CHAPTER 1256

CSI Church, School, Institutional District

1256.01 PURPOSE.

   The purpose of the Church, School, Institutional District is to provide areas for the development and use of structures and amenities related to religious, educational, cultural and recreational buildings both private and public.

1256.02 PERMITTED USES.

   (a)   Churches and other places of religious worship and study.
   (b)   Private and public educational buildings and campuses.
   (c)   Museums, art galleries, and other cultural attractions.
   (d)   Theaters with live theatrical presentations or performances.
   (e)   Indoor or outdoor recreational facilities.
   (f)   Parks.
   (g)   Flagpoles, television and radio antennas for the exclusive use of the property owner.
   (h)   Assisted living facilities.
   (i)   Day care.
   (j)   Residential uses per Section 1256.14.
   (k)   Recycle collection points.

1256.03 ACCESSORY USES.

   (a)   Uses, customary in the course of or associated with specified permitted uses.
   (b)   Cemeteries, only to churches and places of religious worship.

1256.04 CONDITIONAL USES.

   (a)   Outdoor lighting for recreational facilities.
   (b)   Outdoor live music venues.
   (c)   Campgrounds as an accessory use.

1256.05 ACCESSORY STRUCTURES.

   (a)   Including, but not limited to, parking garages, stadiums, bell towers, shelters, public or private swimming pools when used in the course of or associated with a permitted or conditional use.
   (b)   Accessory structures shall comply with Chapter 1274.

1256.06 DISTRICT STANDARDS.

   (a)   The floor area in this district is unlimited.
   (b)   The combined square footage of the footprint of all buildings and structures on a given lot shall not be more than twenty-five percent of the lot area, exclusive of any lot area in the floodway.
   (c)   New construction, including additions, shall be reviewed by the Planning Commission for compliance with the City's current Development Regulations. Items to be reviewed by the Planning Commission in determining compliance include, but are not limited to, the following items: roadway improvements, access management or traffic congestion prevention, storm water management, floodplain management, public utility connections, FAA requirements and landscaping requirements.
   (d)   All uses in this district shall comply with the applicable requirements of Chapter 1296.
   (e)   There shall be a maximum of four recycling collection point containers allowed on lots less than five acres; maximum of eight recycling collection point containers allowed on lots of five acres or more.
   (f)   There shall be no retail business conducted in this district, except as per Section 1256.03(a).
   (g)   There shall be an evergreen buffer between a use in this district and any residential district. The buffer shall consist of a strip of land not less than fifteen feet in width, planted with an evergreen hedge, or planting of evergreen shrubs not less than four feet in height, providing a continuous seventy-five percent opaque buffer.

1256.07 HEIGHT RESTRICTIONS.

   (a)   Church spires, bell towers or ancillary structures shall not exceed a height of eight feet higher than the building or structure it is attached or adjacent to.
   (b)   Flagpoles, television and radio antennas shall not exceed the height of existing buildings on the property by more than four feet.

1256.08 LOT AREA AND SETBACKS.

   The following minimum requirements shall apply, except as provided in Chapters 1270 and 1271.

1   There shall be a minimum of sixty feet of lot frontage on a public street.
2   Additional lot area of one acre per one hundred theatre seats or fraction thereof over 200.
3   Additional lot area of one acre per 100 sanctuary seats or fraction thereof over 200.
4   These district standards apply to new construction. For alterations or additions to existing structures see Chapter 1242.
5   Side yard setback shall be increased one foot for each foot of height a principal building exceeds thirty feet.

1256.09 OFF-STREET PARKING AND LOADING.

   Off-street parking and loading spaces shall be provided in accordance with Chapter 1290.

1256.10 CORNER LOTS.

   Corner lots shall meet the requirements of Section 1240.11.

1256.11 LANDSCAPING, BUFFERING, GREEN SPACE.

   Landscaping, buffering, and green space shall be provided in accordance with Chapter 1292.

1256.12 PUBLIC AND PRIVATE ROADWAYS.

   (a)   Front yard setbacks from public and private roadways shall be modified in accordance with the thoroughfare maps maintained in the office of the City Engineer.
   (b)   Lots with no legal access to an adequate public right-of-way shall obtain approval from the Planning Commission for the proposed access prior to issuance of a zoning certificate. Approval of a lot split by the Planning Commission is evidence of an acceptable legal access.

1256.13 OTHER STANDARDS/REGULATIONS.

   Deed restrictions and covenants may establish additional restrictions.

1256.14 RESIDENTIAL USES.

   (a)   In this district, a one-family dwelling and related accessory structures on a single lot or parcel in existence at the time of the adoption of this Code may be repaired, altered or enlarged in accordance with Chapters 1242, 1248, 1249, or 1251 as determined by the Zoning Inspector.
   (b)   New residential uses shall not be permitted within this district except as an accessory use to a permitted use including, but not limited to:
      (1)   A parsonage on a church property;
      (2)   Dormitories on an educational campus, providing that the residents of the dorms are enrolled in the school; or
      (3)   A caretaker of the residence.
