.
      1. Minimum Lot Size –Not less than two (2) acres.
      2. Minimum Lot Width – Not less than one hundred and twenty-five (125) feet shall be maintained at the building setback line.
    2. Special Uses – Lot sizes for special uses shall be as specified in the special use permit, unless otherwise noted for a particular use listed in this District based upon the criteria listed in Article 21-20, Administration and Enforcement, Section 21.2012 of this Ordinance.
  5. Yard and Setback Regulations. Every building hereafter erected or enlarged in this District shall provide and maintain a setback in accordance with the following:
    1. Setback from Major Streets – As provided in Section 21.701F, above.
    2. Minimum Front and Corner Yards – Not less than thirty (30) feet from the front or corner side lot line.
    3. Minimum Interior Side Yards – Not less than fifteen (15) feet from an interior side lot line.
    4. Minimum Rear Yards – Not less than forty (40) feet from a rear lot line.
    5. Maximum Lot Coverage – Not more than one-third (33.3 percent) of a lot can be occupied with buildings, accessory structures and impervious surfaces.
  6. Bulk Regulations.
    1. Structure Height.
      1. Single-Family Detached Residences – Not more than forty-five (45) feet.
      2. Accessory Buildings or Structures – No height restrictions.
      3. Special Uses – Maximum height limitations shall be specified with the granting of a special use permit.
    2. Floor Area – Floor areas which follow are exclusive of garages, basements or porches:
      1. Single-Family Detached Residences.
        1. One-story, single-family residence – Not less than 1,450 square feet.
        2. Two-story, single-family residence – Not less than 2,100 square feet.
      2. Other Uses – No minimum floor area shall apply to other permitted and special uses within this District.

21.703 R-1, Downtown Residential District

  1. Purpose. The purpose of this zone is to provide for single-family attached and detached, and multi-family residences in the historic Village core area served by public sewer and water.
  2. Permitted Uses.
    1. Residential.
      1. Home occupations, according to Article 21-4 Section 21.416.
      2. Detached single-family dwellings.
      3. Original Multi-family dwellings, as determined by the Zoning Enforcement Officer.
    2. Recreational/Open Space.
      1. Greenbelts.
      2. Public parks, forest preserves, playgrounds or playfields.
  3. Permitted Accessory Uses.
    1. Buildings accessory to the principal use, including private garages, provided they are located in the side or rear yard, and no closer than five (5) feet to a side or rear property line.
    2. Private greenhouse, subject to setback regulations of this District.
    3. Private swimming pools and tennis courts (unlighted), in rear yards only, and subject to the setback regulations of this District.
    4. Sheds or storage buildings provided they are located in a rear yard only, and no closer than five (5) feet to a side or rear property line. A maximum of one shed or storage building is allowed per lot.
  4. Special Uses.
    1. Residential.
      1. Congregate care facilities.
      2. Convalescent centers and nursing homes.
      3. Group homes.
      4. Model homes.
      5. Planned developments, as provided according to Article 21-12.
      6. New Multi-family structures other than those listed in paragraph B. above.
    2. Institutional/Governmental.
      1. Schools: high school, college, university and trade, public or private.
      2. Schools: Elementary schools, public or private, non-boarding. Junior High Schools, public or private, non-boarding.
    3. Service.
      1. Bed and breakfast guesthouses.
      2. Day care centers and nursery schools, public or private.
      3. Inns.
    4. Recreation.
      1. Club or lodge building.
      2. Swim and/or tennis clubs.
  5. Lot Size Regulations.
    1. Residential.
      1. Minimum Lot Size – Not less than 7,200 square feet for detached single family.
      2. Minimum Lot Width – Not less than sixty (60) feet for detached single family.
    2. Special Uses – Lot sizes for special uses shall be as specified in this special use permit, unless otherwise noted for a particular use listed in this District, based upon the criteria listed in Article 21-20, Administration and Enforcement, Section 21.2012.
  6. Yard and Setback Regulations. Every building hereafter erected or enlarged in this District shall provide and maintain the following setbacks:
    1. Minimum Front and Corner Yards – A build-to-line of 22’ - 25’. In blocks where greater than 50% of the lots are occupied by residences, the minimum building setback line shall be established at the average setback of the existing residences. However, in such cases, a maximum setback shall also be established to be the average setback of the existing residence plus five (5) feet.
    2. Minimum Interior Side Yards – Not less than ten (10) feet for detached single family.
    3. Minimum Rear Yards – Not less than thirty (30) feet from a rear lot line.
    4. Maximum Lot Coverage – Not more than forty-five (45 percent) of a detached single-family lot can be occupied with buildings, accessory structures and impervious surfaces.
  7. Bulk Regulations.
    1. Structure Height.
      1. Detached Single-Family Residences – Not more than thirty-five (35) feet.
      2. Special Uses – Maximum height limitations shall be specified with the granting of a special use permit.
    2. Floor Area – Floor areas which follow are exclusive of garages, basements or porches.
      1. Detached Single-Family Residences.
        1. One-story, detached single-family – Not less than 1,200 square feet per unit.
        2. Two-story, detached single-family – Not less than 1,600 square feet per unit.
  8. Other Uses. No minimum floor area shall apply to other permitted and special uses within this District.

21.704 R-2, Single Family Residential District

  1. Purpose. The purpose of this zone is to provide for single-family detached and attached residences in areas served by public sewer and water.
  2. Permitted Uses.
    1. Residential.
      1. Home occupations, according to Article 21-4, Section 21.416
      2. Detached single-family dwellings.
      3. Duplexes.
      4. Townhomes.
    2. Recreational/Open Space.
      1. Greenbelts.
      2. Parks, forest preserves, playgrounds or playfields.
  3. Permitted Accessory Uses.
    1. Buildings accessory to the principal use, including private garages, provided they are located in the side or rear yard, and no closer than ten (10) feet to a side or rear property line.
    2. Private greenhouse, subject to setback regulations of this District.
    3. Private swimming pools and tennis courts (unlighted), in rear yards only, and subject to the setback regulations of this District.
    4. Sheds or buildings for domestic storage provided they are located in a rear yard only, and no closer than five (5) feet to a side or rear property line. A maximum of one shed or storage building is allowed per lot.
  4. Special Uses.
    1. Residential.
      1. Congregate care facilities.
      2. Convalescent centers and nursing homes.
      3. Group homes.
      4. Model homes.
      5. Planned developments, according to Article 21-12.

      2. Swim and/or tennis clubs.
  5. Lot Size Regulations.
    1. Residential.
      1. Minimum Lot Size – 9,000 sq. ft. for detached single family, 11,000 sq. ft. lot average. Duplexes and townhomes not less than 4,000 sq. ft. per unit
      2. Minimum Lot Width – Not less than sixty (60) feet for detached single family, eighty (80) feet for duplexes and townhouses shall be maintained at the building setback line.
    2. Special Uses. Lot sizes for special uses shall be as specified in this special use permit, unless otherwise noted for a particular use listed in this District, based upon the criteria listed in Article 21-20, Administration and Enforcement, Section 21.2012.
  6. Yard and Setback Regulations. Every building hereafter erected or enlarged in this District shall provide and maintain the following setbacks:
    1. Setback from Corridor Streets – Thirty (30) feet.
    2. Minimum Front and Corner Yards – A build-to-line of 22’ - 25’ with a 15’-18’ porch setback from a front or corner side lot line.
    3. Minimum Interior Side Yards – Not less than ten (10) feet for detached single family, ten (10) feet for duplexes and fifteen (15) feet for townhomes and other multi-family from an interior side lot line.
    4. Minimum Rear Yards – Not less than thirty (30) feet from a rear lot line.
    5. Maximum Lot Coverage – Not more than one-third (33 %) for detached single family or one-half (50%) for duplex and townhome lots can be occupied with buildings, accessory structures and impervious surfaces.
  7. Bulk Regulations.
    1. Structure Height.
      1. Detached Single-Family Residences – Not more than thirty-five (35) feet.
      2. Duplexes and Townhomes – Not more than thirty-five (35) feet
      3. Special Uses – Maximum height limitations shall be specified with the granting of a special use permit.
    2. Floor Area. Floor areas which follow are exclusive of garages, basements or porches:
      1. Detached Single-Family Residences.
        1. One-story – Not less than 1,600 square feet.
        2. Two-story – Not less than 2,000 square feet.
      2. Duplex Residences.
        1. One-story – Not less than 1,300 square feet.
        2. Two-story – Not less than 1,600 square feet.
      3. Other Uses. No minimum floor area shall apply to other permitted and special uses within this District.

21.705 R-3, Multiple-Family Residential District

  1. Purpose. The purpose of this zone is to provide for medium-density multi-family development that is compatible in scale with single-family homes, in areas served by public sewer and water.
  2. Permitted Uses.
    1. Residential.
      1. Home occupations, according to Article 21-4, Section 21.416.
      2. Detached Single-family dwellings.
      3. Townhomes.
      4. Duplexes.
      5. Quadruplexes.
      6. Apartments
    2. Recreational/Open Space.
      1. Greenbelts.
      2. Parks, forest preserves, playgrounds or playfields.
  3. Permitted Accessory Uses.
    1. Buildings accessory to the principal use, including private garages, provided they are located in the side or rear yard, and no closer than ten (10) feet to a side or rear property line (See Section 21.302 definition). A maximum of one shed or storage building is allowed per lot.
    2. Private swimming pools and tennis courts (unlighted), in rear yards only, and subject to the setback regulations of this District.
  4. Special Uses.
    1. Residential.
      1. Congregate care facilities.
      2. Convalescent centers and nursing homes.
      3. Group homes.
      4. Model homes.
      5. Planned developments, as provided according to Article 21-12.
    2. Institutional/Governmental.
      1. Schools: high school, college, university and trade, public or private.
      2. Elementary schools, public or private, non-boarding.
      3. Junior High schools, public or private, non-boarding.
    3. Service.
      1. Bed and breakfast guesthouses.
      2. Day care centers and nursery schools, public or private.
    4. Recreation.
      1. Club or lodge building.
      2. Golf courses.
      3. Swim and/or tennis clubs.
      4. Swimming pools and tennis courts (lighted) constructed for the common benefit of residents of town homes or apartment dwellers in rear yards only, and subject to the setback regulations of this District.
  5. Lot Size Regulations.
    1. Residential.
      1. Minimum Lot Size.
        1. Detached single-family residential – Not less than 8,000 square feet.
        2. Duplex, townhomes, and quadruplexes – Not less than 4,000 square feet per dwelling unit.
        3. Apartments – Not less than 3,000 Sq. Ft.
      2. Minimum Lot Width.
        1. Detached single-family residential – Not less than sixty (60) feet shall be maintained at the building setback line.
        2. Duplex, townhomes, quadruplexes and apartments – Not less than eighty (80) feet shall be maintained at the setback line.
      3. Maximum Gross Density – Not more than ten (10) dwelling units per acre.
    2. Special Uses. Lot sizes for special uses shall be as specified in this special use permit, unless otherwise noted for a particular use listed in this District, based upon the criteria listed in Article 21-20, Administration and Enforcement, Section 21.2012 of this Ordinance.
  6. Yard and Setback Regulations. Every building hereafter erected or enlarged in this District shall provide and maintain the following setbacks:
    1. Setbacks from Major Highways – As provided Section 21.701F, above.
    2. Minimum Front and Corner Yards – Not less than twenty-five (25) feet from a front or corner side lot line.
    3. Minimum Interior Side Yards – Not less than ten (10) feet for detached single family, ten (10) feet for duplexes and fifteen (15) feet for townhomes and other multi-family from an interior side lot line.
    4. Minimum Rear Yards – Not less than thirty (30) feet from a rear lot line.
    5. Maximum Lot Coverage – Not more than fifty-five (55 percent) of a lot can be occupied with buildings, accessory structures and impervious surfaces.
    6. Townhome and other multi-family (excluding duplexes) Building Separation Standards.
      1. Front-to-Front – Not less than seventy-five (75) feet.
      2. Rear to Rear – Not less than one and one-half (1-1/2) times the building height or fifty (50) feet, whichever is greater.
      3. Front or Rear to Side – Not less than forty (40) feet.
      4. Side-to-Side – Not less than thirty (30) feet.
      5. Corner-to-Corner – Not less than twenty (20) feet at the closest point between building corners.
  7. Bulk Regulations.
    1. Structure Height.
      1. Detached single-Family Residential – Not more than thirty-five (35) feet.
      2. Townhomes, Duplexes and Apartments – Not more than thirty-five (35) feet.
      3. Special Uses – Maximum height limitations shall be specified with granting of a special use permit.
    2. Floor Area. Floor areas which follow are exclusive of garages, basements or porches:
      1. One-story, detached single-family residence – Not less than 1,200 square feet.
      2. Two-story, detached single-family residence – Not less than 1,600 square feet.
      3. One story, duplexes and townhomes – Not less than 1,100 sq. ft.
      4. Two story duplexes and townhomes – Not less than 1,400 sq. ft.
      5. Apartments – Not less than 900 sq. ft.
    3. Number of Units – Not more than six (6) dwelling units per townhome structure.
