The purpose of the General Industrial District is to allow for the development of business uses associated with the processing or combining of raw products or materials in which the process may create noises, odors, or other objectionable attributes to neighboring districts.

   (a)   Uses permitted in Section 1266.02 (LI).

   (b)   Rail road yard or shop.

   (c)   Sawmill.

   (d)   Petroleum bulk plant.

   (e)   Brewery.

   (f)   Meat packing.

   (g)   Concrete or asphalt plant.

   (h)   Water towers, observation towers, transmission towers, flagpoles, television and radio antennas.

   (i)   Recycle process points.

   One sleeping unit attached to a permitted use.

   (a)   Any other use that is determined by the Board, to be of the same general character as the above permitted uses.

   (b)   Adult entertainment businesses per Chapter 1280 (see Section 1267.08, exception 2).

   (c)   Landfills.

   (d)   Poultry houses, or other livestock feed operations, with aggregate buildings being larger than 20,000 square feet.

   (e)   Vehicular race courses, drag strips.

   (f)   Airport.

   (g)   Enlargement of an existing one-family dwelling.

   (h)   Construction and demolition waste disposal facility.

   (i)   Salvage yard.

   (j)   Junk yard.

   (k)   Scrap metal transfer facility.

   (l)   Scrap metal processing facility.

   (m)   Scrap tire yard.

   (n)   Solid waste facility.

   (o)   Solid waste disposal facility.

   (p)   Solid waste transfer facility.

   (q)   Medical marijuana cultivators as defined at OAC 3796:1-1-01(9) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.

   (r)   Medical marijuana processors as defined at OAC 3796:1-1-01(39) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.

   (s)   Adult use cultivators as defined at R.C. § 3780.01(A)(4) and 3780.01(A)(19) - (21) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.

   (t)   Adult use processors as defined at R.C. § 3780.01(a)(7) provided that such facility is in full and complete compliance with the requirements and restrictions of all applicable sections of the OAC and the Ohio Revised Code as well as all applicable licensing and reporting requirements of the Codified Ordinances of the City of Newark, Ohio.

   Accessory structures shall comply with Chapter 1274.

   (a)   The floor area in this district is unlimited.

   (b)   The combined square footage of the footprint of all buildings and structures on a given lot shall not be more than thirty-five percent of the lot area exclusive of any lot area in the floodway.

   (c)   New construction, including additions, shall be reviewed by Planning Commission for compliance with the City's current Development Regulations. The items to be considered in determining compliance include, but are not limited to, the following: roadway improvements, access management, traffic congestion prevention, storm water management, floodplain management, public utility connections, FAA requirements and landscaping requirements.

   (d)   All uses in this district shall comply with the applicable requirements of Chapter 1296.

   (e)   No building customarily used for night operation shall have any opening, other than stationary windows or required fire exits, within 200 feet of any R-District, and any space used for loading or unloading commercial vehicles in connection with such an operation shall not be within 150 feet of any R-District.

   (f)   No residential uses shall be permitted in the GI District, except as accessory uses to a permitted use.

   (g)   For permitted or conditional uses occurring outside of a building, no activity shall be permitted within fifty feet of any property line and not within two hundred feet of a residential district.

   (h)   For uses permitted in Section 1267.04(g) through (p), operations shall be conducted within and area enclosed on all sides with a solid wall or uniform fence not less than eight feet in height.

   (i)   For all uses in this district which require a license from a separate agency, the applicant shall provide proof of such approval.

   (j)   For uses in this district dealing in solid waste materials, construction and demolition materials, junk, salvage materials, recyclable household materials and scrap metal materials, the applicant shall comply with the relevant and appropriate Ohio Revised Code sections, in addition to other relevant City ordinances.

   (a)   Within 200 feet of any R-District, no structure shall exceed three stories or fifty feet in height, and no structure otherwise shall exceed in height the distance measured to the centerline of any street.

   (b)   Water towers, observation towers, transmission towers, flagpoles, television and radio antennas shall not be limited in height.

   (a)   The following minimum requirements shall apply, except as provided in Chapters 1270 and 1271.

 

 

   (b)   Distance from R-Districts. With the exception of uses occurring at the time of the enactment of this Zoning Code, and of those substitution uses considered by the Board to be of the same general character of the pre-existing uses, buildings in the General Industrial District shall be located no less than 200 feet from any R-District.

   Off-street parking and loading spaces shall be provided in accordance with Chapter 1290.

   Corner lots shall meet the requirements of Section 1240.11.

   (a)   Front yard setbacks from public and private roadways shall be modified in accordance with the thoroughfare maps maintained by the office of the City Engineer.

   (b)   Lots with no legal access to an adequate public right-of-way shall obtain approval from the Planning Commission for the proposed access prior to issuance of a zoning certificate. Approval of a lot split by the Planning Commission is evidence of an acceptable legal access.

   Deed restrictions and covenants may establish additional restrictions.

   In this district, a one-family dwelling and related accessory structures on a single lot or parcel in existence at the time of the adoption of this Code may be repaired or altered in accordance with Chapters 1242, 1248, 1249, or 1251 as determined by the Zoning Inspector.

   Notwithstanding the provisions of Section 1267.02, Permitted Uses and 1267.04, Conditional Uses, the following listed uses shall be prohibited in the GI General Industrial District:

   (a)   Medical marijuana dispensaries as defined at OAC 3796:1-1-01(13) and adult use dispensaries as defined at R.C. § 3780.01(A)(5).
